INTRODUCTION Ms. Berkeley Polson, Senior Loan Closing Specialist, GE Financial Assurance (GEFA), retained Clayton Group Services, Inc., Environmental Services (Clayton), to conduct a Phase I Environmental Site Assessment at Vernon Market Retail, 1304 West Vernon Avenue, Kinston, North Carolina, the subject property. 1.1. PURPOSE The objective of the assessment was to provide an independent, professional opinion regarding recognized environmental conditions, as defined by ASTM, associated with the subject property. The term recognized environmental conditions is defined as the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. 1.2. METHODOLOGY AND EXCEPTIONS This assessment was performed in accordance with GEFA's October 19, 1998 Environmental Audit (Phase I) Requirements, and ASTM E 1527-00, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. The assessment included the following components: • A walkthrough of the subject property • A review of pertinent records for evidence of historical and present use of the subject and adjoining properties Interviews with tenants and local government officials • Evaluation of information and development of this report This assessment did not include sampling or analysis of soil, groundwater or other materials. Ms. Tracy L. Talley, Staff Environmental Consultant from Clayton's Atlanta Regional Office, conducted the site walkthrough portion of the assessment April 4 and 5, 2001, unaccompanied. Information was obtained by Mr. Wayne Taylor, Food Lion Store Manager. Resumes for environmental professionals involved in this assessment are included in Appendix A. Photographs were taken at the time of the assessment (Photographs Tab). The objective of the assessment was to provide an independent, professional opinion regarding recognized environmental conditions, as defined by ASTM, associated with the subject property. This assessment was performed in accordance with GEFA's October 19, 1998 Environmental Audit (Phase I) Requirements, and ASTM E 1527-00, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. Any exceptions, additions, or deletions from these guidelines are described in the report. Details of the work performed, sources of information, findings, and assessment limitations are presented in the report. Vernon Market Retail consists of a multi tenant, single level retail building (41,885 square feet), landscaped areas, and asphalt paved parking on 5.69 acres in a residential and commercial setting. Onsite construction started February 2000, according to Building Department records. There are three tenants: Food Lion Supermarket, Realo Discount Drug, and SunCom Wireless Retail Store. The property was developed with seven buildings from at least 1965 until 1999, according to aerial photographs. Previous occupants, from at least 1953 until 1999, included: Mallard Griffin Lumber (LIST, SPILL), several automotive repair facilities [e.g., P&K Automotive (LUST, SPILL)], insurance agencies, and Candyland Daycare, according to previous reports, city directories, and Building Inspections Department records. The current owner is Vernon Market LLC, who purchased the property in 1999, according to the Lenoir County Tax Assessors Office. This assessment revealed no evidence of recognized environmental conditions, as defined by ASTM, in connection with the Vernon Market Retail site, except: Mallard Griffin Lumber (formerly onsite) reported a release February 1993, during the removal of an underground storage tank (UST) containing a gasoline mixture. The North Carolina Department of Environment and Natural Resource (NCDENR), Department of Water Quality (DWQ) is requiring four consecutive quarterly groundwater monitoring events to demonstrate groundwater concentrations are less than the 15A NCAC 2L standards. Groundwater samples were collected from six monitor wells and analyzed January 15, 2001. Analytical results were compared to groundwater samples taken and analyzed in 1999. The results indicated an increase in tetrachloroethene concentrations in MW-2, MW-3, MW-4, and MW-6 and a decrease in MW-1 and MW-5. A review of the quarterly Natural Attenuation Monitoring Reports would be 4, necessary to monitor groundwater concentrations. 