Septage management program; permit fees. (c) No septage management firm shall commence or continue operation that does not have a permit issued by the Department. The permit shall be issued only when the septage management firm satisfies all of the requirements of the rules adopted by the Commission. 6 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(a) Septage management firm names must be distinguishable upon the records of the Division from the name of other septage management firms, limited liability companies…business corporations etc.…naming preferences shall be given to companies that are listed as incorporated with the NC Secretary of State’s office. 7 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(c) To apply for a permit, a person proposing to operate a septage management firm shall submit the following information to the Division by January 1 of each year. •Completed permit application & permit fee •Disposal authorization(s) 8 Department of Environmental Quality New Firm Operator Permit Process 1.Attend new operator training class. 2.Submit an application and permit fee. 3.With receipt of the application and fee, DWM will assign an NCS permit number to the applicant. 4.With permit number: •Obtain and submit to DWM, Discharge Authorization(s). •Get pumper vehicle(s) lettered, per septage rule requirements. 5.Get pumper vehicle inspected, to verify compliance with rules. When all steps above are successfully completed the permit can be signed. You are not permitted until the permit is signed. 9 “Application For Permit To Operate A Septage Management Firm” 10 Department of Environmental Quality “Application For Permit To Operate A Septage Management Firm” There are two types of applications 1.Paper-printable, hard copy must be mailed 2.Electronic-Filled out online and submitted online •New firms use printable form and mail with fee payment •Electronic form should be used for permit renewals 11 Department of Environmental Quality 12 Septage Management Firm Permit Applications “Application For Permit To Operate A Septage Management Firm” Printable Form 13 Department of Environmental Quality 14 (1) The “Firm Name” must be exactly as it is shown on your vehicle 15 The E-mail address given will be used for important communications such as sending permit renewal information, Inspection reports etc. Make sure it is one that is for official communications and will be checked often. 16 New firms will be issued an NCS permit number after the permit application and permit fee have been received (New Firms leave blank) 17 (2) Firm owner’s and (3) Firm operator’s Contact information 18 Record previous 12 months pumping totals in gallons. •Should be 0 for new firm 19 List counties where operating 20 Pumper vehicle information 21 (7) This section was recently added to replace the Recertification of Pumper Vehicle(s) Form Submittal of the Recertification of Pumper Vehicle(s) form is required when renewing a septage management firm permit using an older version of the printable Application for Permit to Operate a Septage Management Firm revised 10/27/2020 22 The Septage Disposal Method selected should be accompanied by a completed Disposal Authorization Form Three types: •Authorization to Discharge Septage to a Wastewater Treatment Facility •Authorization to Discharge Septage at a Septage Detention or Treatment Facility (SDTF) •Authorization to Discharge Septage at a Septage Land Application Site (SLAS) 23 (9) List Septage Management Firm training received •Four hours required each year for Firms •Three hours required each year for SLAS operators •New Firms: Indicate: New Operator Training, this location, todays date. 24 (10) Indicate type of Septage Managed •This should be consistent with Information on the Discharge Authorization* 25 Your Signature -certifies that the information is true, complete and accurate to the best of your knowledge. Handouts “Authorization to Discharge Septage to a Wastewater Treatment Facility” 26 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(c)(14) Written authorization on official letterhead or a notarized wastewater treatment plant authorization form shall be submitted from an individual responsible for the operation of each wastewater treatment plant used for disposal. 27 Department of Environmental Quality 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE •(d) Septage to be discharged at a wastewater treatment plant or any part of the collection system for that plant shall be handled in accordance with the plant rules and policies. 28 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(e) A septage management firm permit shall not be issued unless the applicant has submitted to the Division written documentation of authorized access to dispose or otherwise manage septage, or any part of septage, at a wastewater treatment plant, a permitted septage land application site, a permitted septage treatment facility, or other permitted solid waste management facility. Documentation from each plant, site, or other facility shall include the types and amount of septage that may be discharged. 