Dear Mr. Moody: In a letter dated August 10, 2009, the Division of Waste Management requested access to the referenced site for the purpose of installing two additional monitoring wells at the referenced site. As of November 6, 2009, the DWM has not received the signed access agreement. An access agreement for the purpose of conducting the required assessment is again attached for your review. Please sign the attached site access agreement letter, and return to the address indicated on the letter. In addition, if the conditions of the access agreement are unacceptable, you may apply for eligibility to the Commercial Trust Fund, pay the appropriate deductible, and hire a consultant to handle the assessment and remediation activities.
