This request was submitted on your behalf by Mr. Eric Wysong of Apex Engineering, LLC (Apex). DEQ understands the redevelopment on the Matheson Ave Brownfields Properties will be done jointly under the DEQ-approved Environmental Management Plan (EMP) dated November 26, 2019. DEQ Brownfields reviewed the soil analytical data provided in the Brownfields Export Soil Assessment Report Addendum dated May 3, 2021 prepared by Apex. Based on our review of the data, DEQ Brownfield’s agree that these soils may be exported as outlined in the table below. Per the Matheson Ave EMP, the soils will be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, in accordance with the approved EMP, annual Redevelopment Summary Reports will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but not limited to, total volume, general description of field screening efforts, etc. should be included with each Property’s Redevelopment Summary Report. This report documents sampling activities conducted prior to a proposed soil export at the Brownfields sites located at 255 Matheson Avenue in Charlotte, North Carolina (the “Site”) (Figure 1). On February 4th, 2019 and July 12th, 2019 Notices of Brownfields Property (NBP) were filed for the Site to be developed for multi-family residential use and for development of a recreational Greenway (Matheson Ave II and Matheson Ave Creek, respectively). Planned development includes several multi-level residential buildings, associated amenities, a paved recreational path, and a bridge over Little Sugar Creek. The Brownfields projects are being developed concurrently under an Environmental Management Plan (EMP), approved and signed by the North Carolina Department of Environmental Quality (NCDEQ) on November 27, 2019. Redevelopment activities at the Site commenced in April 2020 and have consisted of land-clearing, grading, construction of structural walls, construction of a bridge over Little Sugar Creek, utility work, and initial construction of building foundations and split-walls. Soil that is unsuitable for re-use due to geophysical properties has been generated from three general areas in the southern portion of the Site from the excavation of soil around a sewer utility installation and at the base of structural walls. See Figure 2 depicting the approximate locations of the soil excavations and the resulting soil stockpile area. The stockpiled soil was determined not suitable for re-use at the Site due to geophysical properties. Approximately 1,500 cubic yards of the stockpiled soil was characterized for proposed export to the Reeves Land Clearing and Inert Debris (Reeves LCID) landfill located at 2323 Salome Church Road in Charlotte, North Carolina as documented in an April 1, 2021 dated Brownfields Export Soil Assessment Report. Upon review of the Brownfields Soil Assessment Report, the NCDEQ approved export of the characterized soil to Reeves LCID in an April 2, 2021 dated approval letter. The soil was subsequently transported to Reeves LCID. However, approximately 3,000 cubic yards of soil remained in the Site as it was anticipated the soil could be reused in non-structural applications throughout the Site. Upon further review, it has been determined that the soil could not be re- used onsite and will also require export. As such, the following report addendum documents characterization activities performed on the remaining 3,000 cubic yards of soil. Assessment activities were performed in accordance with the approved EMP following the characterization requirements and analytical program as outlined in Part 1.A. Number 4 of the approved EMP. Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 2 2.0 SOIL SAMPLING ACTIVITIES On April 7, 2021, Apex conducted soil sampling activities in accordance with the NCDEQ approved EMP and in general accordance with the NCDEQ IHSB Guidelines for Assessment and Cleanup of Contaminated Sites dated January 2020. The methodology and results are summarized in the following sections. 2.1 Sampling Methodology The stockpile area was surveyed by the onsite grading contractor and determined to comprise a total of approximately 3,000 cubic yards of soil. The general locations of the excavated material source areas and stockpile area are identified on the attached Figure 2. The stockpile area was divided in thirds (SP-03, SP-04, and SP-05), each of which comprise an estimated 1,000 cubic yards of soil. Each of the three areas was further divided into four approximately equally sized quadrants based on a visual evaluation (SP-03a through SP-03d, SP-04a through SP-04d, and SP-05a through SP-05d). At each quadrant, one grab soil sample was collected at depths ranging from approximately two to six feet into the stockpile using a decontaminated stainless-steel hand auger and an onsite track-mounted excavator. Each of the grab soil samples were field screened for the presence of odor, staining, and elevated photoionization detector (PID) readings. The stockpiled material was observed to consist primarily of soil with some rock and woody vegetation included. A faint “rotten” odor was noted during sampling, which is attributed