A Street Kannapolis, North Carolina Brownfields Project No. 22031-18-013 H&H Job No. LSG-001 1.0 Introduction and Background Hart & Hickman, PC (H&H) has prepared this Pre-Occupancy Sub-Slab Vapor Sampling Report on behalf of Right Field Development, LLC (Prospective Developer) to document the results of sub-slab sampling activities conducted at the Stadium Lofts/VIDA 3/Block 4 South mixed-use building at the K-Town Furniture Brownfields property (Brownfields Project No. 22031-18-013) located in Kannapolis, Cabarrus County, North Carolina (Site). On January 17, 2020, a Brownfields agreement between the North Carolina Department of Environmental Quality (DEQ) and the City of Kannapolis was recorded for the Site. The Site is comprised of five contiguous parcels of land identified as Cabarrus County PIN numbers 56145072260000, 56146012190000, 56146001440000, 56146000050000, and 56135999030000 that total approximately 9.2 acres. Parcel 56145072260000 has been redeveloped by the City of Kannapolis with a minor league baseball stadium. The former buildings on Parcels 56146012190000, 56146001440000, 56146000050000, and 56135999030000 have been razed, and the land has been graded for future redevelopment activities. A Site location map is provided as Figure 1, and a Site Map is included as Figure 2. Right Field Development, LLC has acquired a portion of the Site (Parcels 56146001440000 and 56146012190000) for redevelopment of one mixed-use building (referred to as Stadium Lofts, VIDA 3, or Block 4 South) with commercial/retail space at ground level and high-density residential units above and a second mixed-use building (referred to as Block 4 North) with three levels of parking near ground level and mixed-use and high-density residential units above. Terms of the Brownfields agreement indicate that physical redevelopment of the Site should be completed in accordance with a DEQ-approved Environmental Management Plan (EMP). DEQ provided approval for the EMP dated August 8, 2018. In addition to the EMP, terms of the Brownfields agreement indicate that no enclosed building for residential use can be constructed on the Brownfields property until DEQ provides written notification that the building is protective of the building occupants from risks associated with vapor intrusion. This is typically accomplished through design and installation of a DEQ-approved vapor intrusion mitigation plan (VIMP) or by demonstrating to DEQ through vapor intrusion sampling that vapor barriers or mitigation systems are not warranted. To obtain updated vapor intrusion assessment information for the Site, H&H conducted supplemental vapor intrusion assessment activities in February 2022. The vapor intrusion assessment activities consisted of the collection of ten (10) soil gas samples (VMP-5 through VMP-14) from the building footprints of the proposed Block 4 North and Block 4 South buildings. The vapor intrusion assessment activities were conducted in accordance with the DEQ-approved Supplemental Vapor Intrusion Assessment Work Plan dated February 9, 2022. Results of the supplemental vapor intrusion assessment activities were provided to DEQ in the Supplemental Vapor Intrusion Report dated February 24, 2022 (VI Report). As discussed in the VI Report, results of the supplemental vapor intrusion assessment activities indicated that cumulative health risks associated with the concentrations detected in the soil gas samples did not exceed DEQ and EPA acceptable risk levels for vapor intrusion based on residential and non- residential land use scenarios. In addition, trichloroethylene (TCE) was not detected above laboratory method detection limits (MDLs) in the soil gas samples. As such, vapor mitigation for the Block 4 South and Block 4 North buildings was not proposed. A tabular summary of the laboratory analytical results and a copy of the risk calculator results for the February 2022 soil gas sampling event are provided in Appendix A. 3 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx Although results of the supplemental vapor intrusion assessment activities did not indicate the presence of a vapor intrusion risk above DEQ and EPA thresholds, DEQ requested that the PD conduct sub-slab sampling in the proposed buildings to further evaluate potential vapor intrusion risk following building construction and prior to occupancy (“pre-occupancy”). To aid in the DEQ-requested pre-occupancy sub-slab sampling, H&H prepared and submitted the Pre-Occupancy Sub-Slab Vapor Sampling Work Plan (Work Plan) to DEQ on July 24, 2023. The Work Plan was subsequently approved by DEQ on July 25, 2023. This report includes a description of the pre-occupancy sub-slab sampling for the Stadium Lofts/VIDA 3/Block 4 South Building. 