Holly, Gaston County, North Carolina (MRO) FTF Incident #22887 Risk/Rank: Low, L135D Dear Property Owner: This letter is to inform you that the State’s Division of Waste Management, Underground Storage Tank (UST) Section, Trust Fund Branch, is providing Public Notification of a Notice of No Further Action concerning an environmental cleanup at the referenced site. A petroleum release was discovered at the site during the removal of two gasoline USTs in November 2000. The Responsible Party was not financially able to conduct the required cleanup, so the incident was recommended to the State-Lead Cleanup program, Federal Trust Fund branch in 2001. We have assessed and monitored the release since then. A review of the November 14, 2022, Monitoring Report shows that petroleum contaminated soil and groundwater remain onsite. Soil results exceeded Residential Maximum Soil Contamination Levels beneath the north end of the former UST located near the northwest corner of the current residence. Groundwater results exceeded the level of the standards or interim standards established in 15A NCAC 2L .0202 but were below Gross Contamination Levels. A contaminant fate and transport model was prepared to determine if area wells remain at risk. The modeling results indicated that the contaminants would not impact the nearest downgradient water supply well within 100 years, and this is supported by historic sampling data. The site is not located in a wellhead protection area or the Coastal Plain Physiographic Region, and no surface water bodies are located within 500 feet. Due to the fact that the groundwater and soil do not meet “Unrestricted Use” standards, meaning that contamination remains above the 2L standards, a Notice of Residual Petroleum was placed on the property deed (Book 5381, Page 375-377) with the following land use restrictions: Soil: Soil containing residual petroleum above applicable regulatory standard(s) remains on the site in the area identified in Figure 1, located at the north end of the former eastern underground storage tank, which was situated near the northwest corner of the current residence. No soil shall be excavated or disturbed within 3 feet of the Area A identified in Figure 1, except to remediate the soil in accordance with all applicable state and federal statutes, regulations and guidelines. Ridgeview Baptist Church Page 2 December 12, 2022 Groundwater: Groundwater from the site is prohibited from use as a water supply. Water supply wells of any kind shall not be installed or operated on the site. These restrictions shall continue in effect as long as residual petroleum remains on the site in excess of unrestricted use standards. Based on information provided to date, the UST Section finds it appropriate to classify the risk of the discharge or release as Low. Furthermore, the UST Section has determined that no further action is warranted for this incident. This determination shall apply unless the UST Section ascertains that the discharge or release poses an unacceptable risk or potentially unacceptable risk to human health or the environment. This No Further Action determination will become valid when the Trust Fund Branch completes the Public Notice requirements outlined below. Public notice in accordance with 15A NCAC 2L .0409 (b) is required within 30 days of receipt of this No Further Action letter. The Trust Fund Branch will provide a copy of this letter to the following persons: Local Health Director, the chief administrative officer of each political jurisdiction in which the contamination occurs (e.g. Mayor, County Manager, City Manager, or other official of equal or similar position); and all property owners and occupants within or contiguous to the area where the contamination is expected to migrate.
