HomeMy WebLinkAbout08026_Fulflex_Soil Disturbance Approval_2022Oct5 October 5, 2022 Sent via Email to: cbagley@synterrracorp.com SynTerra Corp., Science & Engineering Consultants Attn: Chris Bagley 511 Keisler Drive, Suite 102 Cary, NC 27518 Re: Soils Disturbance Work Plan Former Fulflex Inc. 500 Airboss Parkway Scotland Neck, Halifax County Brownfields Project No. 08026-04-042 Dear Chris, The North Carolina Department of Environmental Quality, Brownfields Program – Property Management Unit (“DEQ”) received your email on October 4, 2022, containing information regarding a proposed work plan to disturb soils in accordance with the Notice of Brownfields Property (“Notice”) recorded at the Halifax County Register of Deeds, book 2065, page 631, on Feb. 8, 2005. The Notice contains land use restrictions (“LUR”), specifically LUR 5 & 6, requiring owner (AirBoss Rubber Compounding Inc.) to provide 5 days advanced written notice of any soil disturbances for purposes of protecting human health and the environment, and that DEQ approval is required for any such soil disturbances. The emailed information consisted of work proposal to disturb approximately 6.8 cubic yards of surficial soils for the installation of an exterior emergency stairwell foundation. Additionally, the work plan incorporates procedures from a previously DEQ approved Environmental Management Plan should soil impacts be suspected or discovered during the disturbance activities. It is also noted that groundwater will not be encountered during the described work, and that displaced soils will be relocated on-site. After my review of the provided information, DEQ hereby approves the soil disturbance as outlined in the proposed work plan so that owner can continue to comply with the restrictions set forth in the Notice. Please be advised that this approval from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other North Carolina or local governing entities.