to decay of organic material within the moist stockpiles. No distinctive odors of an environmental concern were noted, such as petroleum or solvent odors, and no staining was observed. There were no PID detections in any of the SP-03 grab samples. PID readings ranged from non-detect to 0.1 parts per million (ppm) in the SP-04 grab samples and non-detect to 0.2 ppm in the SP-05 grab samples. The deepest grab sample from SP-03 and the grab samples with the highest PID detections from SP-04 and SP-05 were selected and placed in laboratory-supplied sample containers, labeled, and placed in a laboratory supplied cooler with ice. The samples were then hand delivered to Pace Analytical in Huntersville, North Carolina under standard chain-of-custody protocol for analysis of volatile organic compounds (VOCs) by EPA Method 8260D, preparation Method 5035. After the selected VOC soil sample from each of the three stockpiles was collected and prepared, the four grab soil samples from each stockpile were composited into one composite soil sample per stockpile using a decontaminated stainless-steel bowl and spoon. The three composite soil Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 3 samples were placed in laboratory-supplied sample containers, labeled, and placed in a laboratory supplied cooler with ice. The samples were then hand delivered to Pace Analytical in Huntersville, North Carolina for analysis of semi-volatile organic compounds (SVOCs) by EPA Method 8270E, hexavalent chromium by EPA Method 7199, metals (arsenic, barium, cadmium, total chromium, lead, manganese, selenium, and silver) by EPA Method 6010D, mercury by EPA Method 7471B, and Synthetic Precipitation Leaching Procedure (SPLP) by EPA Method 1312 followed by manganese analysis of the leachate by EPA Method 6010D. The SPLP and additional manganese analysis of the leachate was performed as an added measure due to the proposed export of the soil to an unlined landfill. As an added quality control measure, one duplicate soil sample (SP-DUP) was collected from the SP-05 stockpile soil sample and analyzed for the same parameters as the parent sample. 2.2 Analytical Results The soil sample results were compared to the January 2021 NCDEQ Preliminary Soil Remediation Goals (PSRGs) for Protection of Groundwater (PoG), Residential Health-Based Direct Contact (Residential), and Industrial/Commercial Health-Based Direct Contact (Industrial/Commercial). The results of the manganese analyses on the SPLP leachates were compared to the 15A NCAC 2L Groundwater Quality Standard (2L Standard) for manganese. The analytical detections are summarized as follows: VOCs Laboratory analytical detections of VOCs are summarized as follows: • Cyclohexane, ethylbenzene, methylcyclohexane, toluene, and xylenes were detected in the sample collected from SP-03, all at concentrations below applicable PSRGs. No other VOCs were detected in SP-03; • No VOCs were detected in the sample collected from SP-04; • Acetone, 2-butanone, ethylbenzene, and toluene were detected in the sample collected from SP-05, all at concentrations below applicable PSRGs. No other VOCs were detected in SP-05; and, • Acetone, ethylbenzene, and toluene were detected in the duplicate sample collected from SP-05 (SP-DUP), all at concentrations below applicable PSRGs. No other VOCs were detected in SP-DUP. Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 4 SVOCs Laboratory analytical detections of SVOCs are summarized as follows: • No SVOCs were detected in the samples collected from SP-03, SP-04, or the duplicate sample collected from SP-05 (SP-DUP); and, • Benzo(a)anthracene, benzo(a)pyrene, benzo(b)fluoranthene, chrysene, fluoranthene, phenanthrene, and pyrene were detected in the sample collected from SP-05. All detected concentrations were below applicable PSRGs with the exception of benzo(a)pyrene, which was detected at an estimated J-flagged concentration of 0.224 milligrams per kilogram (mg/kg), exceeding the Residential and PoG PSRGs of 0.11 mg/kg and 0.12 mg/kg respectively. No other SVOCs were detected in SP-05. Metals Laboratory analytical results did not identify detectable concentrations of silver in any of the four samples (SP-03, SP-04, SP-05, and SP-DUP). Several metals were detected in each of the samples, summarized as follows: • Arsenic concentrations ranged from an estimated J-flag concentration of 0.77 mg/kg at SP-04 to 2.0 mg/kg at SP-05. All detected concentrations of arsenic exceeded the Residential PSRG but were below Industrial/Commercial and PoG PSRGs; • Barium concentrations ranged from 75.3 mg/kg at SP-04 to 90.2 mg/kg at SP-03. All detected concentrations of barium were below applicable PSRGs; • Cadmium concentrations ranged from non-detect at SP-04 to 0.092 at SP-05. All detected concentrations of cadmium were below applicable PSRGs; • Total Chromium concentrations ranged from 38.1 mg/kg at SP-05 to 54.8 mg/kg at SP-03. Hexavalent chromium was detected in SP-03 at an estimated J-flagged concentration of 0.636 mg/kg, which exceeded the Residential PSRG but was below Industrial/Commercial and PoG PSRGs. Hexavalent chromium was