The reports are entitled: Phase I Limited Site Assessment Report dated September 15, 2009, and Soil Sampling Report dated February 11, 2010. The site property was formerly used as a gasoline station that included underground storage tanks (USTs). The Department understands that when the property was purchased you did not know that USTs were ever located on the site. As you came to determine, the site property formerly included one 280-gallon heating oil UST, two 1,000-gallon gasoline USTs, and one 5,000•gallon UST. The tanks and contaminated soil were removed in 1997. Based on their removal, a release of petroleum related compounds was indicated. A tank closure report wassubmitted in 1997. Due to the documented presence of contamination remaining from the UST closure, the subject property was accepted by the State for inclusion to the list of sites awaiting State -Lead cleanup. The results of the receptor suvey showed no indication of potential receptors within 1,000 feet of the site property. One monitor well was installed. Soil samples were not collected at the time of monitor well installation because the depth to bedrock was very shallow. As stated, groundwater testing was performed. Based on the laboratory analysis of the groundwater sample, there were volatile organic compounds reported but they were present at levels below the unrestircted use standard (NC 2L Standard for groundwateror present at a level that has no established standard at this time. Because there are no users of groundwater in the area and that water is suppplied by the City of Durham, groundwateruse is not a viable option at this site property. Based on the Phase I LSA results, follow up soil sampling was performed around the perimeter of the former tank pit area in December 2009. Eight soil borings were advanced and soil samples collected. From the laboratory analysis ofthe samples, there were no reported petroleum -related or volatile organic compounds reported in the samples. Meaning, for soils there were no petroleum related compounds reported, and therefore no concentrations above the State of North Carolina soil -to -groundwater maximum soil contaminant concentration standard. Based on the receptor survey and the results of the soil and groundwater testing at the site, the UST Section has determined that no further action is warranted for this incident. This determination shall apply unless the UST Section later determines that the discharge or release poses an unacceptable risk or a potentiallyunacceptable risk to human health or the environment or additional information is provided to warrant re -assessment of the site. Pursuant to 15A NCAC 2L .0115(e), you have a continuing obligation to notify the UST Section of any changes that you know of or should know of, that might affect the level of risk assigned to the discharge or release. Analytical results for the groundwater samples collected from monitoring well MW1 did not indicate the presence of petroleum -type organic compounds at concentrations in excess of the 2L Standard. Chloroform was detected at a concentration of 0.90 µg/L, Ethanol was detected at a concentration of 6,600 µg/L, and C5-CS Aliphatic Hydrocarbons were detected at a concentration of 54 µg/L. Lead was detected at a concentration of 33 µg/L. This concentration is in excess of the 2L Standard, but is less than the GCL for lead. Analytical results are summarized in Table 4 and are presented on Figure 4. The analytical report is contained in Appendix D. 6.0 CONCLUSIONS AND RECOMMENDATIONS Terraquest performed various activities associated with the completion of a Phase I LSA. Primary assessment efforts focused on determining potential receptors in the area as well as determining onsite groundwater quality; both critical steps in determining the risk ranking of the site. Groundwater analytical results indicate that only lead is present at concentrations exceeding its 2L Standard, but less than its GCL. Since the site does not meet any of the other criteria that would rank it a High or Intermediate Risk, the release incident should be ranked a Low Risk with an Industrial/Commercial land use. According to the Durham County Deed of Records, it appears that you are the current property owner. Based on Department information, the property was purchased along with an adjacent property by Barney West, etal, on June 27, 1985. According to an affadavit provided by Jack West, received by the Department's Raleigh Regional Office (RRO) on November 9, 2000, the West family was not aware that there were USTs located on the property at the time it was purchased. In 1997, the West family had the USTs removed. At the time of UST removal soil samples were obtained and submitted for laboratory analysis. The laboratory results indicated soil contamination present above the State of North Carolina action levels. Because the former owners of the USTs are no longer available, there is no responsible party available to pursue further assessment and/or remediation activities. Due to the documented presence of contamination remaining at the site, additional assessment and/or remediation may be necessary. According to the information on file, you are not considered the owner or operator of the USTs pursuant to G.S. 143-215.94A. To determine the risk posed by the contamination at the subject property, the UST Section will need to access your property in order to take all reasonable and necessary action(s) to conduct assessment and remedial activities necessary to protect human health and the environment. The above