Kingston Avenue; 1700, 1708, 1714, 1720, and 1728 South Boulevard; and 101, 105, and 115 East Boulevard in Charlotte, Mecklenburg County, North Carolina (Site). The Site is part of the North Carolina Department of Environmental Quality (DEQ) Brownfields Program (Brownfields No. 24051-20-060). The development is known as Ascent Southend and consists of one high-rise building with retail and amenity spaces on the ground floor, a parking deck located above the ground floor, and multi-family residences located above the parking deck. The Site is being developed by Greystar. On February 2, 2022, the DEQ Brownfields Program provided approval for the Vapor Intrusion Mitigation Plan – Revision 1 dated January 12, 2022 related to installation of a passive vapor intrusion mitigation system (VIMS) during construction of the Site building. The proposed modifications to the VIMP are depicted on the VIMS Design Drawings – Revision 2, dated April 19, 2022, and included in Attachment A. A brief summary of the modifications are also listed below. 1. The ground floor layout of the building was modified to include an open-air non- conditioned vehicle drive-through area on the western portion of the building that runs through the entire building between Retail Space #2 (Retail 2) and Retail Space #3 (Retail 3). In the DEQ-approved VIMP, this area included a trash hangar and proposed enclosed retail spaces. With the addition of the open-air drive-through, Retail 2 was reduced in size. As such, the revised VIMS drawings include a reduction in vent pipe and vapor barrier based on the new layout. As the drive-through is open-air and not enclosed, VIMS controls below the drive-through are not warranted. The proposed riser (E-B1) location, size, exhaust plan, and pipe material in Retail 2 will remain the same as in the approved VIMP. In addition, the same number of monitoring points will remain as in the approved VIMP, but temporary monitoring point TMP-B2 will be shifted to remain within the Retail 2 space. 2. The stairwell on the north side of Retail 3 changed slightly to include a recessed entryway (doorway) to the stairwell. As such, minor changes to the sub-slab vent piping were made to accommodate this recessed entryway. One monitoring point (MP-C3) will remain in this stairwell as proposed in the approved VIMP. 3. The builder is planning to apply a 60-mil self-adhering waterproofing membrane (e.g. Carlisle MiraDri 860) on the outside of the exterior footers. This waterproofing membrane has a permeance lower than 0.1 perms which is considered the highest class of vapor retarder (i.e. vapor barrier) per American Society of Testing and Materials ASTM specifications. The approved VIMP indicates that vapor barrier would extend, where possible, close to finished grade, but the exterior waterproofing wasn’t specified in the VIMP. The application of the waterproofing membrane along the outside of the exterior footers will make the vapor barrier unnecessary (Detail 11/VM-2) in most areas. Therefore, in areas where the exterior grade remains lower than the interior slab elevation, Mr. Bill Schmithorst April 25, 2022 Page 3 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/White Point Partners (WPP)/WPP-011 Dilworth Auto Service/VIMP/VIMP Mod - Rev 2 drawings/24051_Dilworth Auto_VIMS Mod Request _042522.docx the modification includes installation of the waterproofing only on the outside of the exterior footer, as vapor intrusion into the buildings is unlikely to occur in these areas due to the grade elevations, and the waterproofing material still acts as a vapor retarder. However, as an additional precaution, in areas where the final grade soils will extend higher than the slab elevation of interior spaces (Detail 12/VM-2) that cause soil to be placed adjacent to exterior walls, the vapor barrier specified in the VIMP will be installed along the exterior footer along with the proposed waterproofing. The details were slightly modified to incorporate these scenarios. The proposed VIMP modifications detailed herein will allow for coordination of the VIMS installation with the revised building plans and provide more information for the installation contractors. These modifications are intended to supplement the DEQ-approved VIMP and so the provisions in the VIMP (e.g. inspections, influence testing, sampling etc.) not referenced above will continue to apply. Engineer’s Certification Statement According to the DWM Vapor Intrusion Guidance: “Risk-based screening is used to identify sites or buildings likely to pose a health concern, to identify buildings that may warrant immediate action, to help focus site-specific investigation activities or to provide support for building mitigation and other risk management options including remediation.” In addition, this VIMP was prepared to satisfy the vapor intrusion mitigation condition in the pending Brownfields Agreement. Per the North Carolina Brownfields Property Reuse Act 130A-310.32, a prospective developer, with the assistance of H&H for this project, is to provide NCDEQ with “information necessary to demonstrate that as a result of the implementation of the brownfields agreement, the brownfields property will be suitable for the uses specified in the agreement while fully protecting public health and the environment instead of being remediated to unrestricted use standards.” It is in the context of these risk-based concepts that H&H’s professional engineer makes the following statement. The sealing professional engineer below is satisfied that the design is fully protective of public health from known Brownfields Property contaminants. BENDS, TURNS, AND ELBOWS IN VERTICAL RISER PIPES SHALL BE MINIMIZED FROM THE SLAB TO THE ROOFTOP. 5.EXHAUST DISCHARGE LOCATIONS SHALL BE A MINIMUM OF 10 FT FROM ANY OPERABLE OPENING OR AIR INTAKE INTO THE BUILDING, 10 FT FROM PUBLIC AREAS, AND 20 FT FROM THE GROUND ELEVATION. AN ELECTRICAL JUNCTION BOX (120V REQUIRED) FOR OUTDOOR USE SHALL BE INSTALLED WITHIN 5FT OF THE EXPOSED RISER PIPE PRIOR TO THE EXHAUST DISCHARGE FOR POTENTIAL FUTURE CONVERSION TO ELECTRIC FANS, IF REQUIRED. THE ADDITIONAL THICKENED SLAB OR FOOTER SHALL NOT ALLOW FOR CONTINUOUS GRAVEL BETWEEN THE VIMS EXTENTS AND EXTERIOR PORTIONS OF THE BUILDING WITH AT LEAST 12" SEPARATION OF ADJACENT GRAVEL BEDS. IF WATERPROOFING IS PRESENT, THE VAPOR BARRIER SHALL BE INSTALLED BETWEEN WATERPROOFING AND ANY DRAINAGE FEATURES INCLUDING DRAINAGE MATS WHERE IT OVERLAPS (SEE DETAIL #16).
