Consistent with the Brownfields agreement for this project, an essential component of public health protection for this design is the professional engineer’s seal of these documents that the proposed design will be effective at mitigating the potential for vapor intrusion at the property and protecting public health. Furthermore, the safe occupancy of the building will be evaluated upon “Post-Construction and Pre-Occupancy System Effectiveness Testing” as required by Section 4.0 of the VIMP. In addition, DEQ Brownfields reserves the authority to require confirmation of efficacy in the future. Please be advised that this design compliance review from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities. Davidson Street Charlotte, Mecklenburg County, North Carolina Brownfields Project No. 23085-19-060 H&H Project No. FDL.001 Dear Caroline: On behalf of TCD NoDa Mills, LLC c/o Federal Capital Partners, Hart & Hickman, PC (H&H) has prepared this letter to request that the North Carolina Department of Environmental Quality (DEQ) Brownfields Program provide approval for proposed modifications to the vapor intrusion mitigation plan (VIMP) prepared for the Johnston Mill Brownfields Property (Brownfields Project No. 23085-19-060) and located at 3315 N. Davidson Street in Charlotte, Mecklenburg County, North Carolina (Site). On March 26, 2021, the Brownfields Program provided approval for the Vapor Intrusion Mitigation Plan – Revision 1A dated March 5, 2021 related to installation of vapor mitigation controls during renovation/upfit activities for the existing Johnston Mill building. A previous VIMS Modification Approval Request, dated May 5, 2021, was approved by DEQ via email on May 6, 2021. In accordance with the approved VIMP, a passive vapor intrusion mitigation system Ms. Caroline Goodwin January 13, 2022 Page 2 S:\AAA-Master Projects\Federal Capital Partners - FDL\FDL-001 Johnston Mill\VIMP\VIMP - Modification\January 2022\23085-19-060_VIMS Modification Request_Johnston Mill_2022-01-13.docx (VIMS) is being installed during renovation of the building. The proposed VIMS modification is described in the following paragraphs. Interior Basement Wall Vapor Barrier Installation The DEQ-approved VIMP includes installation of a 15-mil vapor barrier along the vertical basement walls between existing soils and the back of the brick walls that are adjacent to enclosed spaces. The vapor barrier as designed was installed along the eastern and southern basement walls in accordance with the VIMP details. The vapor barrier was installed by excavating the existing soils behind the wall, installing and sealing the vapor barrier against the brick wall, then backfilling the removed soils. However, in one portion of the building along the northern basement wall, the existing wall was discovered to be a load bearing footer for several of the building columns. Therefore, there is a structural concern of compromising the building stability and thus the construction contractor was unable to excavate behind this wall and install the vapor barrier as planned. This northern basement wall is approximately 50 feet long and approximately 8 feet high. In lieu of installing the vapor barrier between the soil and exterior of the brick wall, it is proposed that the vapor barrier is installed along the interior of the brick wall for this northern section of the basement. The proposed installation will include adhering the Stego Industries 15-mil Stego-Wrap® vapor barrier to the interior of the brick wall using manufacture double-sided tape gasket/sealants, In addition, a termination bar will be installed over the double-sided tape gasket around the perimeter of the vapor barrier indicated for this style of vapor barrier in the DEQ-approved VIMP. The termination bar will be installed over the gasket and screwed into the brick wall. After installation of the vapor barrier, the construction contractor will construct a stud wall along this brick wall to cover and protect the installed vapor barrier. Details regarding the proposed vapor barrier installed along this northern basement wall are included in the VIMS design drawings in Attachment 1. Vent Piping and Riser Layout During construction of the crawl space area depicted as Area C2 on Sheet VM-1, an existing building load-bearing footer was discovered. To avoid cutting through this footer to connect the proposed crawl space VIMS pipe, the VIMS vent pipe was terminated on each side of this footer which created two separated VIMS sections. In order to provide greater vacuum influence on the northern larger section, an additional riser (F- 2A) is proposed in this section at the location depicted on Sheet VM-1 (Attachment 1). This additional riser will be installed similar to the approved design. The riser will consist of a 3-inch diameter Schedule 40 PVC pipe that extends from the crawl space to the roof, and contain a wind- driven