Tryon Street, Suite 200 Charlotte, NC 28202 Charlotte, NC 28202 chris.branch@blvdrea.com jfish@spectrumcos.com Subject: Brownfields Property Soil Transfer Approval- REVISED Former Gathings Motor Company to Woodlawn Green Brownfields Properties Charlotte, Mecklenburg County Brownfields Project No. 22074-18-060 and 22023-18-060 Dear Mr. Fish and Mr. Branch, The North Carolina Department of Environmental Quality (DEQ) Brownfields Program received and reviewed a request to export an approximate 3,000-6,000 cubic yards of soils from the Former Gathings Motor Company Brownfields Property to the Woodlawn Green Brownfields Property. This request was submitted on your behalf by Mr. Rob Foster of Wood Environment & Infrastructure Solutions, Inc (Wood) in his Beneficial Reuse Soil Transfer Request dated September 16, 2020. DEQ Brownfields reviewed the soil analytical data provided the following reports: Letter Report of Stockpiled Soil Characterization dated July 13, 2020 prepared by Wood; Report of Soil Characterization for Beneficial Reuse (Shallow Soil East Tower) dated January 23, 2020 prepared by Wood; and Beneficial Reuse Soil Assessment Report dated April 3, 2019 prepared by Wood. Block 12 referenced in Report of Soil Characterization for Beneficial Reuse (Shallow Soil East Tower) dated January 23, 2020 is not approved for export to Woodlawn Green. The remaining portions are acceptable and based on a review of the DEQ Risk Calculator which incorporated data from both properties did not increase risk at the receiving Woodlawn Green Brownfield Property. Therefore, DEQ Brownfields approves of up to 6,000 cubic yards of soil to be exported to the Woodlawn Green Brownfields Property, with the exception of soil from Block 12. Mr. Christopher Branch and Mr. Jason Fish September 21, 2020 Page 2 In May 2020, DEQ Brownfields Program approved the request to export an approximate 2,500 cubic yards of soils from stockpiles A1, A2, A3, and A5 between this brownfields properties. This letter approves up to an additional 6,000 cubic yards. All soil export must be conducted under a DEQ Brownfields approved Environmental Management Plan (EMP). Per the Gathings Motors EMP, the soils will be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, in accordance with the approved EMPs for Gathings Motors and Woodlawn Green, an annual Redevelopment Summary Report will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but not limited to, total volume, general description of field screening efforts, etc. should be included with each Property’s Redevelopment Summary Report. Please be advised that this approval does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities.