111 V The following environmental issues were identified in connection with the Vernon Market Retail site. They are not recognized environmental conditions, as defined by ASTM: ■ Suspect asbestos containing materials (ACM) observed include: acoustical ceiling tile, vinyl floor tile and mastic, covebase and mastic, sheetrock (joint tape and compound), and roofing materials. These materials are in good condition (2000 construction). Prior to any activities (i.e., repair, renovation, demolition) which may disturb suspect ACM, these and similar materials should be sampled and analyzed for possible asbestos content. If these materials are found to contain asbestos, the building owner or leased space tenant may be required to comply with applicable USEPA, OSHA, NESHAPS, and state and local regulations. • Lenoir County is located in Radon Zone 2, with predicted average screening concentrations between 2.0 and 4.0 picocuries of radon per liter of air (pCi/L; USEPA Map of Radon Zones). The USEPA recommended action level is 4.0 pCi/L. There are no routinely occupied subgrade areas at the subject property. Radon testing is not required based on GEFA's Scope of Work Guidelines. • Fluorescent light fixtures are present in the building. Many fluorescent light ballasts manufactured prior to 1980 may contain PCBs (2000 construction). Spent fluorescent light tubes should be segregated, properly stored, and disposed. This information, to the extent it was relied on to form our opinion, is assumed to be correct and complete. Clayton is not responsible for the quality or content of information from these sources. The information and opinions rendered in this report are exclusively for use by GEFA. Clayton will not distribute or publish this report without consent except as required by law or court order. The information and opinions expressed in this report are given in response to a limited assignment by GEFA and should be considered and implemented only in light of that assignment. The services provided in completing this project are consistent with normal standards of the profession. No other warranty, expressed or implied, is made. 2.0 SUBJECT PROPERTY DESCRIPTION 2.1 LOCATION AND LEGAL DESCRIPTION Vernon Market Retail is located at 1304 West Vernon Avenue, Kinston (Lenoir County), North Carolina, Florida, in a residential and commercial setting (Figures 1 and 2; Figures Tab). The property is made up of several parcels and is further described as: Tracts or parcels of land lying and being in Kinston Township, Lenoir County, North Carolina.... Legal descriptions are provided in Appendix C. No record of environmental liens was found in the information reviewed (VISTA 2001). 2.2 CURRENT USE OF SUBJECT PROPERTY Vernon Market Retail consists of a multi tenant, single level retail building (41,885 square feet), landscaped areas, and asphalt paved parking on 5.69 acres in a residential and commercial setting. A stormwater drainage canal runs along the east property boundary. Onsite construction started February 2000, according to Building Inspections Department records. There are three tenants: Food Lion Supermarket, Realo Discount Drug, and SunCom Wireless Retail Store. The property was developed with seven buildings from at least 1965 until 1999. Previous occupants, from at least 1953 until 1999, included: Mallard Griffin Lumber (UST, SPILL), several automotive repair facilities [e.g., P&K Automotive (LUST, SPILL)], insurance agencies, and Candyland Daycare (Section 3.0). The current owner is Vernon Market LLC, who purchased the property in 1999, according to the Lenoir County Tax Assessors Office. PL\O:\ATLEMS\1-PHASEI\GEFA\2001\20-01335.00\01335Report.&C 2 Mr. Taylor provided the following information: • Utilities: ELECTRICITY City of Kinston GAS Carolina Natural Gas WATER AND SEWER City of Kinston b Heating is natural gas and cooling is electric. • Wastewater originates from sinks and toilets. Stormwater runoff flows to onsite stormwater drains then to the stormwater drainage canal along the east property line. r Floor drains connected to the sanitary sewer system are located in the bathrooms. The planned short term use is retail. 2.3 CURRENT USE OF ADJOINING PROPERTIES The area surrounding the subject property is residential and commercial. Adjoining properties were observed (from the subject property or from public access areas) for signs of recognized environmental conditions and their potential to pose an environmental concern to the subject property (Figure 2; Figures Tab). The uses and features of adjoining properties are described below. North: West Vernon Avenue, then Fairfield Park, Greenbriar Road and Amoco Gas Station (801 Greenbriar Road, UST). South: West Washington Avenue then undeveloped (wooded) lot owned by Vernon Market LLC, residential, then railroad tracks East: Sparkling Clean Car Wash (1300 West Vernon Avenue), West Lenoir Avenue and residential, then Hines Avenue West: Kinston City School Maintenance Building (LUST, SPILL), W. Gary Baker Insurance Agency, and residential, then Jackson Carpet, then Terminal Street, then residential including 610 Terminal Street (LUST, SPILL) Kinston City School Maintenance Building, (crossgradient), reported a release June 1992 during the removal of an underground storage tank (UST). The case was closed November 1992 (Section 4.0). 