No risk to the public was observed at the time of the inspection, with the exception of a
concrete retaining wall bordering Sugar Creek where a steel handrail is proposed (Photos
3 & 4). The perimeter of the property is fenced with temporary construction and
barricade fencing to prevent unauthorized entry to the property, and temporary orange
barrier type fencing is installed as a safety measure.

Photo 1: View facing west of apartment building and parking deck under construction.
A copy of the EMP and erosion control documents were in the job trailer, and Mr.
Jennings acted as an escort during the Site Inspection.
While walking the property, Mr. Jennings explained that a metal handrail would be
mounted on the concrete retaining wall for safety purposes. Subsequent to the Site
Inspection, Hart & Hickman’s July 14th, 2022 - Stream Access Control Barrier and Signage
plan was submitted. This plan proposed the installation of control barriers and signage to
limit creek access to satisfy the Brownfields Agreement paragraph 13 (l). This plan was
subsequently approved by DEQ on July 15th 2022.
