According to the Mecklenburg County Property Ownership and Land Records Information System (POLARIS), the Parcel ID Number for the Brownfields Property is 14901254 and consists of approximately 3.872 acres. It should be noted that the address previously assigned to this site prior to redevelopment was 3804 South Boulevard. The parcel is owned by CC LoSo Station, LLC. ECS further understands that this Brownfields Property is known as Affordable Custom Iron within the North Carolina Brownfields Program (NCBP) and has been assigned Brownfields Project Number 23056-19-060. The Brownfields property was historically the site of residences, commercial/warehouse buildings, a drive- in theater, and a commercial shopping center until sometime before 2006. At one time, the property was used by a company called Affordable Custom Iron, with historical operations that appeared to include a spray paint booth and an incinerator. After 2006 the main shopping center/commercial buildings were no longer present. In 2009, a parking lot was developed, and no buildings remained on the property by 2012. According to the Brownfields application which was submitted to the North Carolina Brownfields Program (NCBP) on September 13, 2019, redevelopment of the subject Brownfields Property is one portion of a cooperative project between prospective developer, the City of Charlotte, and other third-party developers to return the Brownfields Property and other surrounding parcels to productive use. Redevelopment of the Brownfields Property will include construction of a parking garage that, by agreement with the City, will include free public parking serving passengers using the nearby light rail station. Redevelopment activities began in early 2020 and continue at this time. Construction is scheduled to be completed in 2022 with phased occupancy to begin in August 2021. No further grading activities are planned or anticipated for the Brownfields Property. In accordance with the approved Environmental Management Plan (EMP) for the site, a work plan was developed for the collection of surficial soil samples in portions of the site not covered by hardscape. The work plan was approved by the North Carolina Brownfields Program on July 8, 2021. On July 12, 2021, ECS requested by email that the work plan be implemented in two phases to accommodate phased construction by the prospective developer (PD) and occupancy. In this email, ECS requested that Areas 1, 2, and 6 be assesses at the current time and Areas 3, 4, and 5 at a later time. The portion of the Brownfields Property which was to be occupied first, represented by Areas 1, 2, and 6, is shown in Figure 2. Areas 1 through 6 are described in the approved work plan. In a July 19, 2021, email (Appendix A), the NCBP approved this request for the phased implementation of the work plan. ECS was notified by Crescent Communities on October 27, 2021, that Area 5 would be ready for sampling on or about November 15, 2020, and Areas 3 and 4 would be ready for sampling in early 2022. This report details sampling which was performed in Area 5 in December 2021. A work plan was submitted, approved and executed. This report has been prepared to describe the executed work plan and subsequent results for the first phase of implementation. ECS Southeast, LLP 1612 Center Park Drive, Suite D Charlotte, North Carolina 28217 jnestor@ecslimited.com 2.0 SCOPE OF SERVICES The services described below were performed to provide initial final grade soil assessment activities requested by the NCBP. Towards the completion of the earthmoving activities at the site, a Final Grade Sampling Work Plan was developed, and submitted to and subsequently approved by the Brownfields Program on July 8, 2021. As described previously, on July 12, 2021, ECS requested that the work plan be implemented in two phases to accommodate phased construction by the PD and occupancy. On July 19, 2021, the NCBP approved this request. Emails documenting the phase approach request and approval are included in Appendix A. This report summarizes the implementation of Phase II of the Final Grade Sampling and the results. In accordance with the approved work plan, on December 10, 2021, five soil borings were advanced to two feet below the ground surface (bgs) in Area 5 section (Figure 2). Each composite sample was comprised of five individual grab soil samples collected in re-sealable bags from each section. An individual soil sample and a duplicate was collected from zero to two feet bgs at each sample point to be composited. Additionally, an individual soil sample and a duplicate sample was collected from one to two feet bgs at each sample point to be used as the samples for the analysis of volatile