Dear Mr. Stolze:
At the request of Ms. Berkeley Poison, GE Financial Assurance, Woodmen of the World
may rely on the contents of the Phase I Environmental Site Assessment Report (Report)
dated April 23, 2000, conducted for GE Financial Assurance wider Clayton Project No.
20-01335.00, as prepared by Clayton Group Services, Inc., Environmental Services
(Clayton), to the extent of Clayton's scope of services associated with this project;
however, please also note that this reliance applies only to reported enviroiunental
conditions at the subject property for the time period extending only up until the date of
the written Report for the subject site.
Clayton has performed the work described in the Report as an expert in environmental
matters and certifies to Woodmen of the World that it may rely upon the findings,
conclusions and recommendations as being those of ail environmental expert, performed
in accordance with generally accepted industry standards, practices and procedures.
Please note that any use that any other third party makes other than Woodmen of the
World of this Report, or any reliance upon it, or any decision based on it, is the sole
responsibility of that third party. A third party is not afforded the status of a third party
beneficiary unless such status is expressly agreed to in writing by Clayton. Clayton is not
responsible for any damages that may be suffered by a third party as a result of any
decision made, or action taken by a third party, based on this Report.
In consideration for being able to rely on the Report, Woodmen of the World agrees that
it will not release the Report and/or the information contained in the Report to other
parties. Also, Woodmen of the World agrees that Clayton's terms and conditions that
