Hope you’ve had a nice week. As discussed, I am providing the following in connection with the
DPLUR on the Kaiser Fluids site:

1. Recorded corrective deed referencing the DPLUR in connection with the most recent land
transfer; and
2. Statement affirming the current owner’s compliance with the restrictions set forth in the
DPLUR.

Please let me know if you would like hard copies of either of these documents. Also, we are
finalizing our minor revisions to the draft brownfields agreement and will send those over to you as
soon as possible (we are mindful of your impending vacation).