610 Terminal Street, residence (crossgradient), reported a heating oil release February 2000, during the removal of an UST. The case was closed June 2000 (Section 4.0). Amoco Gas Station (upgradient): four USTs (gasoline and diesel) were installed in 1972. No releases have been reported (Section 4.0). PL\O:NTLEMS\l-PHASE 1\GEFA\2001\20-01335.00\01335Reportdoc Adjoining properties do not appear to present an environmental concern to the subject property, based on visual observations and available information (Section 4.0; VISTA 2001). 2.4 PHYSICAL SETTING Lenoir County is located in the Coastal Plain Physiographic Region of North Carolina. The soils are underlain by unconsolidated sand, silt, and clay except for small intermittent areas on the southeast side of the county. The land surface is smooth and most of the county is nearly level or gently sloping. Short breaks separate the uplands and flood plains in many places. The Neuse River is south of the subject property. Elevations at and around the subject property are approximately 18 to 23 feet above sea level (Barnhill et al. 1977; USGS 1988). The main soil found on and around the subject property is Kahnia sandy loam, 0 to 2 percent slopes. This soil is well drained to somewhat poorly drained and has a loamy or sandy subsoil. Kalmia sandy loam is found on stream terraces (Barnhill et al. 1977). The onsite shallow groundwater flow direction was determined to be south toward the Neuse River, and depth to groundwater was determined to be between 3.22 to 8.20 feet (C&ES 2001). 3.0 HISTORICAL REVIEW 3.1 AERIAL, PHOTOGRAPHS Aerial photographs, which include the subject and adjoining properties, were reviewed at the Lenoir County Tax Assessor's (LCTA) and the Lenoir County United States Department of Agriculture/Natural Resource Conservation Services (USDA/NRCS). • LCTA Aerial Photograph; Lenoir County; Date: 1965 The subject property is developed with seven buildings (appear commercial). Adjoining properties include: North: One building (appears to be commercial), then West Vernon Avenue, then Fairfield Park. Adjoining properties are developed as current USDA/NRCS Aerial Photograph No. 91L; Lenoir County; Date: 1994; Scale 1" = 660 The subject and adjoining properties appear similar to the 1983 Photograph. No readily apparent evidence of recognized environmental conditions at the subject or adjoining properties was noted on the aerial photographs reviewed. Previous site occupants include several automotive repair facilities [e.g., P&K Automotive (LUST, SPILL)], Mallard Griffin Lumber (UST, SPILL), a daycare, and insurance agents (Sections 3.4; 3.7; 4.0). 3.2 USGS TOPOGRAPHIC MAPS The 1988 USGS 7.5' Topographic Map, Kinston, North Carolina Quadrangle, which includes the subject property and vicinity, was reviewed. No structures are depicted at the subject or adjoining properties. West Vernon Avenue is north; West Washington Avenue and the Neuse River are south. U3.3 FIRE INSURANCE MAPS Fire insurance maps, which include the subject and adjoining properties, are not available in the VISTA Historic Map Collection or the Kinston -Lenoir County Public Library. PL\O:WTLEMS\I-PHASEI\GEFA\2001\20-01335.00\01335Report.d- 5 3.4 CITY DIRECTORIES Polk City Directories (1902 to 1999, at approximately 5 year intervals), which include the subject and adjoining properties, were reviewed at the Kinston -Lenoir County Public Library (Appendix D). The subject property is first listed in 1953 as Mallard Griffin Lumber. Previous site occupants include automobile service and repair facilities, a radio station, insurance agencies, P&H Pipeline, a daycare, and Mallard Griffin Lumber (Sections 3.7; 4.0). Addresses and locations were verified at the Kinston Addressing and Mapping Department. Previous and current adjoining properties include: residential, commercial, a gas station (LIST), the City School Maintenance Building (LUST), Fairfield Laundry (laundromat), and a car wash (Section 2.3). Fairfield Laundry, (crossgradient; current Jackson Carpet), was a laundromat and did not conduct dry cleaning onsite, according to Ms. Jackson, Jackson Carpet. No readily apparent evidence of recognized environmental conditions at the subject and adjoining properties was noted in the city directories. 