Dillow, Attorney At Law Reference: Phase II Environmental Site Assessment Biggs Buick-GMC 1189 and 1197 US Highway 17 South Elizabeth City, Pasquotank County, North Carolina EA Project No. 22-12445.2 Dear Ms. Dillow: EnviroAssessments (EA) has completed a Phase II Environmental Site Assessment (ESA) of the Biggs Buick- GMC property (the “Site”) located at 1189 and 1197 US Highway 17 South in Elizabeth City, Pasquotank County, North Carolina. A Site Location Map is attached as Figure 1. The purpose of the Phase II ESA was to address the findings described in EA’s Phase I Environmental Site Assessment dated August 18, 2022. EXECUTIVE SUMMARY Phase II assessment activities were performed by EA personnel and its subcontractors on September 6, 2022, which consisted of the collection and laboratory analysis of nine (9) groundwater samples from exterior locations across the Site, including the areas of the Site’s former underground storage tank (UST #2), the on- site oil-water separator, and former auto salvage yard. In summary, one groundwater sample (WS-3) contained concentrations of target analytes exceeding the state’s minimal reporting limits defined as the NCAC 2L Groundwater Standards (2L Standards). Groundwater sample WS-3 contained a Benzene concentration of 940 micrograms per liter (ug/L), which exceeds the 2L Standard of 1 ug/L for Benzene. Groundwater sample WS-3 also contained concentrations of Naphthalene (170 ug/L), Toluene (1110 ug/L) and Total Xylenes (522 ug/L) which exceed their respective 2L Standards. None of the remaining groundwater samples contained concentrations of target analytes exceeding 2L Standards. The compounds listed above are components related to gasoline and its degradation products, and the source of the contamination in groundwater sample WS-3 appears to be the result of a petroleum release associated with a former 1,000 gallon gasoline underground storage tank (UST#2) which was removed from the property on September 17, 2008. As described in EA’s Phase I ESA report, during the closure of UST#2, laboratory analysis of soil and groundwater samples identified elevated levels of petroleum-contaminated soil in the Phase II Environmental Site Assessment Biggs Buick-GMC 1189 and 1197 US Highway 17 South Elizabeth City, Pasquotank County, North Carolina EA Project No. 22-12445.2 September 15, 2022 2 location of the underground fuel lines, as well as an elevated concentration of Benzene in a groundwater sample from the former UST location. At the time, the concentrations were above the state’s minimal reporting action limits, and the consultant recommended that the UST Closure Report be submitted to the NC Dept. of Environmental Quality (NCDEQ) for review. However, EA’s Phase I ESA identified no evidence that the 2008 UST Closure Report was ever submitted to the NCDEQ. Based on the conclusions of this ESA, EA offers the following recommendations: • EA recommends that the Site owner submit this Phase II ESA report to the NCDEQ Washington Regional Office UST Program, along with a 24-Hour Release and UST Leak Reporting Form to document the presence of the petroleum constituents found in the Site’s groundwater. The NCDEQ will direct the Site owner with regard to any specific additional assessment and/or remediation actions that might be required to evaluate the source of the release and determine the risk that the releases pose to human health and the environment. EA would be pleased to assist in the submittal process if desired. 1.0 SITE INFORMATION Phase I ESA The Site consists of two adjoining parcels of land totaling approximately 10.22 acres and identified as Parcel ID Numbers 8903 106950 and 8903 118199 according to the Pasquotank County Tax Assessor’s Office. The Site was operating as the Biggs Buick-GMC automotive dealership and the Biggs Collision Repair Center at the time of this inspection. The Biggs Buick-GMC automotive dealership is located on the southwestern portion of the Site and is improved with two buildings: one 22,000 square foot automotive Dealership building which was constructed in 1974 and one 3,000 square foot Detailing building which was also constructed in 1974. The Biggs Collision Repair Center is located on the northeastern portion of the Site and is improved with one approximately 12,776 square foot body shop building which was constructed in 1998. Site historical information indicates the southwestern section of the Site was formerly improved with one to two single family residences and/or barns/outbuildings from at least as early as 1938 until the construction of the current Dealership building in 1974. The remaining northeastern section of the Site existed as agricultural fields from at least as early as 1938 through 1961. From at least 1975 through 1983, a drive-in movie theater was located on the northeastern section of the Site. By 1993, the former drive-in theater section was filled with numerous vehicles, apparently operating as an auto salvage yard. The current Collision Repair Center building was constructed in 1998 on the northeastern section, with