4 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx 2.0 Sub-Slab Vapor Sampling Activities The sub-slab vapor sampling activities described herein were conducted in accordance with the DEQ Inactive Hazardous Sites Branch (IHSB) Guidelines for Assessment and Cleanup of Contaminated Sites (Guidelines) dated September 2022, the DEQ Division of Waste Management (DWM) Vapor Intrusion Guidance (VI Guidance) dated March 2018, most recent versions of the U.S. Environmental Protection Agency (EPA) Region IV Quality System and Technical Procedures for Laboratory Services and Applied Science Division (LSASD) guidance, and DEQ- approved Work Plan. Prior to conducting the sub-slab vapor sampling activities, H&H notified North Carolina 811, the public utility locator, to mark subsurface utilities on the Site. H&H also contracted a private utility locator to screen proposed sample locations for subgrade utilities and obstructions and to confirm the public utility locator markings using electromagnetic and ground-penetrating radar methods. 2.1 Sub-Slab Vapor Sampling Methodology As discussed in the DEQ-approved Work Plan, H&H installed and sampled nine sub-slab vapor sampling points (SSV-1 through SSV-9) in the concrete slab of the existing building to evaluate the potential for structural vapor intrusion into the proposed Site building following installation of the building slab. The locations of the sub-slab monitoring points are shown in Figure 3. The sub-slab vapor (SSV) sampling points were installed using a rotary hammer drill and 1½-inch diameter drill bit to advance a pilot hole into the concrete slab to a depth of approximately 1¾ inches below the surface. A drill guide was then placed in the pilot hole, and a 5/8-inch diameter drill bit was utilized to advance the boring through the concrete slab and approximately 6 inches into the underlying soil. Following concrete borehole advancement, loose concrete cuttings were removed from the boring utilizing a bottle brush, and a Cox-Colvin Vapor Pin™ (vapor pin) assembly (stainless-steel sampling point and silicone sleeve) was installed in the borehole using an installation/extraction tool and dead blow hammer. 5 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx The sub-slab vapor samples were collected utilizing laboratory-supplied 1-liter Summa® canisters connected to an air-flow regulator calibrated by the laboratory to collect the sub-slab vapor sample at a rate of approximately 100 milliliters per minute (ml/min). Prior to the collection of the sub- slab vapor samples, a “shut-in” test was conducted on the sampling train, and helium leak checks were conducted at each sampling point. The purpose of the shut-in test and helium leak check was to ensure short-circuiting with ambient air did not occur during sampling. A description of the shut-in test and helium leak testing procedures is provided below. The shut-in test was conducted by connecting the flow regulator with the vacuum gauge to the Summa® canister and sealing the flow regulator with the laboratory-provided brass cap. Once the sampling train was “closed,” the sample valve on the Summa® canister was opened and the reading on the vacuum gauge was recorded. The Summa® canister sample valve was then closed, and the vacuum gauge was observed to ensure no vacuum loss occurred. If the vacuum reading remained the same, the shut-in test was considered successful. Results of the shut-in tests performed on each Summa® Canister are provided in the Summa Canister Shut-in Test Field Form provided in Appendix B. As shown in Appendix B, each of the Summa® canisters utilized during the sampling event passed the shut-in test. Following the shut-in test, the Summa® canister was connected to the sample point via Teflon® sample tubing using a brass nut and ferrule assembly to create an air-tight seal and the leak check was performed. The leak check was performed by constructing a shroud over the sampling train and flooding the shroud with helium gas. A calibrated helium gas detector was then utilized to measure helium concentrations within the shroud. Once helium concentrations stabilized within the shroud, the sample tubing was purged outside of the shroud using a syringe and a three-way valve to collect purged sub-slab vapor into a Tedlar® bag. The purged sub-slab vapor was then analyzed using the helium gas detector to ensure that helium concentrations in the sub-slab vapor were less than 10% of the helium concentrations measured within the shroud. Results of the leak checks at each sample point are provided in the Sub-Slab Vapor Installation Field Forms provided in Appendix B. 6 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx