Hemmerdinger ATCO Properties 9777 Queens Boulevard Rego Park, NY 11374 damon@atco.us Subject: Building 3 Central Warehouse Residential Approval Rite Aid Brownfields Site (Camp North End) Charlotte, Mecklenburg County Brownfields Project No. 20050-16-060 Dear Mr. Hemmerdinger, The North Carolina Department of Environmental Quality (DEQ) and Camp Landowner, LP recently approved the Amendment to the Notice of Brownfields Property and Amendment to the Brownfields Agreement and Supersession of the Notice of Residual Petroleum (the Amendments). The Amendment was signed and recorded at the Mecklenburg County Register of Deeds Book 36504 Page 613-618. Land Use Restriction No. 8 addresses vapor intrusion for new construction and requires DEQ approval for high density residential use. Redevelopment plans submitted to DEQ Brownfields include high density multifamily and amenities in the central area of Building 3 on the attached figure. A Brownfields Vapor Assessment Report Building 3 Central dated November 15, 2021, prepared by Hart &Hickman, PC was submitted on your behalf to demonstrate no vapor intrusion in this requested area. Assessment activities included soil gas vapor samples collected and analysis by EPA Method TO-15 for volatile organic compounds (VOCs). Based on the analytical results of the soil gas samples and DEQ Risk Calculator hazard risk index, DEQ Brownfields does not object to the proposed high density residential use in the outlined area. Therefore, DEQ Brownfields approves the current redevelopment plan for new construction of high density residential use in the central area of Building 3 as outlined in the report.
