RE: Notice of No Further Action 15A NCAC 2L .0407(d) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Former Beal’s 76 633 North Main Street Hendersonville, Henderson County, North Carolina Incident Number 9994 (associated with open incident #9412) The original release was reported in July 1992 under incident 9412, and incident 9994 was reported in March 1993 when a 500-gallon heating oil underground storage tank (UST) was
discovered while investigating the above incident 9412. The heating oil UST was removed, and a monitoring well (MW-3) was installed in that location. Three consecutive groundwater sampling events were conducted between 1992 and 1993 with results below 2L. Based on comments in
the latest report submitted March 1, 2023, incident 9412 is driving the cleanup with the presence of LNAPL in MW-4, the prior presence of LNAPL in MW-9, and prior exceedances of GCLs when these wells were sampled in the past. No surface water bodies, or water supply wells were
located within 1,000 feet of the source area. Incident 9994 is low risk. As such, the UST Section is administratively closing Incident 9994, as the site is being assessed and remediated under incident 9412. This determination shall apply unless the UST Section later determines that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment.