organic compounds (VOCs). The individual and duplicate samples were placed immediately in plastic bags after collection and sealed. The duplicate sample bags were placed on ice to prevent volatilization prior to screening of the individual bags. Each individual sample was screened using a photoionization detector (PID) for volatile organic vapors. The individual grab soil sample with the highest PID reading from each 1- to 2-foot section was appropriately packaged in laboratory-supplied containers from its duplicate re-sealable bag and submitted to Pace Analytical Services, LLC, a North Carolina certified laboratory located in Huntersville, North Carolina, to be analyzed for VOCs using EPA Method 8260. Subsequently, the grab soil samples from zero to two feet bgs were gently mixed together and one composite soil sample per section was submitted for analysis by EPA Method 8270 for Semi-Volatile Organic Compounds (SVOCs), the eight metals regulated under the Resource Conservation and Recovery Act (RCRA 8-metals) using EPA Methods 6010 and 7471, and for hexavalent chromium (Cr VI) by EPA Method 7199. The samples were collected and shipped to the laboratory under chain-of custody procedures. A copy of the Chain-of Custody Record is included in Appendix B. 3.0 RESULTS The following sections describe results of the field assessment and analytical laboratory testing of soil samples collected on December 10, 2021. The results of the soil samples were compared to the most current version of the Inactive Hazardous Sites Branch (IHSB) Protection of Groundwater, the Residential, and the Industrial/Commercial Health Based Preliminary Soil Remediation Goals (PSRGs). Laboratory analysis of soil samples Area 5 indicated hexavalent chromium at concentrations greater than its IHSB Residential PSRG, but less than its Protection of Groundwater and Industrial/Commercial PSRGs. Arsenic was detected at a concentration greater than its Residential and Industrial/Commercial PSRG in the Area 5 sample, but less than its Protection of Groundwater PSRG. A summary of the laboratory soil analytical data is shown on Table 1. A copy of the laboratory analytical report is included in Appendix B. Based upon the analytical results of the samples collected, the detected concentrations were input into the NCDEQ DWM Risk Calculator to assess if unacceptable risk criteria were exceeded. Results indicated that neither the carcinogenic risk nor hazard index was exceeded for residential or non-residential worker receptors for the samples collected during this assessment. The Risk Calculator output data is included in Appendix C. 4.0 FINDINGS & CONCLUSIONS Based on the results of the field activities and laboratory analysis, ECS concludes the following: • One grab and one composite sample were collected from Area 5 of the subject Brownfields site. A duplicate soil sample was also collected. • Hexavalent chromium was detected in the soil samples collected at a concentration greater than its Residential PSRG. Arsenic was detected in the sample at a concentration greater than its Residential and Industrial/Commercial PSRG. • Results of the Risk Calculator did not indicate an exceedance of either the carcinogenic risk or hazard risk for the samples collected during this assessment. 5.0 RECOMMENDATIONS • Based on the laboratory analytical results and risk analysis future additional soil assessment, remediation, or capping are not recommended; however, existing land use restrictions incorporated into the site’s Brownfield Agreements should be maintained. • Based upon the laboratory analytical results and the risk analysis, ECS recommends that the PD begin using Area 5 of the Brownfields Property shown in Figure 3 of this report, as contemplated by Section 16.d. of the Brownfields Agreement. Our evaluation of site conditions has been based on our understanding of the site project information determined during previous environmental assessments and the data obtained during our field activities. This report was prepared for the express use of the North Carolina Brownfields Program. (When we spoke I inadvertently said “western” due to orientation of map in work plan with north to the right). We understand that the final grading has not been completed at this time on the northern portion of the development where areas 3, 4 and 5 in the approved work plan are located. As discussed, we intend to move forward with final grade sampling in the southern portion of the development and will sample areas 1, 2, and 6 in the near future. We will samples areas 3, 4, and 5 at a later time when final grading has been 2 completed in those areas. We will submit separate summary reports for the southern and northern areas.