3.5 PRIOR OWNERSHIP Prior ownership records were reviewed at the Lenoir County Tax Assessor and Deed Records Room. The current owner is Vernon Market LLC, who acquired a portion of the property August 26, 1999, from James McLeod and wife, Ida McLeod. Vernon Market LLC acquired the rest of the property December 14, 1999, from Eleanor Mallard and Betsy Mallard Newborn (widow). Copies of the current warranty deeds are provided in Appendix C. 3.6 AGENCY CONTACTS 3.6.1 City of Kinston Building Inspections Department The City of Kinston Building Inspections Department was visited April 5, 2001, to obtain building permit information for the subject property. There are multiple permits (e.g., shell construction, plumbing, electrical, heating, ventilation, air conditioning) on file for the subject property, according to a representative. Permit #00-00566, issued February 28, 2000, is for the Food Lion foundation at Vernon Avenue. A copy of the building L► permit is provided in Appendix E. There are also seven building demolition permits on file: Permit #99-01542 (issued 8/19/99), for the demolition of a 3780 square feet daycare building located at 1312West Vernon Avenue, for a New Food Lion. The property is �j owned by Mallard Heirs. The property is owned by Mallard Heirs. • Permit. #99-01544 (issued 8/19/99), for the demolition of a 21,609 square feet total buildings located at 1400 West Washington Avenue. The property is owned by Mallard Heirs. • Permit #99-01579 (issued 8/30/99), for the demolition of a 800 square feet building located at 1402 West Washington Avenue. The property is owned by Mallard Heirs. • Permit #99-01662 (issued 9/10/99), for the demolition of a 6804 square feet office for the Old Mallard Griffin located at 1400 West Washington Avenue. The property is owned by Mallard Heirs. • Permit #99-01663 (issued 9/10/99), for the demolition of a 972 square foot building located at 1308 West Vernon Avenue. The property is owned by Mallard Heirs. ■ Permit 499-01818 (issued10/25/99), for the demolition of a 1170 square feet, one story building located at 1302 West Vernon Avenue. The property is owned by Mallard Heirs. Previous site occupants include several automotive repair facilities [e.g., P&K Automotive (LUST, SPILL)], Mallard Griffin Lumber (UST, SPILL), a daycare, and insurance agents (Sections 3.4; 3.7; 4.0). These buildings were demolished in 1999, for the construction of the current Food Lion. 3.6.2 Lenoir County Fire Department The Lenoir County Fire Marshal was visited April 5, 2001, to obtain information for the subject property including: fires, complaints, permits, violations involving hazardous materials, underground storage tanks (USTs), and aboveground storage tanks (ASTs). A freedom of information request was filed; no response has been received. 3.6.3 Lenoir County Health Department The Lenoir County Health Department was visited April 5, 2001, to obtain information regarding environmental concerns or violations at the subject property. There are no files on record for the subject property, according to a representative, and no septic tank records are on file for the subject property. 3.7 PREVIOUS ENVIRONMENTAL REPORTS i An Environmental Audit Report for the subject property was conducted by Contractors 1.1 and Engineers Services, Inc. (C&ES 1999). • Soil samples were collected March 4, 1996, behind the P&K Automotive building (formerly onsite), and analyzed for petroleum constituents. Analytical results indicated soil concentrations were greater than the state regulatory levels. The North PL\O:\ATLEMS\I-PHASEI\GEFA\2001\20-01335.00\01335Reportdce 7 Carolina Department of Environment and Natural Resources (NCDENR) was notified and the site received a No Further Action (NFA; at this time) status August 13, 1998 (C&ES 1999). Onsite monitor wells were abandoned (C&ES 1999). The building was demolished in 1999, according to Building Inspections Department records (Section 3.6.1). This is currently the Vernon Market Retail paved parking area. Groundwater samples were collected from five groundwater monitor wells at the Mallard Griffin Lumber property (formerly onsite) and one groundwater well offsite, and analyzed March 4, 1996, for petroleum constituents and tetrachloroethene. Analytical results indicated benzene concentrations (2.91) in MW-1 and tetrachloroethene (0.99, 1.81, and 1.50) in MW-1, MW-4, and MW-5. The North Carolina standard for benzene is 1.0 parts per billion (ppb) and 0.7 ppb tetrachloroethene (C&ES 1999). The NCDENR Department of Water Quality (DWQ) was notified and is requiring four consecutive quarterly groundwater monitoring events to demonstrate groundwater contamination concentrations are below 15A NCAC 21, standards (C&ES 1999). a The six ground water monitor wells were sampled March 8, 1999, to determine the degree of affected groundwater. Analytical results indicated concentrations greater than state standards for tetrachloroethene in MW-1, MW-3, and MW-5, lead in MW- 1, MW-2, and MW-BD (MW-6), Napthalene in MW-3 and 4-Nitrophenol in MW-3. PL\O:\ATLEMS\ I -PHASE I \GEFA\2001 \20-0133 5.00\0133 5Report. doc The Natural Attenuation Monitoring Report for the Former Mallard Griffin Site was reviewed (C&ES 2001). • Five out of the six previous groundwater monitor wells were destroyed during construction and five new wells were installed onsite (MW-2, MW-3, MW-4, MW-5, and MW-6) January 2001. Groundwater samples were collected and analyzed from all wells on January 15, 2001. Analytical results indicated an increase in tetrachloroethene concentrations in MW-2, MW-3, MW-4, and MW-6 and a decrease in MW-1 and MW-5 (C&ES 2001). Groundwater Sampling Data (January 2001) All results are in parts per billion (ppb) NA Not Analyzed ND Not Detected PQL Less than Practical Quantitation Limit A review of the quarterly Natural Attenuation Monitoring Reports would be necessary to monitor groundwater concentrations. 