I have followed up with our Town attorney and we did not list any clauses or provisions that would cause the Town to 
take on the responsibility for the previous contamination. Mr. Turley would be the appropriate person to send the 
notices to.

I asked our town attorney to confirm the contract for sale of the property did not include a No Further Action clause or 
any others that would place the responsibility on the Town of Leland. I have asked him to follow up with me no later 
than 1/27/20. I will follow up with you just as soon as I get a response.

A Brownfield Agreement would allow the Town of Leland the ability to develop the property with limited 
liabilities.  A Brownfield Agreement does not relieve a RP (Responsible Party) from cleanup/assessment 
requirements. 

As for the suspected UST’s, I did not get a chance to speak with anyone in the Permitting and Inspections 
Group of the UST Section but I do not see in the registration database that there were ever any registered 
UST’s at this location.  If you are wondering if these tanks are eligible for Trust Fund Reimbursement, you 
would need to contact the Trust Fund and speak to someone that handles Eligibility.  The following people 
handle Trust Fund eligibility out of Raleigh:

If these tanks are eligible for Trust Fund Reimbursement, there will most likely be back fees that would need 
to be paid along with a deductible.

Thanks Liz. One thing I wanted to mention was the Town intended to do a Brownfields agreement for these parcels. Not 
sure how that might changes things about who the responsible party might be.

Attached are the letters (Notice of Regulatory Requirements – NORR) that I have drafted to go out.  Just trying 
to determine if there are any legal agreement between the Town of Leland and Mr. Turley, as to who would 
be responsible for additional cleanup activities at this site. 

If there are no agreements, than these Notices will be send to Mr. Turley, and he will be required to continue 
cleanup/assessment/deed restriction activities as required in the NORRs. 

Please let me know what you find out about any agreements made for this site.