a remnant smaller ancillary building remaining on-site to the southeast of the collision center until at least 2016. In summary, the Site has operated in its current capacity as an automotive dealership since 1974, with its current Collision Repair Center added by 1998. Phase II Environmental Site Assessment Biggs Buick-GMC 1189 and 1197 US Highway 17 South Elizabeth City, Pasquotank County, North Carolina EA Project No. 22-12445.2 September 15, 2022 3 The Phase I ESA identified the following “Recognized Environmental Conditions” (RECs) in connection with the Site: • The Site operated one 1,000-gallon gasoline UST (UST #2) which was installed in August 1992 and was permanently closed by removal on September 17, 2008. EA found no UST closure documents or other references to UST #2 in historical records or in available regulatory records. However, EA reviewed an excerpt which was provided by the Site owner from the UST #2 Closure Report dated December 18, 2008. The excerpt is a summary of the UST closure findings and indicates laboratory analysis identified elevated levels of petroleum-contaminated soil in the location of the underground fuel lines, as well as an elevated concentration of Benzene (a common gasoline constituent) in a groundwater sample from the former UST area. The concentrations were above the state’s minimal reporting action limits, and the consultant recommended that the UST Closure Report be submitted to the NCDEQ for review. However, the Phase I ESA identified no evidence that the UST Closure Report was ever submitted to the NCDEQ. The presence of the unreported petroleum contamination at UST #2 is defined by ASTM guidelines as a “Recognized Environmental Condition” (REC) for the Site. • The southwestern portion of the Site has operated as an automotive dealership with a service department since 1974. The Site’s former practices related to the storage, use, and disposal of automotive fluids and their waste products are unknown. These practices are common to automotive dealerships, and they are potential sources of contamination by petroleum and solvents to the Site’s soil and groundwater. EA considers the Site’s operation as an automotive dealership with unknown former practices related to the storage, use, and disposal of automotive fluids and their waste products to be a “Recognized Environmental Condition” (REC) for the Site. • The northeastern portion of the Site is suspected to have operated as an auto salvage yard for an undetermined number of years at some time between 1983 and 1998, based on EA’s review of historical aerial photographs. The former auto salvage yard’s historical practices involving the storage, use, and disposal of automotive fluids such as petroleum and solvents and their resultant waste products are unknown, and they are a potential source of contamination to the Site’s soil and groundwater. EA considers the historical operation of the northeastern portion of the Site as a junk yard to be a REC for the Site. • The Dealership building currently operates 11 inground hydraulic lifts, and EA observed concrete floor patches indicating the locations of at least 4 formerly closed inground lifts in the building’s service area. The installation date of the inground lifts is assumed to be original to the construction of the Dealership building in 1974. No closure reports or other environmental investigative reports pertaining to the current or closed inground lifts were identified. Considering the age of the existing inground lifts and the absence of environmental investigative reports pertaining to the former lifts, a potential exists that undocumented contamination associated the current and/or former lifts remains on the Site. The Site’s current and former inground hydraulic lifts are a “Recognized Environmental Condition” (REC) for the Site. Phase II Environmental Site Assessment Biggs Buick-GMC 1189 and 1197 US Highway 17 South Elizabeth City, Pasquotank County, North Carolina EA Project No. 22-12445.2 September 15, 2022 4 Based on the findings of the ESA, EA recommended the following: • Completion of a Phase II ESA to include the collection, field screening, and laboratory analysis of groundwater samples from exterior locations across the Site, to include the areas of the Site’s former UST #2 and oil-water separator, in order to investigate the Site’s subsurface for contamination from these potential contaminant sources. Due to the Site’s shallow groundwater table encountered in prior subsurface work related to a former UST, EA did not recommend the collection of soil samples for this Site. The Client authorized EA to complete this Phase II ESA to evaluate for evidence of adverse impact to the Site’s subsurface from the issues of concern. 2.0 FIELD ACTIVITIES Phase II assessment activities were performed by EA personnel and its subcontractors on September 6, 2022, the specifics of which are detailed in the remainder of this report. 