Jernigan and Son Trucking Accident (Petroleum Contamination Only) Intersection NC 11 \NC 461 Ahoskie - Hertford County Incident Number: 95746 Ranking: Low Dear Mr. Jernigan: The Initial Assessment Report received by the UST Section, Division of Waste Management, Washington Regional Office on August 7, 2020 has been reviewed. The review indicates that soil contamination meets the cleanup requirements for petroleum contaminants for a low-risk release from an aboveground storage tank (AST) or other source under Title 15A NCAC 2L .0500, as modified by Session Law 2015-286. Contamination associated with fire suppressant foam containing Per-and Poly-Fluroalkyl Substances (PFAS) presumably remains in the excavation, as laboratory testing was not performed for PFAS contaminants at the base of excavation. The UST Section determines that no further action is warranted for the petroleum portion of incident # 93410. The PFAS constituents found in fire suppressing foam used during emergency response are not covered in this Notice of No Further Action (NFA). All required actions as they relate to the petroleum contaminants have been completed for the release. Petroleum contaminated soils were excavated, samples were collected post excavation, analysis shows petroleum constituents below the North Carolina action levels. However, soil analytical for PFAS constituents at the base of excavation was not completed resulting in Incident # 93410 remaining open. This determination shall apply unless the UST Section later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC 2L .0507(a) you have a continuing obligation to notify the Department of any changes that might affect the risk or land use classifications that have been assigned. Groundwater was not encountered during excavation and as a result was not tested. This No Further Action determination applies only to the petroleum contaminants released at the subject incident and NOT PFAS contaminants found in fire suppressing foam. As a result, this office will keep the incident # 93410 OPEN; for any other contaminants or incidents at the subject site, the responsible party must continue to address contamination as required.
