Box 1500 Springfield, OH 45501 Re: Notice of No Further Action 15A NCAC 2L .0407(e) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Speedway #8220 2256 North Main Street, Tarboro, NC Edgecombe County Incident Number: 48280 Risk Classification: Low Mr. Kramer: On December 14, 2022, the Underground Storage Tank (UST) Section, Division of Waste Management, Department of Environmental Quality (Department) received a request for a No Further Action determination for the aforementioned facility. This request included a certified copy of a Notice of Residual Petroleum with land use restrictions that was filed at the Pitt County Register of Deeds on March 3, 2022, in Book 4252, Pages 132 to 147, as required by Title 15A of the North Carolina Administrative Code (NCAC) Subsection 2L .0407(e)(3). Additionally, copies of the April 18, 2022, public notice mailings with associated delivery tracking information were provided, as required by Title 15A NCAC 2L .0407(e)(2). Based on the provided information, this Notice confirms the requirements of Title 15A NCAC 2L .0407(e) have been met and the Department has determined that No Further Action is warranted for this incident. This determination shall apply unless and until the Department later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC 2L .0407(a), you have a continuing obligation to notify the Department of any changes that might affect the risk or land use classifications that have been assigned. Additionally, this determination applies only to the incident described above; for any other incidents at the subject site, the responsible party must continue to address contamination as required. Interested parties may examine information on file by contacting this regional office and may submit comments on the site to the regional office at the address or telephone number listed below.