2.1 Subsurface Utility Locating/Limited Geophysical Survey EA personnel contacted the North Carolina One Call Center and requested that the local utility services conduct an electromagnetic (EM) survey in the areas of concern at the Site to determine the orientation and location of underground utility lines for optimal sampling locations. At the time of the assessment, all underground utility lines appeared to be marked up to the Site boundaries. However, public utilities are not authorized to locate underground lines on private property. On September 6, 2022, EA’s subcontractor, Ground Penetrating Radar Systems, LLC, conducted an on-site EM and ground-penetrating radar (GPR) survey at the Site to determine the orientation and location of the on- site oil-water separator, former UST-2, and subsurface utilities in order to determine final sampling locations. All items located were marked directly on the surface using paint. The GPR was unable to determine the location of former UST-2; however, Site personnel stated the tank was previously located in the same general area as former tank UST-1. 2.2 Groundwater Assessment On September 6, 2022, EA and its subcontractor, Regional Probing Services, utilized a Geoprobe® (direct- push) sampling device to advance nine (9) groundwater sample points (WS-1 through WS-9) to depths below the water table in order to collect groundwater samples from the locations depicted on the attached Figures 2A and 2B. Phase II Site Photographs are included as Appendix 1. Borings logs are included as Appendix 2. Phase II Environmental Site Assessment Biggs Buick-GMC 1189 and 1197 US Highway 17 South Elizabeth City, Pasquotank County, North Carolina EA Project No. 22-12445.2 September 15, 2022 5 Groundwater sample points WS-1 and WS-2 were advanced to the southwest of the vehicle service area in the dealership building. Groundwater sample point WS-3 was advanced near the former USTs and dispenser. Groundwater sample point WS-4 was advanced near the oil-water separator. Groundwater sample points WS-5, WS-6, WS-7, WS-8, and WS-9 were advanced in areas of the former auto salvage yard. All of the groundwater sample points were advanced to depths of 13 feet below grade (BG). At the groundwater sample point locations, a stainless steel sampling rod was advanced to a depth below the groundwater table. At the end of the sampling rod, a four (4) foot slotted stainless steel screen was exposed to groundwater. Dedicated, clean polyethylene tubing was then inserted into the sampling rod to the exposed screen interval and groundwater samples were then collected for laboratory analyses. The groundwater samples were placed into appropriate sample containers and labeled with the Site name, time and date of collection, and analyses to be performed. The filled sample containers were placed in a cooler containing ice and transported to Pace Analytical in Huntersville, North Carolina (a North Carolina- certified laboratory). A chain-of-custody form was maintained with the samples. The groundwater samples were analyzed for volatile organic compounds (VOCs) by EPA Method 8260 and polynuclear aromatic hydrocarbons (PAHs) by EPA Method 8270. A copy of the laboratory analytical report is attached as Appendix 3. The laboratory results are detailed in Section 3.0 of this report. 3.0 LABORATORY ANALYTICAL RESULTS 3.1 Groundwater Assessment EA collected nine (9) groundwater samples (WS-1, WS-2, WS-3, WS-4, WS-5, WS-6, WS-7, WS-8, and WS-9) for laboratory analysis, the locations of which are depicted on Figures 2A and 2B. A summary of the groundwater analytical results is presented in Table 1 and on Figures 2A and 2B. A copy of the laboratory analytical report is attached as Appendix 3. In summary, one groundwater sample (WS-3) contained concentrations of target analytes exceeding the NCDEQ minimal reporting limits defined as the NCAC 2L Groundwater Standards (2L Standards). Groundwater sample WS-3 contained a Benzene concentration of 940 micrograms per liter (ug/L), which exceeds the 2L Standard of 1 ug/L for Benzene. Groundwater sample WS-3 also contained concentrations of Naphthalene (170 ug/L), Toluene (1110 ug/L), and Total Xylenes (522 ug/L), which exceed their respective 2L Standards. None of the remaining groundwater samples contained concentrations of target analytes exceeding 2L Standards. In addition, groundwater sample WS-3 contained a detectable concentration of Ethylbenzene (437 ug/L) below the 2L Standard of 600 ug/L. Groundwater sample WS-3 did not contain detectable concentrations of additional target analytes above laboratory reporting limits. Groundwater samples WS-1 (12.6 ug/L) and WS-3 (1.3 ug/L) contained detectable concentrations of Methyl Tert-Butyl Ether (MTBE) below the 2L Standard of 20 ug/L. Groundwater samples WS-1 and WS-2 did not contain detectable concentrations of additional target analytes above laboratory reporting limits. Groundwater sample WS-4 did not contain detectable concentrations of additional target analytes above laboratory reporting limits. The remaining groundwater samples (WS-5, WS-6, WS-7, WS-8 and WS-9) did not contain detectable concentrations of target analytes above laboratory reporting limits.