Following successful leak checks, the valve on the flow regulator was fully opened to allow the collection of the sub-slab samples. Vacuum readings on the Summa® canister were recorded prior to and following the sampling period to ensure adequate sample volume was collected. A vacuum of approximately 5 inches of mercury or more was maintained within the canisters at the conclusion of the sampling event in accordance with DEQ DWM guidance. Following sample collection, the Summa® canisters were shipped to a laboratory under standard chain of custody protocols for analysis of volatile organic compounds (VOCs) by EPA Method TO-15. The laboratory used reporting limits that are below DEQ DWM Residential Vapor Intrusion Soil Gas Screening Levels (SGSLs). Following sample collection, the vapor pins were sealed and capped with a secure stainless-steel cover. The sample locations were estimated using a hand-held GPS unit or by measuring from known benchmarks within the buildings (e.g., doors, windows, exterior walls, etc.). 2.2 Quality Assurance/Quality Control Non-dedicated equipment and tools were decontaminated prior to use at each sample location. One duplicate sub-slab vapor (SSV-DUP) was collected from sub-slab vapor sample location SSV-8 for quality assurance/quality control (QA/QC) purposes. The duplicate sample was collected using a laboratory-supplied T-fitting which allows for the collection of two samples from one sampling point simultaneously. The duplicate sub-slab vapor sample was submitted for analysis of VOCs by EPA Method TO-15. The laboratory analytical results of the duplicate and parent samples are summarized in Table 1. As shown in Table 1, compounds and concentrations detected in the parent sample and duplicate sample are similar. This result indicates good laboratory reproducibility. 7 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx 3.0 Sub-Slab Sample Results The sub-slab soil vapor sample analytical results are summarized in Table 1. The results were compared to the DEQ DWM Residential and Non-Residential Vapor Intrusion Sub-Slab and Exterior Soil Gas Screening Levels (SGSLs) dated July 2023. The laboratory analytical report and the chain of custody record are provided in Appendix C. Laboratory analytical results indicate the presence of several compounds above laboratory MDLs in the samples. The following compounds were detected above their respective Residential SGSLs. • Chloroform was detected above the Residential SGSL of 4.1 µg/m3 in sub-slab vapor samples SSV-1 (5.2 µg/m3), SSV-3 (4.6 µg/m3), SSV-4 (35 µg/m3), SSV-5 (6.3 µg/m3), SSV-6 (24 µg/m3), and SSV-8/SSV-DUP (6.9/7.9 µg/m3). • 1,2-Dibromoethane (EDB) was detected above the Residential SGSL of 0.16 µg/m3 in sub- slab vapor samples SSV-3 (0.58 B J µg/m3), SSV-4 (0.61 B J µg/m3), SSV-5 (0.65 B J µg/m3), SSV-6 (0.55 B J µg/m3), SSV-7 (0.61 B J µg/m3), and SSV-8/SSV-DUP (0.61 B J / 0.65 B J µg/m3), and SSV-9 (0.61 B J µg/m3). The “B” qualifier indicates that the compound was detected in the associated laboratory method blank. As such, the concentrations detected are attributable to laboratory contamination and not representative of Site conditions. No other compounds were detected at concentrations above DEQ DWM Residential SGSLs and compounds were not detected above DEQ DWM Non-Residential SGSLs in sub-slab vapor samples collected at the Site. Low-level concentrations of tetrachloroethylene (PCE) were detected in SSV-4 (2.2 µg/m3), SSV-5 (1.4 µg/m3), SSV-6 (1.4 µg/m3), SSV-7 (2.1 µg/m3), SSV-DUP (0.98 J µg/m3), but the concentrations detected are multiple orders of magnitude below the Residential SGSL of 280 µg/m3. A trace concentration of trichloroethylene (TCE) was also detected slightly above the laboratory MDL in sample SSV-4 (0.45 J µg/m3). TCE was also not detected in the previous groundwater samples collected at the Site. Based on discussions with multiple key laboratories that manage the majority of vapor sampling analyses in North Carolina, Summa® canisters (both batch-certified and individually certified) can potentially contain “J-values” of TCE from carryover from previous samples or within the laboratory equipment used to analyze or clean the canisters. These laboratories have also indicated that certified canisters are not certified to be less than the laboratory MDLs, rather they are only certified to the laboratory reporting limits, or in one case, to half of the reporting limit. As such, a “J-value” of TCE may be present in a Summa® from laboratory equipment carryover. Because the TCE concentration detected in SSV-4 is an estimated “J-value”, and TCE was not detected in the previous soil gas samples and groundwater samples collected at the