1.0 Introduction
On behalf of Tapestry Tyvola LLC, Hart & Hickman, PC (H&H) has prepared this Annual
Redevelopment Summary to document redevelopment activities at the Dick Keffer Pontiac Buick
GMC Brownfields property located at 1001 Tyvola Road and 450 Minuet Lane in Charlotte,
Mecklenburg County, North Carolina (Site). A Site location map is provided as Figure 1, and a
Site map is provided as Figure 2. The Site is in the North Carolina Department of Environmental
Quality (DEQ) Brownfields Program (Brownfields Project #23064-19-060).
Construction activities at the Site are ongoing and are being conducted under a DEQ Brownfields
Program approved Environmental Management Plan (EMP) dated June 9, 2020. The purpose of
this annual summary is to document environmental-related construction activities that were
conducted at the Site since approval of the EMP.

2.0 Redevelopment Activities
The Site is being redeveloped with a multi-family apartment community known as Tapestry
Tyvola, which consists of four multi-family apartment buildings comprising 297 for-rent units, a
leasing office, and associated amenities. Current construction activities include utility and
stormwater installation, and grading. A Site photographic log is included in Appendix A.
2.1 Asbestos Abatement
H&H completed an asbestos survey on the former dealership buildings at the Site in January 2020.
The results of the survey indicated the presence of category I non-friable asbestos containing
building materials (ACBMs) in the former main dealership building, including select floor tile,
floor mastic, and roofing materials. Prior to demolition of the former dealership structures, an
asbestos abatement was performed by RPI, Inc., a licensed asbestos removal contractor. The non-
friable ACBMs were removed using hand tools and containerized in a lined and covered roll-off
dumpster. The roll-off dumpster was transported to the Charlotte Motor Speedway Landfill in
Concord, North Carolina for disposal. Asbestos closure documentation is included in
Appendix B.
2.2 Demolition and Clearing Activities
Following asbestos abatement, dealership structures were razed, and paved surfaces were
removed. Debris was loaded onto trucks as demolition activities progressed or stockpiled for off-
Site disposal. Land clearing activities have been conducted in formerly undeveloped portions of
the Site.

2.3 Environmental Assistance
As stipulated in the DEQ-approved EMP, H&H remains on-call should any unexpected
environmental conditions (i.e. previously unidentified UST, buried debris, soil staining, drums,
etc.) be encountered during construction activities.
H&H received a call from Site construction personnel on June 23, 2021, that a large metal box and
plastic tote had been uncovered in an asphalt paved parking area that had been heavily overgrown
with kudzu. H&H subsequently mobilized to the Site on June 23, 2021 to observe the conditions.
The metal box and plastic tote contained 65 5-gallon pails of used motor oil and roofing tar. Some
of the pails were labelled with the contents, but all were found to contain either motor oil or roofing
tar. The pails were sealed and stacked within the metal box and plastic tote. H&H did not observe
staining or obvious evidence of a potential release in the vicinity of the pails. The DEQ
Brownfields project manager, Mr. Pete Doorn, was immediately notified regarding the containers,
and informed of the planned disposal. Because the containers were staged on a paved surface and
no evidence of a spill or release was observed, further assessment actions were not warranted.
H&H contracted EVO Corporation, a licensed waste disposal contractor, to remove and dispose
of the metal box, plastic tote, pails, and pail contents. Select pails were deemed unsuitable for
transport, and were overpacked into drums prior to transport from the Site. The used oil was
removed from the pails by a vacuum truck prior to transport. Certificates of disposal and non-
hazardous waste manifests are included in Appendix C.
No other unexpected environmental conditions have been encountered during
construction activities at the Site, and H&H remains on call should such conditions be observed
in the future.

3.0 Summary
On behalf of Tapestry Tyvola LLC, H&H has prepared this Annual Redevelopment Summary to
document environmental-related activities completed at the Dick Keffer Pontiac Buick GMC
Brownfields property. A summary of the environmental-related activities conducted at the Site
since approval of the EMP is presented below:
•Prior to demolition of the former dealership structures, an asbestos abatement was
performed by a licensed asbestos removal contractor. The non-friable ACBMs were
removed using hand tools and containerized in a lined and covered roll-off dumpster. The
roll-off dumpster was transported to the Charlotte Motor Speedway Landfill in Concord,
North Carolina for disposal.
•Construction activities at the Site are being conducted under a DEQ Brownfields Program

condition was encountered in June 2021 which involved the uncovering of two large
containers in an overgrown parking lot at the Site. The containers held 65 5-gallon pails
of used motor oil and roofing tar. The pails were sealed and stacked within the larger
containers. H&H did not observe staining or obvious evidence of a potential release in the
vicinity of the pails and the pails were staged on a paved surface; therefore, no further
assessment was deemed warranted. H&H contracted a licensed waste disposal company,
to remove and dispose of the metal box, plastic tote, pails, and pail contents.
•No other unexpected environmental conditions have been encountered during construction
activities at the Site, and H&H remains on call should such conditions be observed in
the future.

• H&H has made periodic Site visits for the purpose of documenting Site redevelopment
activities and progress. As of our most recent Site visit, conducted on July 14, 2021,
ongoing construction activities include utility and stormwater installation, and grading.

Asbestos Abatement Complete
(Removal/ Disposal of Asbestos Material –Report; Hart Hickman 1/31/20)
This letter serves as Documentation that the Asbestos Material; ( Non-Regulated ACM’s) for
the address listed above were properly removed under EPA Regulation 40 CFR 61, subpart
M, National Emission Standard for Hazardous Air Pollutants (NESHAP) and in accordance
with the Osha Asbestos Standard ( 29 CFR 1926.1101) which regulates exposure to
asbestos in the work place for Employees.
The ACM’s or Asbestos Containing Materials that are listed in Hart Hickman Report/ Survey(
Roofing, flashing, flooring ) were Abated/Removed and disposed of from the address listed
above on 9/15/20 by ;NC Accredited and Licensed Employees. All Asbestos Materials were
double packaged/bagged and or wrapped in 6 Mil poly (asbestos Labeled Bags), and have
or will be Loaded, Transported to CMS Landfill in Concord, NC. Where the ACM materials will
be or were properly disposed of.
