HomeMy WebLinkAbout20050_Rite Aid_B2 - North_VIMP Mod_2022-07-11 Via Email July 11, 2022 NCDEQ – Division of Waste Management Brownfields Program 1646 Mail Service Center Raleigh, NC 27699-1646 Attn: Ms. Carolyn Minnich Re: VIMS Modifications Approval Request Rite Aid Facility - Camp North End Building 2 – North – Suites 103, 110, 111, & 112 1776 Statesville Avenue Charlotte, Mecklenburg County, North Carolina Brownfields Project No. 20050-16-060 H&H Project No. ATL.006 Dear Carolyn: On behalf of Camp Landowner, LP, Hart & Hickman, PC (H&H) has prepared this letter to request that the North Carolina Department of Environmental Quality (DEQ) Brownfields Program provide approval for proposed modifications to the vapor intrusion mitigation plan (VIMP) prepared for the Camp North End Building 2 – North building (Brownfields Project No. 20050- 16-060) located at 1776 Statesville Avenue in Charlotte, Mecklenburg County, North Carolina (Site). The VIMP modifications in this request are related to utility trenches, Suite 103 located on the southwestern corner of Building 2 – North, and Suites 107, 110, 111, & 112 located on the northernmost portion of the building. On October 28, 2020, the DEQ Brownfields Program provided approval for the Vapor Intrusion Mitigation Plan – Revision 1 dated October 2, 2020 related to installation of a vapor intrusion mitigation system (VIMS) during renovation/upfit activities for the existing Building 2 – North. In accordance with the DEQ-approved VIMP, an active sub-slab depressurization (SSD) system Ms. Carolyn Minnich July 11, 2022 Page 2 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/ATCO LLC - ATC/ATL-001 - Rite Aid/Task-009 Brownfields/VIMS Design/VIMP Mod - July 2022/VIMS Modification Request_Suites 103,111-112.docx using the Cupolex® aerated floor system, a new concrete slab, and electric fans along with a vacuum alarm system are currently being installed during renovation of the building. Currently, renovation activities are underway in Building 2 – North to upfit the building for commercial purposes. The most recent VIMP – modification request, dated September 10, 2021, was approved by DEQ in a letter dated October 11, 2021. The proposed VIMP modification detailed here-in includes VIMS design drawings identified as Revision 4, and dated July 11, 2022 included as Attachment 1. Note, monitoring point labels have been added to the Rev. 4 drawings for reference. A description of the proposed VIMS modifications is described below. Utility Trench Sealing The Building 2 – North renovation includes a new minimum 4-inch thick concrete slab over the Cupolex forms, but in some areas shallow utility trenches are present within the new concrete slab where approximately 1-to-2-inch layer of concrete is present. Note, all utility trenches are located directly over Cupolex forms. Within these trenches, after utility conduits are installed, an additional 2-to-3-inch layer of concrete will be poured over the utility conduits. The installation of the utilities in one of the last planned construction items so other VIMS effectiveness testing would be performed prior to completion. Thus, H&H completed smoke testing on Building 2 – North on March 25, 2022 with DEQ personnel on-site to identify areas to focus on sealing prior to the pilot/influence testing. The smoke testing identified leaks from cracks within in the utility trenches where the thinner layer of concrete was present. However, as an additional measure prior to the full installation, Tremco EXOAIR® 130, a fluid-applied air and vapor retarder membrane, was used to seal large cracks (~1/8” or greater) within the trenches, but it was not applied across the entire trench. The proposed pre-occupancy indoor air VIMS effectiveness analytical sampling will be conducted prior to the final layer of concrete over the utility trenches due to construction sequencing and so the utilities trenches are anticipated to be further sealed prior to occupancy. Interior Suite 107, and Suites 110 to 112 Layout Modification The northern portion of Building 2 – North includes two suites identified as Suites 107 and 111/112 (see VIMS Drawings – Rev 4). Former Suite 110, identified in the September 2021 modification request, will now be fully incorporated into current Suite 107 and no longer exists. This suite is proposed to be occupied by a single restaurant business. Cut-off footers and the demising wall that were previously described and approved in the September 2021 modification request will no longer be needed between the previous Suite 110 and Suite 107. However, as proposed in the September 2021 modification request, a demising wall and cut-off footer between Suite 111/112 and Suite 107 has been constructed. The demising wall is an interior stud framed wall finished with drywall constructed from the existing floor to the existing roof with no doors or windows connecting to other suites. Conduits installed for utility purposes through the demising wall are sealed to prevent air transfer between the suites. The location of the footers and walls is located on Sheet VM-1 (Attachment 1). The riser identified as Riser F-5 will be installed to provide sub-slab depressurization of the proposed restaurant Suite 111/112 (see VIMS Drawings – Rev 4). Riser F-5 will contain an electric fan and differential pressure sensor connected to the proposed Sentinel alarm system. As this new Suite 111/112 will be one interconnected area, the previous plan for separate risers and valve controls are no longer required and have been removed from the design. Suite 103 Expansion The proposed Suite 103 was expanded to a larger footprint as shown on the Rev. 4 drawings. A cut-off footer and demising wall was installed to separate Suite 103 from Suite 100. Due to the relatively small footprint of Suite 103 (approximately 2,300 sq ft), the original plan for interconnected Cupolex from Suite 100 to Suite 103 will remained as proposed so an additional riser and electric fan in Suite 103 is not proposed. Approximately 25 to 30 1-inch diameter PVC connector pipes were installed through the cut-off footer as shown in the Rev. 4 drawings. These connector pipes are currently capped to prevent air short-circuiting with Suite 100 until Cupolex and concrete is installed within Suite 103. During installation, the caps will be removed and after connection to the main system, vacuum will be tested within Suite 103 and the remaining monitoring points throughout the building to verify adequate vacuum is present with the fans operational. Ms. Carolyn Minnich July 11, 2022 Page 4 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/ATCO LLC - ATC/ATL-001 - Rite Aid/Task-009 Brownfields/VIMS Design/VIMP Mod - July 2022/VIMS Modification Request_Suites 103,111-112.docx Pre-occupancy Analytical Sampling After Suite 103 and Suites 111/112 are completed and prior to occupancy of these suites, one indoor air sample and one concurrent sub-slab vapor sample will be collected from each suite (see VIMS Drawings – Rev 4). Note, the previous samples that were proposed in Suite 110 will no longer be collected, as the samples collected within Suite 107 will be representative of this area. All sub-slab and indoor air sampling will be conducted in accordance with the sampling procedures contained within the DEQ-approved VIMP and standard DEQ sampling procedures. Note, the DEQ-approved VIMP didn’t propose collection of sub-slab vapor samples, but per prior discussion and approval via email with DEQ, sub-slab vapor samples will be collected in Building 2 – North to help evaluate the potential for the presence of compounds from building material off-gassing during the analytical sampling. Note, the specific list of analytes for the sub-slab vapor and indoor air samples will be approved by DEQ prior to laboratory analysis of the samples. Further, the quality control samples including a duplicate sample during each sampling event and background ambient air sample will be collected during these events. Furthermore, the semi- annual indoor air sampling events indicated in the VIMP will also apply to these suites following the initial pre-occupancy sampling event. In addition, while these suites may be upfitted at a later date than the rest of the building, the same VIMS inspections, DEQ notifications, pre-occupancy influence testing, post-construction quarterly vacuum monitoring, and reporting requirements as indicated in the DEQ-approved VIMP will be followed for these suites. Engineer’s Certification According to the DWM Vapor Intrusion Guidance: “Risk-based screening is used to identify sites or buildings likely to pose a health concern, to identify buildings that may warrant immediate action, to help focus site-specific investigation activities or to provide support for building mitigation and other risk management options including remediation.” In addition, this VIMP modification request was prepared to satisfy the vapor intrusion mitigation condition in the Brownfields Agreement. Per the North Carolina Brownfields Property Reuse Act 130A-310.32, a prospective developer, with the assistance of H&H for this project, is to provide NCDEQ with “information necessary to demonstrate that ... as a result of the implementation of the brownfields Ms. Carolyn Minnich July 11, 2022 Page 5 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/ATCO LLC - ATC/ATL-001 - Rite Aid/Task-009 Brownfields/VIMS Design/VIMP Mod - July 2022/VIMS Modification Request_Suites 103,111-112.docx agreement, the brownfields property will be suitable for the uses specified in the agreement while fully protecting public health and the environment instead of being remediated to unrestricted use standards.” It is in the context of these risk-based concepts that H&H’s professional engineer makes the following statement. The Vapor Intrusion Mitigation System (VIMS) detailed herein is designed to mitigate intrusion of subsurface vapors into the subject building from known Brownfields Property contaminants in a manner that is in accordance with the most recent and applicable guidelines including, but not limited to, DWM Vapor Intrusion Guidance, Interstate Technology & Regulatory Council (ITRC) guidance, and American National Standards Institute (ANSI)/American Association of Radon Scientists and Technologists (AARST) standards. The sealing professional engineer below is satisfied that the design is fully protective of public health from known Brownfields Property contaminants.
