The northeastern portion of the site is developed as an asphalt-paved parking area. The southwestern portion of the site is presently undeveloped grass and gravel covered land that was formerly developed as a four-story Red Carpet Inn and a two- story parking garage (Exhibit 2). The Mecklenburg County GIS website identifies the site as Parcel Nos. 125-175-06 and 125-175-19. The site is currently enrolled in the North Carolina Brownfields Program (NCBP) as Project No. 23070-19-060. MOD CLT Property, LLC (Prospective Developer) plans to redevelop the southwestern portion of the site with a mixed-use high-rise tower consisting of first-floor commercial tenant spaces along Morehead Street, a cast- in-place parking garage, and multi-family residential rental units wrapping the parking deck. The Prospective Developer plans to construct a mid-rise multi-family residential building in the northeastern portion of the site. 1.2 Prior Investigations Numerous subsurface investigations have been conducted at the site since 2000 to investigate impacts related to a release (NCDEQ Incident No. 15278) from an underground storage tank (UST) system formerly located on the adjacent property to the northwest of the site (521 East Morehead Street), as summarized below. The locations of historical soil, groundwater, and soil vapor samples collected on the site are shown in Exhibits 2 and 3, while a summary of analytical results (for compounds detected in at least one historical sample) are provided in Tables 1, 2, and 3. The sources of historical information summarized in this report are provided in the table below. Jones/Rea Construction Company facility. None of the above described borings were located on the site; however, the LAW investigation identified petroleum impacts in both soil and groundwater at the adjacent facility. Groundwater impacts well above the Gross Contaminant Levels (GCLs) were detected (e.g. benzene at a concentration of 10,000 µg/L vs. its GCL of 5,000 µg/L) in a monitoring well located near the shared property boundary with the site. Based on the results of the initial assessment, it appeared likely that the J.A. Jones/Rea Construction Company petroleum release had impacted the 615 Morehead Street site. The results of subsequent investigations at the 615 Morehead Street site are summarized below. All samples referenced below were collected from the 615 Morehead Street site. In 1996, as part of Comprehensive Site Assessment activities in response to the release, LAW collected soil samples B-6, B-7, B-8, and B-11 and installed three permanent monitoring wells (MW-6, MW-7, and MW-10) on the site. Total petroleum hydrocarbon (TPH) concentrations were not identified in the soil samples. Numerous petroleum constituents were identified in MW-6 above both their 2L Standard and their non-residential vapor intrusion groundwater screening levels (VI-GWSLs). Petroleum constituents were not identified above their 2L standards in MW-7 and MW-10 at that time; however the semi-volatile organic compound (SVOC) bis(2-ethylhexyl)phthalate was detected in MW-7 (4.3 µg/L) above its 2L standard (3 µg/L) in MW-7. In 2000, LAW collected additional groundwater samples from MW-6, MW-7, and MW-10. Petroleum concentrations within MW-6 had decreased significantly relative to the past sampling event in 1996; however, multiple compound, including benzene, ethylbenzene, and xylene remained above both their 2L standards and non-residential VI-GWSLs. In 2000, ECS advanced 12 soil borings (P-1 through P-12) in the northwestern portion of the site to evaluate the extent to which contaminated groundwater migrating from the adjacent property had impacted soils at the site. Low level petroleum impacts were identified in soils ranging from 4 to 16 feet bls, with most constituent concentrations below their Preliminary Soil Remediation Goals (PSRGs). Naphthalene was identified between 12 and 16 feet bls in P-1 (1.0 mg/kg), P-2 (2.1 mg/kg), and P-9 (1.1 mg/kg) at concentrations exceeding either its Protection of Groundwater PSRG (0.39 mg/kg) or Residential PSRG (2.1 mg/kg). In addition, ECS installed two temporary monitoring wells (TW-1 and TW-2) and one permanent monitoring well (MW-11) at the site. Petroleum concentrations were not identified above laboratory method detection limits (MDLs) in MW-01. Volatile petroleum hydrocarbons (VPH) above their 2L standards were identified in both TW-1 and TW-2. Benzene, toluene, ethylbenzene, and xylene were identified above both their 2L standards and non-residential VI-GWSLs in TW-2. In 2004, in conjunction with on-going assessment at the adjacent property, S&ME collected a groundwater sample from on-site MW-6. Groundwater concentrations remained elevated, with benzene, ethylbenzene, and xylene remaining above both their 2L Standards and non-residential VI-GWSLs. In 2005, Schnabel completed a geotechnical investigation in advance of planned site redevelopment. Eleven borings were advanced at the site, four of which (B-5, B-8, B-9, and B-10) were