29 Department of Environmental Quality Authorization to Discharge Septage to a Wastewater Treatment Facility 30 31 •New firms will be issued an NCS permit number after the permit application and permit fee have been received •Most WWTPs will not issue a Discharge Authorization without a valid NCS number •Make sure the firm name and NCS number is correct on the authorization when received •**Try to get the Discharge Authorization sent to you by email to facilitate electronic renewals** 32 The Discharge Authorization will indicate what types of septage are permitted to discharged at the WWTP *Type of septage managed by firm dependent on Discharge Authorization (note line (10) on Application. 33 The Discharge Authorization will articulate where septage will be accepted from 34 The Discharge Authorization will indicate the location septage should be discharged and during what hours. Reintroduction to grease trap? Usually not permitted 35 •Take note of the expiration date usually will be Dec. 31 •Mistakes are sometimes made. •It is easier to get corrections made while you are picking up your Discharge Authorization from the WWTP. 36 Discharge Authorizations printed on the owner of the treatment works official letterhead do not require notary seal. Grease Disposal List Handouts “WWTPs that may accept grease WWTP plants that may accept septage” Note: WWTPs accepting septage is subject to change at the discretion of the treatment works 43 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(f) Septage management firm permits shall not be issued until all parts of the application have been completed. •(g) Prior to the issuance of a septage management firm permit to firms that pump septage, all pumper trucks for the firm shall be inspected and approved by the Division for compliance with Rule .0835 of this Section. 44 Department of Environmental Quality 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS •(h) Permits shall not be transferable. •(i) Septage management firm permits issued on or after January 1 shall be effective until December 31 of that calendar year. 45 Department of Environmental Quality 15A NCAC 13B .0833 PERMIT FEES •(a) Every septage management firm shall pay an annual permit fee by January 1 of each year … unless the firm notifies the Division prior to January 1 that the firm will not operate during the next year. •Fees shall be paid to the Division of Waste Management. 46 Department of Environmental Quality 15A NCAC 13B .0833 PERMIT FEES •(c) Failure to apply for permit renewal or failure to pay the permit fee by January 1 shall result in assessment of a late fee in accordance with G.S. 130A-291.1(e2). Failure to pay the appropriate fees within 45 days after January 1 shall result in an additional administrative penalty pursuant to G.S. 130A-22(a) of ten dollars ($10.00) per day for each day thereafter that the fees are not paid. •WWTP’s are contacted for failure by firm to apply for renewal or pay fees. 47 Department of Environmental Quality 15A NCAC 13B .0833 PERMIT FEES •(d) Annual permit renewal, including fee payment, shall be the responsibility of the operator of the septage management firm. If the operator did not receive annual permit renewal forms, it shall not be a defense to assessment of late fees. 48 Department of Environmental Quality Permit Revisions •Contact this office regarding changes in trucks, discharge locations, septage types and company name, address or phone numbers. •If you have any questions, please call to prevent any confusion or violations. 49 Department of Environmental Quality NCGS§130A-291.1. Septage management program; permit fees. •(e2) A properly completed application for a permit and the annual fee under this section are due by December 15 of each year. The Department shall mail a notice of the annual fees to each permitted septage management firm and each individual who operates a septage treatment or disposal facility prior to October 1 of each calendar year. A late fee in the amount equal to fifty percent (50%) of the annual permit fee under this section shall be submitted when a properly completed application and annual permit fee are not submitted by January 1 following the October 1 notice. The clear proceeds of civil penalties collected pursuant to this subsection shall be remitted to the Civil Penalty and Forfeiture Fund in accordance with G.S. 115C-457.2." 50 Where to Find Applications & Forms 51 •All application materials can be obtained from the NCDWM Septage website https://deq.nc.gov/about/divisions/waste-management/waste-management-rules/septage 52 Use for online application Use for paper application When renewing with the paper application, one must submit Recertification of Pumper Vehicle form 53 For disposal authorization forms, scroll down to next section. 54 Using the Online Application Click on the appropriate application. (1) The date, type, quantity, and location of septage pumped; the location for tanks shall be a street address and the location for portable toilets shall be a route. (2) Location of the discharge of the septage. 69 Department of Environmental Quality Records •Do not combine pump jobs –except for a daily route for portable toilets. •Maintaining records is required. •Operators will be held accountable for falsifying records. •If you have any questions about your truck logs, please ASK. 70 Department of Environmental Quality 15A NCAC 13B .0836 RECORD KEEPING FOR SEPTAGE FIRMS •(b) A septage management firm shall make all records documents, or logs required in accordance with this Section or conditions of the permit available for review the Division at the time and place of an inspection of the firm’s septage pumper truck(s) or upon the Division’s request. 