HomeMy WebLinkAbout19054_HD Supply_VIMP Compliance Review Space 150_20221130 November 30, 2022 Sent Via E-mail Steve Hallmark Cousins Properties 550 South Caldwell St Charlotte, NC 28202 sahallmark@gmail.com Subject: VIMS Upfit and Effectiveness Testing -Approval South Tower- Space 150 HD Supply Brownfields Property 1414 and 1422 South Tryon Street, Charlotte, NC Brownfields Project Number 19054-15-060 Dear Mr. Hallmark: The North Carolina Department of Environmental Quality Brownfields Program (DEQ Brownfields) received and reviewed the Vapor Intrusion Mitigation System (VIMS) Upfit and Effective Testing Report- Revision 1, Space 150-Summerbird Restaurant (Report) dated November 9, 2022, ) submitted on your behalf by Hart & Hickman, PC. This Report was submitted specifically for Space 150 in the South Tower, at the HD Supply Brownfields Property known as the Rail Yard. Brownfields has reviewed the Report and evaluated the analytical data using the DEQ Risk Calculator. The results of this evaluation were below the DEQ thresholds for non-residential use when taking soil gas and indoor air concentrations into consideration. Therefore, Space 150 South Tower is currently in compliance with Land Use Restriction (LUR) 8 of the recorded Notice of Brownfields Property and occupancy may continue for the subject building. DEQ Brownfields looks forward to receipt of the 2023 sampling data in accordance with the previously approved Vapor Mitigation Plan (VMP). Please be advised that this design compliance review from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities.