Site, or other sub-slab vapor samples, the TCE concentration in SSV-4 is likely attributable to laboratory carryover or contamination from laboratory equipment. Risk Evaluation The DEQ DWM Vapor Intrusion SGSLs are conservative and based on a target carcinogenic risk (TCR) of 1 x 10-6 and a hazard quotient (HQ) of 0.2 for potential non-carcinogenic risks. The DEQ and EPA typically acceptable risk level for potential carcinogenic risks is a cumulative lifetime incremental cancer risk (LICR) of 1 x 10-4 or less, and the acceptable level for non-carcinogenic risks is a cumulative hazard index (HI) of 1 or less. The HI is the sum of hazard quotients (HQs) for each target analyte. To further evaluate sub-slab vapor concentrations, H&H utilized the DEQ Risk Calculator (July 2023) to calculate potential vapor intrusion risks associated with the concentrations detected in the sub-slab vapor samples. Although the lower level of the Block 4 South building is commercial and retail (with residential units above the first floor), H&H modeled a worst-case scenario by using the highest concentrations of any compound detected below the slab based on a residential use scenario to conservatively evaluate potential vapor intrusion risks. The calculated cumulative LICR and HI values are provided in Table 1, and copies of the completed DEQ Risk Calculators are provided in Appendix D. As shown in Table 1, the results of the worst-case risk calculations for sub-slab vapor indicate a calculated cumulative LICR of 1.5 x 10-5 and a HI value of 0.20. The calculated cumulative residential use LICR and HI are within the DEQ and EPA acceptable levels. 10 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx 4.0 Summary and Recommendations H&H has conducted pre-occupancy sub-slab soil vapor sampling for the Stadium Lofts/VIDA 3/Block 4 South mixed-use building located in the eastern portion of the K-Town Furniture Brownfields property in Kannapolis, Cabarrus County, North Carolina. The sub-slab vapor sampling activities were conducted in accordance with the DEQ-approved Work Plan. The sub-slab vapor sampling included the collection of nine (9) sub-slab vapor samples and one duplicate sample. Laboratory analytical results of the sub-slab vapor samples indicated the presence of chloroform and EDB above their respective DEQ DWM Residential SGSLs. Chloroform was detected in six of the nine samples above the Residential SGSL of 4.1 µg/m3 (ranging in concentrations from 4.1 µg/m3 to 35 µg/m3) and EDB was detected in seven of the nine samples above the Residential SGSL of 0.16 µg/m3 (ranging in concentrations from 0.58 J µg/m3 to 0.65 J µg/m3). However, the EDB concentrations detected are attributable to laboratory contamination based upon the results of the laboratory method blank. No other compounds were detected at concentrations above DEQ DWM Residential SGSLs and compounds were not detected above DEQ DWM Non-Residential SGSLs in the sub-slab vapor samples. To further evaluate sub-slab vapor concentrations, H&H utilized the DEQ Risk Calculator (July 2023) to calculate potential vapor intrusion risks associated with the concentrations detected in the sub-slab vapor samples. Although the lower level of the Block 4 South building is commercial and retail (with residential units above the first floor), H&H modeled a worst-case scenario by using the highest concentrations of any compound detected below the slab based on a residential use scenario to conservatively evaluate potential vapor intrusion risks. Results of the worst-case risk calculations for sub-slab vapor indicate a calculated cumulative LICR of 1.5 x 10-5 and a HI value of 0.20 for residential use. The calculated cumulative residential use LICR and HI are within the DEQ and EPA acceptable levels. Based on the results of the pre-occupancy sub-slab vapor sampling, H&H requests that the Brownfields Program provide a Compliance Review letter indicating that the occupancy of the Block 4 South building is approved. Because the Block 4 South building is not mitigated, H&H will conduct semi-annual “post-occupancy” sub-slab sampling for a minimum period of 1 year. 11 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Lansing Melbourne Group (LSG)/LSG-001 Kannapolis NC/2023 Pre-Occupancy Sampling/Report/Draft to Client/Pre-Occupancy Sub-Slab Sampling Report.docx The post-occupancy sampling will be conducted in March and September 2024. The post- occupancy sampling will include the collection of sub-slab vapor samples from the nine SSV points (SSV-1 through SSV-9) and a duplicate sample. The methods utilized for the sampling will be consistent with those described in the DEQ-approved Pre-Occupancy Sub-Slab Vapor Sampling Work Plan.
