Dear Mr. Waaso,
The Notice of Residual Petroleum (NRP) Memo received by the Underground Storage Tank (UST)
Section, Asheville Regional Office on September 13, 2022, has been reviewed. A review of the memo
indicates that Albemarle Kings Mountain proposes to place the filing of the NRP on hold, as the site intends
to open its mining operation in the next 3-5 years and once mining has started, the intended mining path
would pass through the location of the former UST. At that point, the building that sits on and around the
spill area would be removed, and soil be remediated. However, if the decision is made to not mine out the
area for whatever reason, the site will communicate the intent to follow the instructions in the Conditional
Notice of No Further Action and proceed with the filing of the NRP.
The UST Section approves with placing the NRP on hold until decisions are made following the
intended mining operations. We look forward to future correspondence and if you have any questions
