48762
Hi Ruth/Jerren (This is the facility that filled tanks in‐place without permission),
Mr. Moore called me back and said both the new property owner (Mr. Patel) and the old property owner (Mr.
Sakina ‐ East King Inc) were involved in contracting him and in paying him to abandon the tanks in‐place at this
facility.
Going to address NORRs for additional work to both parties since they both seem to be listed in the PIBS
database as affiliated with the facility and tanks.
Additionally, at this time, UST/CAB is not requiring the abandoned in‐place tanks to be removed.
I am not requesting any additional information from PIBS at this time, just wanted to keep you in the loop.
Thank you

Mr. Moore,
Thank you for taking my phone call earlier today, I wanted to follow up with this email as I will be out on leave
the next few business days.
The UST Closure Report received on 12/9/2022, has listed you as the person to whom the report was prepared
for.
I was hoping that you could confirm who hired you to complete the UST in‐place closure activities at the
subject UST facility.
A copy of the contract would also be valuable to our incident file. Please email me a copy of any contracts to
preform in‐place closure that you may have.
I appreciate any help you can give me with determination of who contracted the in‐place closure of the USTs
at this facility.
Thank you.

Mr. Moore,
I am looping in CAB to answer your question about closing the tanks in place. To my knowledge it is not allowed unless a
structural engineer signs off on it but I will let them address this with you. If you still need to talk to me please let me
know. Thanks.

Thanks for the email with the UST‐61. CAB will review and advise on your next steps. All I need is the UST‐2 form. I see
from the email that the tanks were closed in place which is not allowed but CAB will advise. Thanks.

Charlie,
We are in receipt of the laboratory analytical data for this UST closure in place assessment.
A closure report is in preparation.

There were several elevated detections in several boreholes. NCDEQ will consider this a release.
Therefore, please find attached a UST-61 release report form for DEQ.
Please communicate this with your client. This form needs to be submitted to DEQ as soon as possible.
With your permission we will forward this to the appropriate DEQ regional office.
