This request was submitted on your behalf by Mr. Matt Bramlett of Hart & Hickman. (H&H) on September 29, 2023 via email. Based on our review of the data provided, DEQ Brownfields agrees that the soils from Soil Pile 4 may be exported to the following options. Stockpiled soils characterized by Soil Pile 4 data may be managed at Old 27 Landfill (1222 Old 27 Highway, Mount Holly, Gaston County, Permit No. 36A-LCOD-2010), or a Construction & Demolition (C&D) Landfill, or a Municipal Solid Waste (MSW) Landfill, or at another Brownfields Property with prior DEQ Brownfields approval. Other options may be available; however, DEQ requires that the receiving facility be identified and approved prior to export. All soil export must be conducted under a DEQ Brownfields approved Environmental Management Plan (EMP). Soils should be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, in accordance with the Kaiser Fluids Tech II Road EMP, an annual Redevelopment Summary Report will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but not limited to, total volume, general description of field screening efforts, etc. should be included with the Redevelopment Summary Report. Hi Carolyn – based on the results of the recent soil characterization activities, the contractor NVR is requesting disposal of Soil Pile 4 generated at the former Kaiser Fluids portion of the Kaiser Fluids Tech II Brownfields Property (#20026-16-060) located in Charlotte, NC to the Old 27 Land Clearing and Inert Debris (LCID) landfill facility. Soil Pile 4 is approximately 800 cubic yards in size and was generated during recent grading activities. H&H inspected soil that comprised the soil pile during recent grading activities and collected samples from the soil pile for characterization purposes. The Soil Pile 4 sample was derived from five (5) aliquot soil samples collected on September 12, 2023 and no obvious odors, evidence of soil staining, or elevated PID readings were identified during the characterization sampling activities. Soil pile sampling activities was conducted in accordance with the DEQ-approved EMP prepared for the Site. The semi-volatile organic compound (SVOC by EPA Method 8270) and the RCRA metals (plus hexavalent chromium) samples were generated from five (5) soil aliquot samples (A-E) and composited. The volatile organic compound (VOC) sample was selected from the aliquot exhibiting the highest PID reading (aliquot C = 3.2 mg/kg). Laboratory results indicated that VOCs and SVOCs were not detected at concentrations above PSRGs in the Soil Pile 4 soil sample. Arsenic (2.4 mg/kg) was detected in the Soil Pile 4 sample at a concentration slightly above the residential PSRG (0.68 mg/kg) and consistent with regional background concentrations. Based on this information, we request written approval for DEQ to allow export of soil from Soil Pile 4 to the Highway 29 LCID Landfill. Note, the soil in Soil Pile 3 will be sent to the Republic Services Speedway MSWLF based on the results of the soil characterization sampling activities.