referenced incident is a commercial property located at 302 East Pettigrew Street in Durham, Durham County. The property was purchased along with the adjacent property by Barney H. West and wife, Carol C. West, and Manley Jackson West and Wife, Sara N. West on June 27, 1985. As discussed below and stated in an affidavit by Jack West received by RRO November 9, 2000. At the time the property was purchased the buyers (West Family) were not aware of the presence of USTs on the subject site. After the property was purchased the West family became aware that the USTs were in the ground and removed the tanks at their own cost. On June 12, 1997, Aquaterra Engineering (Aquaterra) removed two 1,000-gallon gasoline USTs, one 5,000-gallon gasoline UST, and one 150-gallon fuel oil UST from the above referenced location. The 24-hour release form indicated the tanks were taken out of service in the 1960's. This information was presented in an Underground Storage Tank Closure Assessment Report dated July 25, 1997. This report also describes over -excavation activities of two tank pits and soil sampling conducted. The two 1,000-gallon gasoline DST's were located together in one tank pit and the 5,000-gallon gasoline UST was located in a separate tank pit. The UST Closure Report did not identify sampling or over -excavation of soils associated with the 150-gallon fuel oil UST. Approximately 52 tons of impacted soil was removed from the two tank pits. Four soil samples (T3-1, T3-2 T2-1, and T2-2) were collected from the base of the excavation at 7 feet bgs of the two 1,000-gallon gasoline tank pit and two soil samples (T4-1 and T4-2) at 8.5 feet An Eq.,al r>f;t>ortiarii yrAffirriiativE, Action Employer - 50% Rocycied, 101i4, Post Cons ncr Pa Per bgs of the 5,000-gallon gasoline tank pit. Over -excavation was limited due to the danger of damaging the adjacent street (East Pettigrew Street). The tank pits were backfilled with approximately 36 tons of soil and 16 tons of stone. Analytical results from the soil samples collected reported GRO - T2-1 at 14 mg/kg, T3-1 at 23 mg/kg, T3-2 at 310 mg/kg, and T4-1 at 2,100 mg/kg. T2-2 and T4-2 were reported bql. Groundwater was not identified / sampled during closure procedures. RRO issued a NORR on October 10, 2000, after reviewing the UST Closure Report. The NORR required additional assessment and/or conduct a LSA. October 13, 2000 — Phone record from RRO - states: Mr. West was under the impression the incident was closed. He stated that someone from DENR visited the site in 1997 and informed him that further assessment was not necessary. He also stated, over excavation stopped due to the danger of damaging the adjacent street. The rest of the phone interview states property ownership as listed below. November 17, 2000 — RRO sent letters requesting affidavits to various potential RP's to determine regulatory responsibility. Potential RP's contacted: Jack West Dibrell Brothers, Inc. A.C. Williams Marvin L. Barnes (registered agent: M.M. Fowler, Inc) Per the affidavit submitted by Jack West: • He nor his partners were aware of the USTs prior to the purchase of the property on June 27, 1984 when the property was purchased from C.W. Walters Co., Inc., a subsidiary of Dibrell Brothers. • A Gulf station operated on the site from as early as 1938 until the mid- 1960's. • 1947 — 1961 the gas station was known as Williams' gulf — operated by A.C. ("Preacher") Williams of 1203 East Oak Street, Durham, NC • 1961 — 1964 the gas station was known as Thompson Gulf, Clark's Gulf and Sutton Gulf. — operated by M.M. Fowler, Inc. of 1529 S. Miami Blvd, Durham, NC 27703. (M.M. Fowler leased the station from the C.W. Walters Tobacco Company pursuant to a ground lease) On September 26, 2008, RRO contacted (via phone conversation) Barney West. Barney West is Jack West uncle. Barney is also the registered agent for RXP LLC, the corporation that now controls the subject site. RRO contacted Mr. Barney West to discuss site activities, specifically if additional work has been conducted since 2000, also the status of development at the site. No environmental activities have been conducted since the closure report and the site remains a vacant lot. Mr. Barney West also stated that he did not receive nor was he aware of the October 2000 NORR that was sent to Jack West. Mr. Barney West stated that Jack West moved from the address on the NORR, he was not sure of the date he moved and that Jack may not have received the NORR either. October 21, 2008 — RRO visited the site. The property is a vacant lot located on the corner of Pettigrew Street and Roxboro Road. The majority of the property surface is covered with concrete. The area surrounding the former tank pits does not appear to be capped with concrete. Refer to the attached site photographs. Based on receptors identified by LSA's conducted in the area (Incident number 22086 U-Haul 782-57 facility which was also submitted for State Lead), the site is suspected to be a low risk, dependent on soil and groundwater analytical results. Based on the above listed information the responsible parties for this incident have not been positively identified. The northeast corner of the site was operated as a gas station from as early as 1938 until the mid-1960s. From approximately 1947 until 1961, the gas station was known as Williams' Gulf and was operated by A.C. ("Preacher") Williams of 1203 East Oak Street, Durham, NC (919-3 83-2805). During the period of 1961 to 1964 the station was known as Thompson Gulf, Clark's Gulf and Sutton Gulf. I am informed that the