Tryon Street and Atando Avenue Charlotte, North Carolina Brownfields Project No. 26008-22-060 H&H Job No. EMB.005 Dear Bill: 1.0 Introduction On behalf of ATANDO-CLT QOZB, LLC (Prospective Developer or PD), Hart & Hickman, PC (H&H) has prepared this Annual Redevelopment Summary Report for the Moss Trucking Company Brownfields property (Brownfields Project No. 26008-22-060) located at 3027 and 3035 N. Tryon Street in Charlotte, Mecklenburg County (Site). The Site consists of an approximately 7.6-acre parcel (Parcel ID: 08502101) of land located in a rapidly densifying area of the North Davidson (NoDa) neighborhood approximately 2 miles northeast of uptown Charlotte. A Site location map is provided as Figure 1, and the Site and surrounding area are shown in Figure 2. As indicated in the North Carolina Department of Environmental Quality (DEQ) approved Environmental Management Plan (EMP) prepared for the Site and dated April 6, 2023, redevelopment plans include the demolition of the existing Site buildings, mass grading and utility installation activities, and the construction of a high-density apartment complex with amenity Mr. Bill Schmithorst January 30, 2024 Page 2 s:\aaa-master projects\embrey (emb)\emb.005 3027 n tryon street brownfields\redevelopment summary report\2024 submittal\final to deq\26008 - moss trucking co._annual redevelopment summary report_january 2024.docx spaces and a parking deck. Redevelopment activities at the Site are currently underway and are being conducted following the DEQ-approved EMP. A copy of the redevelopment Site Plan prepared by LandDesign is provided in Appendix A. The approved EMP indicates that a report of environment-related activities will be prepared for submittal to DEQ Brownfields each year for as long as physical redevelopment of the Brownfields property continues. This report has been prepared to meet the annual redevelopment reporting requirement outlined in the approved EMP. A summary of environment-related activities associated with redevelopment of the Brownfields property is provided in the following sections. 2.0 Environmental Related Redevelopment Activities Redevelopment activities at the Site in 2023 generally included demolition of the on-Site buildings, installation of erosion control measures, stream relocation activities, soil import and initial mass grading activities, utility installation, and removal of a previously closed-in-place underground storage tank (UST). The sections below include summaries of activities associated with soil management and UST removal activities. 2.1 Import Soil To achieve the desired grades, approximately 16,000 cubic yards of beneficial fill was imported to the Site. Approximately 3,000 cubic yards of beneficial fill were imported from the National Cash Register Brownfields property (Brownfields Project No. 26074-22-060). Approximately 3,000 cubic yards of beneficial fill were imported from the Ikea Boulevard property located at 9021 Drivers Way in Charlotte. Additionally, approximately 10,000 cubic yards of beneficial fill were imported from the Bryton property located at 13615 Roderick Drive in Huntersville. The soil was approved for import to the Site by DEQ in letters dated October 31, 2023, November 17, 2023, and November 29, 2023, respectively. Redevelopment activities in 2023 did not include exporting soil from the Site. Trucking logs for imported fill are included in Appendix B. Mr. Bill Schmithorst January 30, 2024 Page 3 s:\aaa-master projects\embrey (emb)\emb.005 3027 n tryon street brownfields\redevelopment summary report\2024 submittal\final to deq\26008 - moss trucking co._annual redevelopment summary report_january 2024.docx 2.2 Previously Closed-In-Place UST Removal A 6,000-gallon former heating oil UST was closed-in-place at the Site in November 1997 (associated with NC DEQ Incident No. 18243). Due to its close proximity to a former Site structure, the 6,000-gallon UST was closed in place using an inert foam and was not removed at the time of closure. Soil sampling completed by others at the time of tank closure in November 1997 did not indicate significant soil impacts in the vicinity of the closed-in-place UST, and DEQ issued a risk-based No Further Action (NFA) letter for the release incident on February 28, 2008. As part of Phase II Environmental Site Assessment (ESA) activities conducted at the Site by H&H in May 2022, one soil boring (SB-3) was advanced adjacent and downgradient of the closed-in- place UST, and a soil sample was collected for laboratory analysis. Laboratory analytical results for soil sample SB-3 indicated low levels of several petroleum-related volatile organic compounds (VOCs) and semi-volatile organic compounds (SVOCs) at concentrations above laboratory detection limits but below the Residential and Industrial/Commercial Preliminary Soil Remediation Goals (PSRGs). The metal hexavalent chromium was detected in soil sample SB-3 at a concentration above the Residential PSRG but below the Industrial/Commercial PSRG and generally consistent with the Site-specific background range for naturally occurring metals. To allow for the placement of structural fill before construction of the planned apartment building, the previously closed-in-place UST was removed on November 8, 2023. H&H did not observe obvious evidence of significantly impacted soil during the removal of the closed-in-place UST. Based on grading plans, the soil underlying the former UST is below the proposed final grade for this portion of the Site and will be covered by a hardscaped amenity courtyard. Therefore, no additional soil sampling was completed following the removal of the UST in accordance with the DEQ-approved EMP. Building construction activities at the Site have not commenced and no VIMS installation activities were completed in 2023. Details associated with VIMS installation activities will be documented in reports under separate cover. 3.0 Summary In summary, redevelopment activities at the Moss Trucking Company Brownfields property are ongoing and are being conducted in accordance with the DEQ-approved EMP. Redevelopment activities completed at the Site in 2023 generally included demolition of the on-Site buildings, installation of erosion control measures, stream relocation activities, soil import and initial mass grading, utility installation, and removal of a previously closed-in-place UST.
