Environmental Current Use of Property: Residential Structures on Property: Existing Structures Violation: Yes Vapor Mitigation Systems: Not Observed Vapor Mitigation Violation: No Use of Surface Water or Groundwater: Not Observed Water Use Violation: No Summary: N/A Summary: N/A Summary: Inspection completed for a portion of the Brownfields Property (owned by Spencer’s Mill Ventures LLC). Former mill building converted into 65-unit apartment complex. Apartment leasing began May 2020, and approximately 90% of units leased at the time of the Site Inspection. Apartments occupied prior to DEQ determining they were protective of public health which is a violation of Land Use Restriction (LUR) #11; “No enclosed building may be constructed on the Brownfields Property and no existing building, defined as those depicted on the plat component of this Notice, may be occupied until DEQ determines in writing that: a. the building is or would be protective of the building's users, public health and the environment from risk of vapor intrusion based on site assessment data or a site- specific risk assessment approved in writing by DEQ;” Further, note that the building was occupied without DEQ’s fore-knowledge and it was through the consultant and subsequent conversations and this site inspection that occupancy was confirmed. Final grade sampling of non-hardscaped areas had not been performed prior to the Site Inspection nor prior to the developer initiating occupancy of the Brownfields Property, which is a violation of LUR #10; “No use of the Brownfields Property may occur until the then owner of the Brownfields Property conducts representative final grade soil sampling pursuant to a plan approved in writing by DEQ of any area of the Brownfields Property that is not covered by building foundations, sidewalks, or asphaltic or concrete parking areas and driveways unless otherwise approved in writing by DEQ in advance”. Summary: Residential units, leasing office, and communal space located either below, or partially below grade. Pre-occupancy sampling has not been performed, and a Redevelopment Summery Report has not been submitted (violation of LUR #11). Summary: N/A Condition: Summary: N/A Because indoor air pre-occupancy sampling (LUR #11), and exterior final grade sampling (LUR #10) have not been performed, there is the potential for public exposure to vapor intrusion or impacted surface soils. PHOTOGRAPHS Photo 1: Spencer’s Mill Apartments Met Mr. Kenneth Reiter, and Mr Mark Horton at 07:55 at the property. Discussed site and walked perimeter of building exterior when Mr. Deakle arrived. Mr. Deakle and Mr. Reiter discussed the use of stockpiled rip-rap to provide hardscape surface adjacent to building (5-foot perimeter). Apartment complex is approximately 90% rented, so unable to enter below grade of ground floor apartment units. Was able to view below grade common areas and office, viewed portion of “crawl space” below street level apartments, and viewed a typical apartment on second floor.
