URS-001 & LAV-001 Dear Bill: 1.0 Introduction Hart & Hickman, PC (H&H) has prepared this report to document tenant upfit activities completed at the Square at Southend Apartments mixed-use development on the western portion of the West Boulevard Brownfields Property (Brownfields Project No. 22076-18-060). The West Boulevard Brownfields Property is located northeast of the intersection of S. Tryon Street and West Boulevard in Charlotte, Mecklenburg County, North Carolina (Site). The western part of the Site is identified as 222 West Boulevard and was redeveloped with two mixed-use residential and commercial buildings. The buildings are located adjacent to the north and south of the multi-level parking garage. A Site location map is included as Figure 1, and the redevelopment layout is included as Figure 2. The eastern part of the Site is developed with a 10-story office building with commercial tenant spaces on the ground floor. The Site redevelopment on the western part of the Site included construction of a parking garage with two distinct buildings designed for mixed commercial and residential use to the north and south. The southern building footprint is approximately 8,719 square feet and includes commercial tenant spaces on the first floor and residential units above. The northern building footprint is approximately 4,693 square feet and includes residential, commercial, and amenity use on the first floor with residential units above. The DEQ-approved VIMP included installation of a passive sub-slab depressurization system in the mixed-use buildings and post-installation soil gas sampling. VIMS installation activities for the northern building were documented in H&H’s VIMS Installation Completion Report dated February 8, 2022, and the southern building activities were documented in the VIMS Installation Completion Report dated March 9, 2022. Briefly, the VIMS consists of a passive sub-slab depressurization system which is comprised of an interconnected system of vapor collection/conveyance piping installed in a permeable gravel layer beneath the buildings. The sub-slab piping is connected to riser piping which extends vertically through the building and discharges vapors through exhaust stacks installed above the building roof. Empire Model TV04SS (stainless steel) turbine ventilator fans were installed on the discharge end of the exhaust stacks on the roof. In addition, Vaporblock® Plus 20 (VBP20), a vapor barrier manufactured by Raven Industries (Raven), was installed above the gravel layer and beneath the concrete slab of the office building. The VIMS layout in the southern building is included on Figure 3. The DEQ-approved VIMP included pre-occupancy sub-slab sampling, along with three post- occupancy sub-slab sampling events. The pre-occupancy sampling was completed in December 2021 and February 2022, and the first post-occupancy event was completed in July 2022. The results of the pre-occupancy sampling and the first July 2022 post-occupancy sampling event indicate that the calculated worst-case, residential-use and non-residential-use cumulative carcinogenic and non-carcinogenic risks associated with the detected sub-slab gas concentrations are well below the DEQ and EPA acceptable thresholds. Thus, the detected concentrations do not pose a risk of vapor intrusion above acceptable levels. Please note, the tenant upfit activities discussed below were completed after the July 2022 post-occupancy sampling. At this time, the retail space remains unoccupied without a concrete slab. The remaining commercial tenant spaces were completed with concrete slabs. Tenant upfit activities are currently being conducted in two of these spaces, and the upfit work required cutting through the concrete slab. H&H was retained to oversee the portions of the tenant upfit activities that impacted the VIMS. A discussion of the tenant upfit activities and VIMS inspections is provided in Section 2.0, and a summary and conclusions are provided in Section 3.0. 2.0 Tenant Upfit Inspections Tenant upfit activities are currently being conducted in two commercial tenant spaces in the southern building at the Site. Urban Sweets is upfitting the eastern commercial space, and Beard Papa’s is upfitting the western commercial space, adjacent to the east of the leasing office. Since both tenants will operate food handling facilities, as part of the upfit activities, trenches were installed in portions of the building slab in each tenant space for installation of sub-slab utilities. The approximate slab cut areas are depicted on Figure 3. The upfit activities which impacted the slab were completed in both the Urban Sweets and Beard Papa’s spaces in September and October 2022. In accordance with the requirements of the DEQ-approved VIMP, VIMS components in the retail spaces were inspected by a NC PE, or a designee under direction of a PE, during tenant space upfit activities. Based on the tenant upfit plan, the concrete slab and vapor barrier beneath the slab were cut to allow for utility installations below the VIMS. After installation of the utilities and before the concrete slab was poured, the VIMS components were repaired and restored in accordance with the DEQ-approved VIMP. After installation and inspection of the gravel and verification that the vent pipes remained in good condition, VBP20 vapor barrier was replaced above the gravel layer and sealed to the Mr. Bill Schmithorst, PG November 30, 2022 Page 4 https://harthick.sharepoint.com/sites/masterfiles-1/shared documents/aaa-master projects/centro cityworks ccw/ccw-004 square residential/vimp/tenant upfit report/22076 -tenant upfit report_west boulevard.doc existing barrier and concrete in accordance with manufacturer installation instructions. Vertical utilities which penetrate the concrete slab were also sealed in accordance with VBP20 manufacturer installation instructions. The concrete was then poured to complete the slabs in the retail spaces. H&H completed the following VIMS inspections: • visual inspection of the base gravel and VIMS vent piping prior to installation of the vapor barrier; • visual inspection of the vapor barrier prior to the concrete pour; and • visual inspection of the sealant at the joints between the original and repaired concrete. Based on the locations of the slab cuts, no VIMS vent piping was modified during the tenant upfit activities. Representative photographs from the upfit inspections are included as Appendix A. 3.0 Summary and Conclusions Construction has been completed at the mixed-use residential and commercial Square at Southend Apartments on the western part of the West Boulevard Brownfields property (Brownfields Project No. 22076-18-060) located in Charlotte, Mecklenburg County. VIMS installation and pre-occupancy sampling activities were documented in two VIMS Installation Completion Reports dated February 8, 2022 and March 9, 2022, and the first post-occupancy sampling event was documented in the VIMS Post-Installation Sampling Report dated October 19, 2022. Two additional post-occupancy sampling events are planned for July 2023 and July 2024, in accordance with the DEQ-approved VIMP.