turbine ventilator identical to the other proposed risers. Crawl Space Vapor Barrier The DEQ-approved VIMP includes installation of a 15-mil vapor barrier within the crawl spaces. In lieu of the 15-mil vapor barrier, the installation contractor proposed the use of the Land Science Monoshield vapor barrier, a 30-mil chemically resistant composite vapor barrier with spray-on seams and sealants, to save installation time and effort. Monoshield is designed for vapor intrusion mitigation and consists of several layers including a polyester reinforcement/protection layer. The H&H design engineer approved the use of Monoshield in lieu of a 15-mil vapor barrier for the crawl spaces. While Monoshield has already been installed over most of the crawl space areas as of the date of this letter, this document serves as a notification to DEQ of the vapor barrier change for the crawl spaces. Note, the 15-mil Stego-Wrap® vapor barrier is still proposed for the areas of the building that will receive a new concrete slab as depicted in the VIMP design. Engineer’s Certification According to the DWM Vapor Intrusion Guidance: “Risk-based screening is used to identify sites or buildings likely to pose a health concern, to identify buildings that may warrant immediate action, to help focus site-specific investigation activities or to provide support for building mitigation and other risk management options including remediation.” In addition, this VIMP was prepared to satisfy the vapor intrusion mitigation condition in the Brownfields Agreement. Per the North Carolina Brownfields Property Reuse Act 130A-310.32, a prospective developer, with the assistance of H&H for this project, is to provide NCDEQ with “information necessary to demonstrate that as a result of the implementation of the brownfields agreement, the brownfields Ms. Caroline Goodwin January 13, 2022 Page 4 S:\AAA-Master Projects\Federal Capital Partners - FDL\FDL-001 Johnston Mill\VIMP\VIMP - Modification\January 2022\23085-19-060_VIMS Modification Request_Johnston Mill_2022-01-13.docx property will be suitable for the uses specified in the agreement while fully protecting public health and the environment instead of being remediated to unrestricted use standards.” It is in the context of these risk-based concepts that H&H’s professional engineer makes the following statement. The Vapor Intrusion Mitigation System (VIMS) detailed herein is designed to mitigate intrusion of subsurface vapors into the subject building from known Brownfields Property contaminants in a manner that is in accordance with the most recent and applicable guidelines including, but not limited to, DWM Vapor Intrusion Guidance, Interstate Technology & Regulatory Council (ITRC) guidance, and American National Standards Institute (ANSI)/American Association of Radon Scientists and Technologists (AARST) standards. The sealing professional engineer below is satisfied that the design is fully protective of public health from known Brownfields Property contaminants. THE VAPOR PINS WILL BE INSTALLED FOLLOWING THE CONCRETE POUR. INSPECTIONS 16.INSPECTIONS: INSPECTIONS OF EACH COMPONENT OF THE VIMS SHALL BE CONDUCTED BY THE DESIGN ENGINEER, OR ENGINEER'S DESIGNEE, TO CONFIRM VIMS COMPONENTS ARE INSTALLED PER THE APPROVED DESIGN. THE REQUIRED INSPECTION COMPONENTS INCLUDE: (1) INSPECTION OF SUB-SLAB PIPING LAYOUT AND GRAVEL, INCLUDING PIPING WITHIN THE CRAWL SPACE AREAS, (2) MONITORING POINT PLACEMENT AND INSTALLATION; (3) INSPECTION OF VAPOR BARRIER PRIOR TO POURING CONCRETE AND INSPECTION OF VAPOR BARRIER WITHIN CRAWL SPACES (4) INSPECTION OF ABOVE-GRADE PIPING LAYOUT; AND (5) INSPECTION OF TURBINE FANS AND RISER DUCT PIPE CONNECTIONS. INSPECTION OF THE VAPOR BARRIER WITHIN THE CRAWL SPACES WILL INCLUDE A SMOKE TEST TO ASSESS FOR LEAKS IN THE VAPOR BARRIER. INSPECTIONS WILL BE COMBINED WHEN POSSIBLE DEPENDING ON THE CONSTRUCTION SEQUENCE/SCHEDULE. THE CONSTRUCTION CONTRACTOR(S) SHALL COORDINATE WITH THE ENGINEER TO PERFORM THE REQUIRED INSPECTIONS. The combination of the chemically resistant metalized film thermally bonded to polyethylene and the durable geotextile allows it to act as a vapor barrier system for low-level contaminated sites. It is designed and installed over the substrate with the geotextile fabric facing down and metallic side facing up to effectively mitigate vapor intrusion. Application Details: • MonoBase is seamed together with a 6” overlap and bonded using Land Science’s MonoCore at 60-mil thickness; applying the core to both above and below the barrier overlaps. • MonoBase is overlapped at all perimeters a minimum of 3” onto the perimeter foundation with adherence using the Nitrile Core. • All penetrations are wrapped using the MonoBase, zip tied and MonoCore is sprayed to seal each penetration. • Smoke testing can be performed on the MonoShield System and is recommended to ensure the system is free of leaks.