selected for environmental evaluation. Soil samples were collected from each of these borings. Temporary monitoring wells (MW-1 through MW-4) were also installed in the borings. Groundwater samples were collected from MW-2, MW-3, and MW-4 as well as existing permanent monitoring well MW-10. Low level petroleum impacts were identified in soils ranging from 13.5 to 20 feet bls; however, none of the detected concentrations exceeded their most conservative PSRGs. Benzene, toluene, ethylbenzene, and xylene were identified above their 2L standards and non-residential VI-GWSLs in MW-2. Benzene was identified in MW-3 above its 2L standard. Methyl tert butyl ether (MTBE) was identified in MW-10 above its 2L standard. Petroleum constituents were not identified above their 2L standards in MW-4. In 2014, Hart & Hickman completed two rounds (January and July) of groundwater sampling at the adjacent property and the site. As part of the first round of sampling, two temporary wells (HTTW-4 and HHTW-5) were installed at the site and sampled along with MW-6. VPH and benzene were identified above their 2L standards in HTTW-4. Ethylene dibromide (EDB) was detected (0.033) above its 2L standard (0.02 µg/L) and trichloroethene (1.1 µg/L) above its residential VI-GWSL (1.0 µg/L) in HTTW-5. During both sampling events, petroleum concentrations in MW-6 were relatively similar to those identified in during the most recent previous sampling events. On February 22, 2017, NCDEQ issued a letter indicating that available data allowed the 521 Morehead Street site to be reclassified as low risk and granted No Further Action status for release incident 15278. 1.3 Purpose of Soil Vapor Evaluation Petroleum impacts have been identified in groundwater above their vapor intrusion groundwater screening levels (GWSLs) in the north-central portion of the site. Soil vapor sampling completed in 2020 by Terracon did not identify concentrations of volatile organic compounds (VOCs) above their residential soil gas screening levels (SGSLs) other than chloroform. Based on review of the historical assessment data, the North Carolina Brownfields Program (NCBP) requested that five additional shallow soil vapor samples be collected at the locations shown on Exhibit 3. The purpose of the additional soil vapor sampling is to confirm the prior soil gas sampling results and to confirm that neither vapor mitigation nor post-construction pre-occupancy testing/on-going monitoring is necessary for the proposed redevelopment. 2.0 SCOPE OF SERVICES The scope of services was conducted in accordance with the Brownfields Work Plan, dated March 12, 2021 and approved by the North Carolina Brownfield Program via email on March 17, 2021. The scope of services included the installation of shallow soil vapor sample points and collection of soil vapor samples for analysis of VOCs as discussed in Section 3.0 below. Technical approaches and methods utilized during the soil vapor investigation were in general accordance with the Interstate Technical and Regulatory Council’s Vapor Intrusion: A Practical Guideline (2007) and Vapor Intrusion Pathway: Investigative Approaches for Typical Brownfields Soil Vapor Evaluation Red Carpet Inn Brownfields Site (No. 23070-19-060) ■ Charlotte, North Carolina May 5, 2021 ■ Terracon Project No. 71197661 Responsive ■ Resourceful ■ Reliable 01671-003/00303622 5 Scenarios (2007), as well as the North Carolina Division of Waste Management (DWM) Vapor Intrusion Guidance (2018). 2.1 Standard of Care Terracon’s services were performed in a manner consistent with generally accepted practices of the profession undertaken in similar studies in the same geographical area during the same time. Terracon makes no warranties, either expressed or implied, regarding the findings, conclusions, or recommendations. Please note that Terracon does not warrant the work of laboratories, regulatory agencies, or other third parties supplying information used in the preparation of the report. The services were performed in accordance with the scope of work authorized by our client, as reflected in our proposal and were not conducted in accordance with ASTM E1903-11. 2.2 Additional Scope Limitations Findings, conclusions, and recommendations resulting from these services are based upon information derived from the on-site activities and other services performed under this scope of work; such information is subject to change over time. Certain indicators of the presence of hazardous substances, petroleum products, or other constituents may have been latent, inaccessible, unobservable, non-detectable, or not present during these services. We cannot represent the site as being free of hazardous substances, toxic materials, petroleum products, or other latent conditions beyond those identified during this investigation. Subsurface conditions may vary from those encountered at specific borings or wells or during other surveys, tests, assessments, investigations, or exploratory services. The data, interpretations, findings, and our recommendations are based solely upon data obtained at the time and within the scope of these services. 