gas station operators subleased the property from the local Gulf distributor, M.M. Fowler, Inc.,1529 S. Miami Blvd., Durham, NC 27703-5625. Marvin L. Barnes of 4220 Neal Road, Durham, NC 27705 is.the President and Registered Agent for M.M. Fowler, Inc. I am further informed that M.M. Fowler, Inc. leased the gas station site from the previous owner of the property, C.W. Walters Tobacco Company pursuant to a ground Lease. C.W. Walters Tobacco Company is a subsidiary of Dibrell Brothers, Inc. which has addresses of P.O. Box 681, Danville, VA 24543 and 512 Bridge Street, Danville; VA 24541 (804-792-751 I). Describe preparations for closure including the steps taken to notify authorities, permits obtained and the steps taken to dean and purge the tanks The Raleigh Regional Office of the Division of Water Quality was notified of the UST closures by the submittal of the GW/UST-3 Notice of Intent form, which is included in Appendix A. The Durham County Fire Department was also notified of the UST closure. A permit was -obtained from this department prior to UST closure. The UST contained pumpable residual material at the time of tank closure. A & D removed this material and pumped it into a tank truck. The oxygen content and Lower Explosive Limit (LEL) of the internal atmosphere of the UST were measured using an Oxygen/LEL meter and found to be within acceptable ranges (less than 10% of the LEL) and were approved by.the local Fire Marshall. B. Note the amount of residual material pumped from the tank(s): UST-1 — N/A UST-2 — see note below UST-3 - see note below UST-4 a see note below Note. Three manifests were generated for the disposal of petroleum water removed from tanks in the amount of 3,290-gallons, 3,830-gallons, and 623-gallons. This total amount was removed from USTs 2,3, and 4. The exact amount removed from each tank is nor known. C. Describe the storage, sampling and. disposal of the residual material: Residual material was transported off -site by A&D Environmental. D. Excavation Note: Refer to the "Groundwater Section Guidelines for the Investigation and Remediation of Soils and Groundwater" on limiting excavations. Cover material was removed to expose the top of the UST and the associated piping. The piping was disconnected and all openings in the UST were plugged. The excavation was extended to the bottom of the UST. All soil removed from the UST excavation was screened with a photoionization detector (PID) by Aquaterra personnel. The final dimensions of the UST excavations were; UST-1 -. 4' x 6' UST-2 — 17' x 14' UST-3 — 17' x 14' UST4 — 4' x 6' 2. Note the depth of tank burial(s) (from land surface to top of tank): UST-1 was buried approximately 0.5 feet below grade. USTs-2, and 3 were buried approximately 3.0 feet below grade UST-4 was buried approximately 1 foot below grade 3. Quantity of soil removed: Approximately 52 tons of impacted soil was removed from the excavation of the four tanks and stockpiled on -site. 4. Describe soil type(s): The soil type encountered during the UST closure consisted of a gray to dark .brown sandy silt. 5. Type and source of backfill used: Approximately 36 tons of soil and 16 tons of stone were obtained for backfill from B&B Topsoil Mine, Inc. located at 1800 Hamlin Road in Durham North Carolina. E. Contaminated Soil Note. Suspected contaminated roil should be segregated from soil that appears to be uncontaminated and should be treated as contaminated until proven otherwise. Two soil samples (T3-1 and T3-2) were collected from under UST-3 from a depth of approximately 7.0 feet bgs. Two soil samples (T4-1 and T4-2) were collected from under UST-4 from a depth of approximately 8.5 feet bgs. Due to safety concerns, all soil samples were obtained from the excavator bucket. All soil samples were submitted for analysis of low boiling point hydrocarbons by EPA Method 5030 and 3550. See Figure 2 for soil sampling locations. C. Describc groundwater or surface water sampling procedures used: Note. Refer to the "Groundwater Section Guidelines for the Investigation and Remediation of Soils and Groundwater "for information about sampling requirements. No ground water or surface water samples.were collected during the UST closures. D. Quality control measures ■ Describe sample handling procedures including sample preservation and transportation Samples selected -for laboratory analysis are collected into laboratory provided containers appropriate for the parameters being analyzed and are labeled with a minimum of the following information: sampler's name, date of collection, sample aumber, analysis to be performed, and project number. In order to prevent cross -contamination of samples, clean, new nitrile gloves are worn during sample collectioa and are changed between samples. Soil samples are stored and transported to the analytical laboratory in an insulated cooler and are chilled to approximately 4°C. Analytical results of soil samples analyzed by EPA Method 5030 indicated TPH concentrations ranging from below the detection limit to 2,100 mg/kg. Specifically, TPH concentrations in the form of gasoline were detected in sample T2-1 at 14 mg/kg, sample T3-1 at 230 mg/kg, sample T3-2 at 310 mg/kg, and sample T4-1 at 2100 mg/kg. Confirmatory laboratoryanalytical results from the soil samples collected from beneath the UST did indicate the presence of TPH -as gasoline. Aquaterra recommends that a copy of this report be submitted to the North Carolina Department of Environment, Health and Natural Resources, Division of Water Quality, Winston- Salem Regional Office.