3.8 SUMMARY OF HISTORICAL REVIEW The historical research presented in this section established use of the subject property since at least 1953 (Mallard Griffin Lumber), current ownership (Vernon Market LLC), and current construction (2000). The subject property has been developed since at least 1953 (Mallard Griffin Lumber, daycare, automobile repair facilities, insurance agencies, P&H Pipeline, and a radio station), according to city directories, Building Inspections Department records, and previous reports. The current building, Vernon Market Retail, was constructed in 2000, according to Building Inspections Department records. The property is currently owned [. by Vernon Market LLC. Available government database information prepared by VISTA Information Solutions, Inc. (VISTA) was reviewed to evaluate both the subject property and any listed sites within GEFA recommended search distances. Federal, state, and local databases reviewed are included in Appendix F. The subject property is listed in the SPILL, LUST, and UST databases; no environmental cleanup liens appear to be on record. A release was reported at P&K Automotive (formerly onsite), during the removal of seven USTs. The site received a No Further Action (NFA; at this time) status August 1998 (VISTA 2001; C&ES; Section 3.7). A release was reported at Mallard Griffin Lumber (formerly onsite), during the removal of a 280 gallon UST containing a gasoline mixture. The release came from two aboveground storage tanks (ASTs) also onsite (VISTA 2001). The NCDENR DWQ is requiring four consecutive quarterly groundwater monitoring events to demonstrate groundwater concentrations are less than the 15A NCAC 2L Standards (C&ES 1999; Section 3.7). A review of the quarterly Natural Attenuation Monitoring Reports would be necessary to monitor groundwater contamination concentrations. Eight USTs and two ASTs have been removed from the subject property (VISTA 2001). There are no active USTs or ASTs currently registered with the State of North Carolina for the subject property (VISTA 2001). Seven additional sites were identified within 0.25 miles from the subject property (VISTA 2001). No unmappable sites were identified with the potential to affect the subject property (Appendix F). 5.0 SITE RECONNAISSANCE AND INTERVIEWS 5.1 GENERAL OBSERVATIONS The interior and exterior areas associated with subject property are clean and well maintained. The assessment consisted of noting evidence (e.g., drums, unusual vegetation patterns, staining) indicating that hazardous materials are currently or were previously located onsite. Potentially hazardous materials currently used or stored onsite include typical cleaners and maintenance materials. Food Lion uses, stores, and sells typical cleaners onsite. All materials are labeled (manufacturer) and appear to be stored appropriately. The subject property was previously occupied by Mallard Griffin Lumber and several automobile repair facilities. Potentially hazardous materials previously used and stored onsite include: waste motor oil, gasoline, and gasoline mixture (C&ES 1999; Sections 3.7; 4.0). 5.3 STORAGE TANKS 5.3.1 Underground Storage Tanks The subject property was inspected for evidence of underground storage tanks (USTs; e.g., vent piping, dispensing equipment, pavement variations). The lack of visible evidence and owner knowledge of USTs does not preclude the possibility that USTs could be present onsite. Visible evidence of USTs (e.g., fill ports, vents) may have been removed or obscured from view and USTs could have been present without the knowledge of the current owner. No readily apparent evidence of USTs was observed onsite. Eight USTs have been removed from the subject property (VISTA 2001). There are no active USTs currently registered with the State of North Carolina for the subject property (VISTA 2001). 5.3.2 Aboveground Storage Tanks No readily apparent evidence of ASTs was observed onsite. Two ASTs have been removed from the subject property (VISTA 2001). There are no ASTs currently registered with the State of North Carolina for the subject property (VISTA 2001). 