2.3 Reliance This report has been prepared for the exclusive use of MOD CLT Property, LLC, its affiliates, and their lenders providing financing for the site. Any authorization for use or reliance by another party (except a governmental entity) is prohibited without the expressed written authorization of MOD CLT Property, LLC and Terracon. Any unauthorized distribution or reuse is at the sole risk of MOD CLT Property, LLC. Reliance by authorized parties, except governmental agencies, will be subject to the terms, conditions, and limitations stated in the Agreement for Services between MOD CLT Property, LLC and Terracon. 3.0 FIELD INVESTIGATION METHODS Terracon conducted the field work under a health and safety plan developed for this project. Work was performed using United States Environmental Protection Agency (USEPA) Level D work attire consisting of a hard hat, safety glasses, safety vest, protective gloves, and protective boots. Brownfields Soil Vapor Evaluation Red Carpet Inn Brownfields Site (No. 23070-19-060) ■ Charlotte, North Carolina May 5, 2021 ■ Terracon Project No. 71197661 Responsive ■ Resourceful ■ Reliable 01671-003/00303622 6 3.1 Utility Location and Site Observations Prior to intrusive activities, Terracon submitted a request to the public utility locator [NC 811] to arrange for location of underground public utilities from the nearby streets to the utility meters. As an added measure of safety, Terracon subcontracted Priority Underground Locating of Huntersville, North Carolina, a private utility locator, to locate and mark public utilities beyond the meter and/or near the proposed boring locations. 3.2 Soil Vapor Sampling Terracon mobilized to the site on March 26, 2021 to conduct the soil vapor assessment. Field notes, boring logs, photographs, and soil vapor purge/sampling logs are provided in Appendix A. Soil Vapor Point Installation Five soil vapor sampling points (2021-SV-01 through 2021-SV-05) were installed at the locations depicted on Exhibit 2. The soil vapor sampling points were installed via direct push technology (DPT) drilling methods to depths ranging from approximately 7.5 to 8 feet below land surface (bls) except for 2021-SV-03, which was installed at a depth of approximately 5.25 to 5.75 feet bls to avoid wet soils observed approximately 6 feet below ground surface within that boring. The sampling points were constructed with six-inch stainless-steel screens with barbed fittings at the top to connect to small bore (0.25 in. O.D.) Teflon® lined sample tubing. A sand filter pack was placed within the annulus to a height of approximately six inches above the screen point. A one- foot thick layer of dry, granular (No. 20) bentonite was placed in the borehole annulus above the sand pack followed by a layer of bentonite hydrated with distilled water to the ground surface. The sample tubing extended from the screen to the surface, where it was capped until the purge/helium tracer test (see below) was conducted. The points were allowed to equilibrate for at least two hours prior to purging and sampling in accordance with standard industry practice for soil vapor points installed by DPT methods. Shut-In and Helium Tracer Testing Prior to sample collection, Terracon conducted shut-in (deadhead) tests of the laboratory- provided sampling equipment and a helium tracer test at each soil vapor point to verify the integrity of the vapor point seal. The shut-in tests were conducted by attaching the laboratory-supplied Summa® canister and flow controller manifold to be used at each point to Teflon® lined tubing and a syringe. The syringe was used to induce a vacuum within the flow controller manifold, at which point, the manifold’s shut-off valve was closed. The Summa® canister and manifold were allowed to sit sealed from the atmosphere for approximately 10 minutes and the pressures within the manifold at the beginning and the end of the shut-in period were recorded and compared. When no loss of pressure was observed during the shut-in test period, the Summa® canister and manifold were deemed suitable for sample collection. The shroud atmosphere was enriched to a helium concentration of approximately 15 percent. At least three volumes of the vapor point annulus and attached Teflon® lined tubing and sample train was purged and directed into a Tedlar bag using a syringe. After each purge volume was collected, the concentration of helium within the Tedlar bag was measured. The sample seal was considered sufficiently sealed if the helium concentration within the Tedlar bag was less than 10% of the concentration of helium within the shroud. During the helium tracer tests for 2021-SV-01, 2021-SV-02, 2021-SV-04, and 2021-SV-05, concentrations of helium were not measured within the Tedlar bag. During the helium tracer test for 2021-SV-03, concentrations of helium were measured within the Tedlar bag; however, the