not detected in any other sample and all detected concentrations of total chromium were below applicable PSRGs for trivalent chromium; • Lead concentrations ranged from 9.8 mg/kg at SP-04 to 16.1 mg/kg at SP-05. All detected concentrations of lead were below applicable PSRGs; Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 5 • Manganese concentrations ranged from 482 mg/kg at SP-05 to 636 mg/kg at SP-03. All detected concentrations of manganese exceeded the Residential and PoG PSRGs, but are below the Industrial/Commercial PSRG; • Mercury concentrations ranged from 0.042 mg/kg at SP-03 to 0.068 mg/kg at SP-05. All detected concentrations of mercury were below applicable PSRGs; • Selenium concentrations ranged from 1.9 mg/kg at SP-05 to 2.0 mg/kg at SP-03, SP-04, and SP-DUP. All detected concentrations of selenium were below applicable PSRGs; and, • Concentrations of manganese in the leachate following the SPLP were below the 2L Standard of 50 micrograms per liter (µg/L) in SP-03 (13 µg/L), SP-04 (39 µg/L), and SP-05 (38 µg/L). However, the concentration of manganese in the leachate from the SP-05 duplicate sample (SP-DUP) was reported at 61 µg/L, exceeding the 2L Standard of 50 µg/L. The analytical detections for the prior export soil sampling conducted in February 2021 (SP-01 and SP-02) were generally consistent with the analytical detections for the additional stockpile samples analyzed in April 2021 (SP-03, SP-04, and SP-05) with the exception of the SVOC detections in SP-05. The stockpiles associated with SP-01 and SP-02 were exported to Reeves LCID in April 2021 under the April 2, 2021 dated NCDEQ approval. The soil associated with all five stockpile samples were generated from the same general areas of the Site as show on Figure 2 and the analytical detections for all five stockpiles are summarized in Table 1. The complete laboratory analytical report for SP-03 through SP-05 is included as Appendix A. 2.3 Risk Calculation In anticipation of a potential transfer to the Reeves LCID facility, the analytical data collected from the soil proposed to be exported from the Site were compared to background metals concentrations at the Reeves LCID (data obtained from Hart & Hickman’s Soil Management Options Letter Report dated August 7, 2020; Manganese data provided February 19, 2021). Metals concentrations between the Site and the Reeves LCID are generally similar and within the range of expected naturally occurring concentrations. Concentrations of all metals except for manganese and hexavalent chromium were slightly higher at the Reeves LCID than in the Matheson Site soil. The metals results for the Matheson Site soils (SP-01 through SP-05) and the prior Reeves LCID data are summarized in the attached Table 2. Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 6 The analytical results were further evaluated using the NCDEQ Risk Calculator (January 2021 version) by entering the highest concentrations of each VOC and SVOC detected in the February and April 2021 stockpile sampling events and the highest concentration of each metal shown on Table 2 to evaluate the risk associated with the proposed transfer of these soils (SP-03, SP-04, and SP-05) combined with previously exported soils (SP-01 and SP-02) and reported metals concentrations at the Reeves LCID. The risk calculator was used to evaluate the carcinogenic and non-carcinogenic risks for residential direct contact, non-residential worker direct contact, and construction worker exposure scenarios. The NCDEQ acceptable threshold for cumulative carcinogenic risk is typically 1.0 x 10-4 and the acceptable threshold for cumulative non- carcinogenic hazard is a hazard index equal to or less than 1.0. The results of the risk calculator indicate the following: • Residential direct contact with soil: o Cumulative carcinogenic risk of 8.9 x 10-6 o Cumulative hazard index of 5.4 x 10-1 • Non-residential worker direct contact with soil: o Cumulative carcinogenic risk of 1.2 x 10-6 o Cumulative hazard index of 3.7 x 10-2 • Construction worker direct contact with soil: o Cumulative carcinogenic risk of 3.6 x 10-7 o Cumulative hazard index of 3.6 The results of the risk calculations indicate that calculated carcinogenic risk and non-carcinogenic hazard for the worst-case scenario based on the February and April 2021 analytical results from the Site combined with the Reeves LCID metals data are well below typical thresholds set by NCDEQ for residential direct contact and non-residential worker direct contact exposure scenarios. The construction worker direct contact cumulative hazard index is calculated at 3.6, a result is largely driven by manganese concentrations that are presumed to be naturally-occurring. Furthermore, construction worker exposure at the Reeves LCID is not considered a likely exposure scenario once the soils have been placed. The output sheets from the NCDEQ Risk Calculator are included as Appendix B. Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 7 3.0 DISCUSSION Several VOCs and SVOCs were detected within the samples, all at concentrations below applicable PSRGs, with the exception of benzo(a)pyrene at SP-05. The SP-05 sample contained low concentrations of several SVOCs, all of which are polycyclic aromatic hydrocarbons (PAHs). The PAHs detected in SP-05 are ubiquitous in urban environments as they form from the incomplete combustion of organic materials such as coal, petroleum, and wood. Apex noted limited amounts of woody debris and rock in the soil stockpiles, but no staining, coal, petroleum odors, or partially burned materials were noted at the time of sampling. Based on the detection of several PAHs in the SP-05 sample but not in the associated duplicate sample, the PAH impacts to SP-05 are considered to be minimal in extent. Furthermore, cumulative risk calculations including the highest reported concentrations of VOCs, SVOCs, and metals in all stockpile samples fall below applicable risk thresholds for a residential exposure scenario, suggesting no unacceptable risk is present for direct contact with this soil in a residential setting. However, no SVOC data is available for the Reeves LCID and export of the SP-05 soil to Reeves LCID would pose a risk of introducing a new contaminant at concentrations above applicable PSRGs, specifically benzo(a)pyrene above its Residential and PoG PSRGs. Arsenic and manganese were detected at concentrations exceeding the Residential and/or PoG PSRGs in all samples and hexavalent chromium was detected at a concentration exceeding the Residential PSRG in one sample (SP-03). The detected concentrations of arsenic and manganese are consistent with data previously collected throughout the Site and are within the range of expected background concentrations for the area. Although the J-flagged hexavalent chromium detection in the SP-03 sample (0.636 mg/kg) is slightly higher than the highest detection from the Reeves LCID (J-flagged 0.43 mg/kg), three of the five Reeves LCID samples contained hexavalent chromium and only one of the five Matheson Site stockpile samples contained hexavalent chromium. All hexavalent chromium detections from Reeves and Matheson Site were estimated J-flagged results. Furthermore, there were no exceedances of the hexavalent chromium PoG PSRG and the results of the risk calculator indicated cumulative risks for residential and non-residential direct contact exposure scenarios are below applicable thresholds. No other metals were detected at concentrations above PSRGs. The concentrations of manganese detected in the SPLP leachates were below the applicable 2L Standard in all of the samples with the exception of the SP-DUP sample. The mean average of manganese concentration in leachate for SP-05 (38 µg/L) and the associated SP-DUP (61 µg/L) Brownfields Export Soil Assessment Report – Addendum May 3, 2021 Matheson Ave II Page 8 calculates to be 49.5 µg/L, which is below the 2L Standard of 50 µg/L. Therefore, risk to groundwater from leaching of manganese is not considered to be a concern with the Matheson Site soil. 4.0 CONCLUSIONS Apex has completed export soil sampling activities at the Matheson Ave Brownfields properties located at 255 Avenue in Charlotte, North Carolina. Sampling included collection of three stockpile samples (SP-03, SP-04, and SP-05) and one duplicate sample (SP-DUP) to characterize Site soil for proposed offsite export to the Reeves LCID. The results of the export soil sampling activities have identified low concentrations of VOCs and SVOCs below applicable PSRGs, with the exception of benzo(a)pyrene in SP-05. Several metals were detected within soil samples at concentrations within the expected range of naturally occurring background levels and comparable to prior data available for Reeves LCID. The analytical results of this assessment and the results from prior soil assessment at the Site (February 2021; SP-01 and SP-02) were evaluated using the NCDEQ Risk Calculator by entering the highest concentration for each of the detected VOCs and SVOCs at the Site and the highest metals concentrations from the combined dataset, which also includes prior Reeves LCID metals data. Based on the results of the risk calculations, the cumulative carcinogenic and non- carcinogenic risk were determined to be below acceptable limits for direct contact soil exposure scenarios including resident and non-residential worker. Additionally, SPLP analysis of manganese in the Matheson Site stockpile samples show that manganese is not expected to leach from this soil at a concentration great enough to create a groundwater quality concern. Although results from the NCDEQ Risk Calculator indicate no unacceptable risk exists for export of soil from SP-03, SP-04, and SP-05 to the Reeves LCID, export of soil from SP-05 to Reeves LCID could result in the introduction of a new contaminant above its applicable PSRGs, specifically benzo(a)pyrene. Based on the data available, Apex does not recommend export of soil from SP-05 to the Reeves LCID. Based on the results of this assessment, export of soil from SP-03 and SP-04 should pose no unacceptable risk to the Reeves LCID. As such, Apex requests NCDEQ approval for the export of up to 2,000 cubic yards of soil from SP-03 and SP-04 to the Reeves LCID.
