1.0 Introduction

Hart & Hickman, PC (H&H) is pleased to present this proposal for environmental services to be
performed for the University Place Mall property located at 201 South Estes Drive in Chapel
Hill, Orange County, North Carolina (Site). Prior site assessment activities identified evidence
of releases in the area of the underground hydraulic lifts (UHLs) at the Chapel Hill Tire (CHT)
facility. Based on discussions with NC Department of Environmental Quality (NCDEQ)
Underground Storage Tank (UST) Section staff, the following additional activities will be
required prior to issuance of no further action (NFA) status for the UHL release incident:
• Proper closure of the UHLs
• Completion of a receptor survey
• Filing of a Notice of Residual Petroleum (NORP) and associated survey plat limiting
land -use in the area of the CHT facility to non-residential

H&H's proposed scope of work to complete the activities required by the UST Section is
outlined in the following sections.
2.0 Scope of Work
Task No. 1 — UHL Closure
UST Section staff indicated that abandonment in -place would be an acceptable method of
closure for the UHLs. Based on previous Site observations, two of the UHLs located at the Site
have previously been abandoned. Therefore, this proposal covers costs associated with
abandonment of the remaining four UHLs. H&H will subcontract Hazmat Emergency Response
and Remediation, Inc. (HERR) to conduct UHL abandonment activities. H&H will coordinate
with CHT personnel to obtain approval for the proposed schedule for field activities.
Prior to conducting the UHL abandonment activities, H&H will contact North Carolina 811, the
public utility locator, as well as utilize a private utility locate to screen the UHL areas for
subgrade utilities. H&H will also prepare a site -specific Health and Safety Plan in accordance
with Occupational Safety and Health Administration (OSHA) requirements.
At each of the UHL locations, HERR will remove a center bolt located on the top portion of the
piston. Once the bolt has been removed, the piston will be lifted from the outer casing. The
outer casings will be pressure washed to remove residual hydraulic fluid and pumped via
vacuum truck. Additionally, each of the pistons removed will be pressure washed and allowed to
drain of potential residual fluids. The fluids generated from rinsing the pistons will be disposed
of in the vacuum truck. Once the pistons have been removed and the cylinders rinsed, HERR

will fill each casing with 3,500 pounds per square inch (PSI) concrete to the ground surface.
Upon completion of UHL abandonment activities, HERR will transport the UHL pistons for
disposal at a metal salvage yard. The fluids generated during abandonment activities will be
transported off -site for disposal as non -hazardous material. H&H expects UHL abandonment
activities to take approximately two days.
At the conclusion of the UHL abandonment activities, H&H will prepare a report documenting
the abandonment for submittal to the UST Section. The report will contain a discussion of the
UHL abandonment procedures, disposal manifests, and photographs documenting field
activities.
Task No. 2 — Receptor Survey
H&H will conduct a receptor survey in accordance with UST Section Requirements. The
receptor survey will document potential water supply wells, public water supplies, surface water,
wellhead protection areas, site hydrogeology, and subsurface structures. The survey will include
a desktop review of publicly available information and reporting of field observations collected
during the prior Brownfields receptor survey. A mailing to property owners within 500 feet of
the site inquiring about water supply wells will also be performed in accordance with UST
Section requirements. The results of the receptor survey will be incorporated into the UHL
Abandonment Report to be completed under Task 1.
Task No. 3 — NORP and Survey Plat
A NORP will be prepared in accordance with UST Section guidelines. The NORP will consist
of a document specifying perpetual LURs required as part of the site closure activities. Based on
discussions with UST Section personnel, the only LUR expected to be required in the NORP is a
restriction limiting land -use to industrial/commercial purposes within the footprint of the CHT
facility. A survey plat must also be prepared in conjunction with the NORP detailing the

location where the LUR will be applied. H&H understands that the client recently obtained a
survey plat for the property prior to the recent property purchase. H&H will work with the
client's surveyor to modify the survey plat to meet the requirements of the UST Section. Note
that costs for the surveyor are not included in this proposal and H&H assumes that the client will
pay the surveyor directly.
Upon completion, H&H will provide the draft NORP and survey plat to Ram and then NCDEQ
for review. After approval by Ram and NCDEQ, H&H will coordinate with Ram and NCDEQ
to obtain the required notarized signatures from both entities on the documents. Once the fully
executed documents are obtained, H&H will file the NORP and associated survey plat with the
Orange County Register of Deeds. H&H assumes that one visit to the Register of Deeds will be
required to complete the filing. H&H will request that the Orange County Register of Deeds
provide a certified copy of the filing. The certified copy of the filing will be submitted to
NCDEQ with a copy to Ram for their records.
Once NCDEQ receives the certified copy of the filing, H&H expects that they will issue a
conditional NFA letter which is contingent on completion of public notification and monitoring
well abandonment activities, as described further below.
Task No. 4 — Public Notification
The NFA letter issued by NCDEQ is expected to require public notification of the site closure.
The public notification activities consist of sending a copy of the NFA letter to contiguous
property owners and public officials via certified mail. H&H will complete the require mailings,
then provide delivery confirmation of the mailings to NCDEQ.

Task No. 5 — Monitoring Well Abandonment
One monitoring well exists in the area of the CHT facility that was installed during investigation
of a historical waste oil release. Although the monitoring well is not specifically associated with
the UHL release, H&H recommends proper abandonment of the well.
H&H will contract a NC -certified well driller to abandon the monitoring well in accordance with
NCDEQ requirements. The well will be abandoned by filling the screen and casing with grout
using a tremie pipe. The well pad will be removed and the surface will be finished with asphalt
patch or painted concrete to generally match the surrounding area.
H&H will prepare a letter report documenting the well abandonment activities for submittal to
the NCDEQ. The report will include a brief summary of the abandonment activities and a well
abandonment record.
3.0 Estimated Cost
H&H proposes to conduct the proposed activities on a time and materials basis for the estimated
costs summarized below.

The UHL closure and receptor survey activities will be completed within three weeks of
authorization to proceed, pending subcontractor availability and CHT agreement with the
proposed schedule. A report documenting the UHL closure and receptor survey will be
completed within two weeks following completion of field activities. The schedule for the
remaining activities will be dependent on NCDEQ response timeframes.
The activities will be conducted in accordance with the previously agreed upon Professional
Services Agreement (PSA) between Ram and H&H. In order to authorize these services, please

AUTHORIZATION
The scope of work and costs presented in H&H's Proposal No. 19-431 and the terms and
conditions of the previously agreed upon Professional Services Agreement are acceptable. H&H
is authorized to proceed with the scope of work.