concentrations measured within the Tedlar bag for were less than 5% of the shroud concentration. As such, the seal at 2021-SV-03 was considered sufficiently sealed. Sample Collection After completion of the shut-in and helium tracer tests, samples were collected within batch- certified 1.0-liter Summa® canisters equipped with flow controllers restricting the air flow rate to less than approximately 200 mL/min. One blind duplicate sample was collected at 2021-SV-02. The vacuum pressure of each sample canister was monitored and recorded at regular intervals throughout the sampling period. The sample periods were ceased prior to the vacuum pressure within each Summa® canister reaching 0 mmHg. After completion of soil vapor sampling activities, the sample points were abandoned by removal of the tubing. Following completion of the field activities, the Summa® canisters, along with chain-of-custody documentation, were shipped to Con-Test Analytical Laboratories (now a member of the Pace National laboratory network) in East Longmeadow, Massachusetts for laboratory analysis of VOCs by EPA Method TO-15. Con-Test was instructed to record the pressure within the Summa® canisters upon receipt. 4.0 ANALYTICAL RESULTS 4.1 Soil Vapor Sample Results The laboratory analytical results for the soil vapor samples were compared to the NCDEQ Residential and Non-Residential Soil Gas Screening Levels (SGSLs), dated January 2021. Numerous VOCs were detected above laboratory method detection limits in each of the soil vapor samples; however, none of the detected concentrations exceed their Residential SGSL. Trichloroethylene (TCE), was identified in 2021-SV-04 at a concentration (1.3 μg/m3) an order of magnitude below its Residential SGSL (14 μg/m3). A summary of the 2021 soil vapor analytical results is included in Table 4. A copy of the laboratory analytical report is provided in Appendix B. Brownfields Soil Vapor Evaluation Red Carpet Inn Brownfields Site (No. 23070-19-060) ■ Charlotte, North Carolina May 5, 2021 ■ Terracon Project No. 71197661 Responsive ■ Resourceful ■ Reliable 01671-003/00303622 8 4.2 NCDEQ Risk Calculator Terracon evaluated the cumulative carcinogenic risk and the non-carcinogenic hazard index for future occupants of the property by entering the maximum concentrations for each compound detected in soil vapor using the most recent version (January 2021) of the NCDEQ Brownfields Risk Calculator. The calculated risks are summarized in the table below, which also includes the results from the risk evaluation conducted during Terracon’s 2020 soil vapor assessment, as documented in the Limited Site Investigation Report, dated April 29, 2020: Residential Non-Residential Sampling Event Carcinogenic Hazard Index Carcinogenic Hazard Index 2020 2.6 x 10-6 5.7 x 10-2 2.0 x 10-7 4.5 x 10-3 2021 2.0 x 10-6 5.1 x 10-2 1.5 x 10-7 4.0 x 10-3 Unacceptable risks to future site occupants due to the soil gas to indoor air exposure pathways were not identified at the site, as the calculated risks are two to three orders of magnitude below the target cumulative risk thresholds of 1x10-4 (carcinogenic) and 1 (hazard index). A copy of the NCDEQ Risk Calculator summary sheets is included in Appendix C. 5.0 CONCLUSIONS Based on the scope of services described in this report and subject to the limitations described herein, Terracon provides the following conclusions. ▪ Numerous VOCs were detected in each of the soil vapor samples; however, none of the detected concentrations exceeded their Residential SGSLs. ▪ Trichloroethylene (TCE) was identified in 2021-SV-04 at a concentration (1.3 μg/m3) an order of magnitude below its Residential SGSL (14 μg/m3). This compound has not previously been identified within groundwater in this portion of the site. Extensive groundwater assessment has been completed at the site, and the sole TCE identified at the site (HTTW-5 in 2014) was detected at a low concentration (1 µg/L). In addition, TCE has not been detected in soils at the site. Based on the above, there does not appear to be widespread TCE impacts at the site. It should also be noted that TCE was not detected at any other of the nine soil vapor sample locations collected at the site during the 2020 and 2021 soil vapor sampling events. Brownfields Soil Vapor Evaluation Red Carpet Inn Brownfields Site (No. 23070-19-060) ■ Charlotte, North Carolina May 5, 2021 ■ Terracon Project No. 71197661 Responsive ■ Resourceful ■ Reliable 01671-003/00303622 9 ▪ The risks associated with the soil vapor concentrations detected during the 2020 and 2021 sampling events, as determined via the NCDEQ Risk Calculator, are two to three orders of magnitude below the target cumulative risk thresholds of 1x10-4 (carcinogenic) and 1 (hazard index). Based on the detected soil vapor concentrations, the NCDEQ SGSLs, the NCDEQ Risk Calculator results, and the NCDEQ Vapor Intrusion Guidance (2018), vapor mitigation and/or post-construction testing/monitoring is not necessary for the proposed redevelopment.