5.4 INDICATIONS OF SOLID WASTE DISPOSAL Nonhazardous solid waste generated onsite is disposed to three onsite dumpsters handled by Waste Management. Kitchen waste (grease) is disposed in one grease container handled by Valley Protein, according to Mr. Taylor. PL\O:\ATLEMS\1-PHASE I\GEFA\2001\20-01335.00\01335Report.doc 13 5.5 INDICATIONS OF POLYCHLORINATED BIPHENYLS The subject property was inspected for the presence of liquid cooled electrical units (transformers, light ballasts, and capacitors), and major sources of hydraulic fluid (elevators and lifts). Such units are notable because they may be potential PCB sources. Two unlabeled pad mounted transformers, owned by the City of Kinston, are onsite. No evidence of leaks or stains was observed. All unlabeled transformers are considered (Federal Regulation 40 CFR 761.40) to be PCB contaminated (i.e., containing between 50 and 500 ppm PCB). Federal Regulations (40 CFR 761. Subpart G) require any release of material containing greater than 50 ppm PCB and occurring after May 4, 1987, be cleaned up by the Owner (City of Kinston) following the United States Environmental Protection Agency's (USEPA) PCB spill cleanup policy. One hydraulic cardboard bailer is onsite. The bailer is new, according to Mr. Taylor. No stains or leaks were observed around it. Fluorescent light fixtures are present in the building. Many fluorescent light ballasts manufactured prior to 1980 may contain PCBs (2000 construction). Spent fluorescent light tubes should be segregated, properly stored, and disposed. 5.6 WELLS Three groundwater monitor wells were abandoned in 1998, at the former P&K Automotive property. Five groundwater monitor wells (MW-2 through MW-6), are currently onsite south of the Food Lion Building. MW-1 is on adjacent property south. These wells are associated with Mallard Griffin Lumber (formerly onsite; C&ES 1999; 2001; Section 3.7). 5.7 SUSPECT ASBESTOS CONTAINING MATERIALS The subject property was inspected for the presence of suspect asbestos containing 1 , materials (ACM) such as ceiling tiles and roofing materials. The inspection consisted of noting observable materials (i.e., materials that are readily accessible and visible without dismantling elements of the structure, such as carpet, wallboard, or ceiling panels) which LJ may contain asbestos. I� Suspect ACM observed includes: acoustical ceiling tile, vinyl floor tile and mastic, L.JI covebase and mastic, sheet rock (joint tape and compound), and roofing materials. These materials are in good condition (2000 construction). UPrior to any activities (i.e., repair, renovation, demolition) which may disturb suspect ACM, these and similar materials should be sampled and analyzed for possible asbestos content. If these materials are found to contain asbestos, the building owner or leased U space tenant may be required to comply with applicable USEPA, OSHA, NESHAPS, and state and local regulations. The potential adverse health effects associated with radon gas depend on various factors, such as the concentration of the gas and duration of exposure. The concentration of radon gas in a building depends on subsurface soil conditions, the integrity of the building's foundation, and the building's ventilation system. Lenoir County is located in Radon Zone 2, with predicted average screening concentrations between 2.0 and 4.0 picocuries of radon per liter of air (pCi/L; USEPA Map of Radon Zones). The USEPA recommended action level is 4.0 pCi/L. There are no routinely occupied subgrade areas at the subject property. Radon testing is not required based on GEFA's scope of work guidelines. 5.9 SUSPECT LEAD BASED PAINT Vernon Market Retail was constructed in 2000; it is not a residential property. Suspect lead based paint sampling was not conducted. 5.10 WETLANDS The subject property was inspected for the presence of sensitive ecological areas by noting environmental indicators (e.g., wetlands vegetation, floodplain) located on or immediately adjoining the subject property. No sensitive ecological areas were observed onsite. A stormwater drainage canal is located along the east property boundary. The subject and adjoining properties are not located in a flood hazard area (USGS 1988; FEMA 1980). 5.11 AIR EMISSIONS No regulated air emission sources were observed onsite. 5.12 DRY CLEANING OPERATIONS No dry cleaners are onsite. There is no historical evidence of dry cleaners at the subject or adjoining properties. 