71 Department of Environmental Quality 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE 72 Department of Environmental Quality (a) Vehicles used for the transportation of septage shall be operated and maintained to prevent leaks and spills of septage and shall comply with the following: (1) all tanks shall be constructed of metal and affixed to the truck bed with permanent fixtures such as bolts; (2) all valves shall be in working order and be closed during transportation; (3) all access ports shall have lids in good repair in accordance with manufacturer specifications and sealed during transportation; (4) portable toilet pump units that slide into pickup truck beds shall be bolted to the trucks in accordance with manufacturer specifications; (5) boats used to pump or transport septage shall be United States Coast Guard approved or construction plans shall be available indicating that the specific craft is stable in the water when fully loaded with septage, and if required by G.S. 89C, a professional engineer shall prepare these documents; and (6) tanks that are mounted on trailers for the pumping or transportation of septage shall meet all applicable State and federal requirements for highway use. 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE •(b) All permitted septage management firms shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall include the firm name, town name, phone number, and septage management firm permit number as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable from the background, and not obstructed from view. Are they tight? •Lettering –is it correct? •Tag/VIN numbers & tank capacity –are they correct? •Pump logs –any missing info? 78 Department of Environmental Quality Truck Inspection 79 •Structurally sound? •Maintained to prevent leaks and spills of septage? 80 Is the tank affixed to the truck frame by permanent fixtures 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE •(c) Applicants for septage management firm permits that were not permitted in the previous calendar year shall have each pump truck inspected prior to the Division's issuance of a permit. 81 Department of Environmental Quality New or Repainted Trucks •Any new trucks shall be lettered correctly & inspected –contact us. •A repainted truck shall be lettered correctly & inspected. •If a tank is switched to another truck bed an inspection is required. •A firm permitted to operate one truck will need to pay an additional $250.00 to add more trucks to the permit. ($550+$250=$800.00) 82 Department of Environmental Quality NCGS 130A-291.1. Septage management program; permit fees •(h1) The annual permit application shall identify the pumper trucks to be used by the septage management firm. A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department. A septage management firm is not prohibited from use of a pumper truck that meets the requirements of the rules adopted by the Commission prior to inspection by the Department. 83 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE •(e) All vehicles used in the transportation of septage, including spare vehicles and tankers, shall meet the requirements of this section and be included in the permit application. 84 Department of Environmental Quality Permitted Vehicles •Any vehicle that goes on the road at any time to pump, haul or discharge septage shall be a permitted vehicle –be correctly lettered, have been inspected and listed on current application. •Includes any backup vehicle. All permitted pumper vehicles must meet 15A NCAC 13B .0835 85 Department of Environmental Quality Inactive Vehicles •Old trucks sitting stationary do not have to be listed on the firm permit, but shall not be used for septage storage unless a SDTF permit is issued. •A truck or storage tank used for septage shall be permitted either under a firm permit or a SDTF permit. 86 Department of Environmental Quality 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE •f) Vehicles used in the transportation of septage, that are listed on an approved septage management firm permit application, may remain loaded or partially loaded on land owned by the septage management firm for up to seven days without obtaining a permit for a detention or treatment facility. Such vehicles shall comply with this Rule. 87 Department of Environmental Quality 15A NCAC 13B .0832 GENERAL PROVISIONS •(h) Washings from the interior of septage handling containers such as pump trucks shall be managed as septage. 88 Department of Environmental Quality Other Types of Septage 89 Spent Media 15A NCAC 13B .0832 GENERAL PROVISIONS (a)(2) The permit requirement of G.S. 130A-291.1(c) applies to persons who remove septage, and other waste materials or spent media from wastewater systems permitted by the Department of Health and Human Services, under the authority of Article 11, Chapter 130A of the North Carolina General Statutes; Spill or Accident Response Procedures for Overturned Septage Trucks •Contain the spill. •Contact local authorities and NCDWM. •Contact another firm to pump waste if needed. •Completely clean up the spill (septage waste, contaminated soil, rinse water). •Company response plan may be needed. 90 Department of Environmental Quality 91 Be Safe •Septage can contain many pathogens and parasites such as Hepatitis, HIV, Shigella and Cryptosporidium •Get immunized (tetanus, hepatitis) •Use sanitary practices (gloves, sanitizer) •Take precautions when working at residences around children and pets.