6.0 CONCLUSIONS AND RECOMMENDATIONS A Phase I Environmental Site Assessment was performed in accordance with GEFA's October 19, 1998 Environmental Audit (Phase I) Requirements, and ASTM Practice E 1527-00 at Vernon Market Retail, 1304 West Vernon Avenue, Kinston, North Carolina, the subject property. Any exceptions or deletions from this practice are described in Sections 1.2 and 1.3. PL\0:1ATLEMS\1-PHASEI\GEFA\2001\20-01335.00\01DlRepomdoc 15 This assessment revealed no evidence of recognized environmental conditions, as defined by ASTM, in connection with the Vernon Market Retail site, except: • Mallard Griffin Lumber (formerly onsite) reported a release February 1993, during the removal of an underground storage tank (UST) containing a gasoline mixture. The North Carolina Department of Environment and Natural Resource (NCDENR), Department of Water Quality (DWQ) is requiring four consecutive quarterly groundwater monitoring events to demonstrate groundwater concentrations are less than the 15A NCAC 2L standards. Groundwater samples were collected from six monitor wells and analyzed January 15, 2001. Analytical results were compared to groundwater samples taken and analyzed in 1999. The results indicated an increase in tetrachloroethene concentrations in MW-2, MW-3, MW-4, and MW-6 and a decrease in MW-1 and MW-5. A review of the quarterly Natural Attenuation Monitoring Reports would be necessary to monitor groundwater concentrations. The following environmental issues were identified in connection with the Vernon Market Retail site. A special use permit application was filed with Gwinnett County Commission for development of approximately 139 acres at the southwestern quadrant of Drowning Creek Road and i Georgia Highway 316, as a Construction and Demolition Landfill. �j The Environmental Assessment addressed the physiography, soils, geology, groundwater, surface water, floodplain and wetlands, and biological communities, including threatened and Ll Michael O. Molley Page 3 endangered species, in and around the area of the proposed development and the potential for adverse impact to these resources. The Special Use Permit Application and accompanying Engineering Report were evaluated and compared to the criteria established by the Gwinnett County Solid Waste Management Plan and the Georgia Environmental Protection Division Guidelines for permitting a Solid Waste Landfill. The landfill site was unsuitable for development based on soil characteristics, surface water hydrology, potential for groundwater impact, biological aspects, and the potential for threatened and endangered species. The application was denied. • Project Manager and Principal Investigator with respect to amber darter (Percina antesella) populations in the Etowah River Study area and assessment of potential impact from a municipal wastewater treatment plant which will discharge into the Etowah River. Available information indicates that the amber darter, a federally endangered species, may be present or have critical habitat in the study area. There are at least three fish species of concern in the Etowah River Study Area, that may be affected by the proposed wastewater discharge: Percina antesella, Amber darter (Endangered), Etheostoma etowahee, Etowah darter (Endangered), and Etheostoma scotti, Cherokee darter (Threatened). Recommendations were made to develop additional information with respect to alternatives to the proposed action and assess potential impact to the river and darter populations. • Project Manager and Principal Investigator for an environmental assessment and prepare applicable permit applications, including supporting documentation, for an approximately 3 mile methane gas pipeline corridor. Permit applications included Corps of Engineers Nationwide Permit, Land Disturbance Permit, and Sedimentation and Erosion Control Permit. The environmental assessment prepared to support these applications included soil, geology, groundwater, surface water, floodplain, cultural resources, and biological communities, including threatened and endangered species potential evaluation. The permit application was approved and the work was completed. • Project Manager and Principal Investigator for an evaluation of dredge spoil material at a proposed development site outside of Norfolk, Virginia. The evaluation consisted of collecting spoil samples, at depth, and analyzing them for volatile organic compounds (VOC), semi VOC (SVOC), and priority pollutant metals. No detectable concentrations of VOC were detected, at method detection limits, and indicated metals concentrations were all within applicable background levels. A modified J L, Michael O. Molley Page 4 health risk assessment was completed for several polynuclear aromatic hydrocarbons, including benzo(a)pyrene. There was no health risk indicated at the 10E6 level. Project Manager and Principal Investigator for a polychohinated biphenyl (PCB) release and cleanup. Soil and groundwater were assessed as part of a PCB release delineation and cleanup. PCB concentrations in soil were delineated and remediated to less then 10 mg/kg; groundwater was not affected. Mr. Molley has also provided expert witness testimony with respect to emergency response actions, including review of applicable response measures, effectiveness, and cost considerations.
