A site location map is provided as Figure 1. The purpose of the sampling was to confirm that exposed shallow soils (up to 5 ft below ground surface (bgs)) do not contain poly -chlorinated biphenyls (PCBs) above site -specific screening levels as outlined in the approved Brownfields Agreement (BFA). A brief description of background information is provided below. 2923 South Tryon Street, Suite 100 3334 Hillsborough Street Charlotte, NC 28203 Raleigh, NC 27607 www.harthickman.com 704.586.0007 main 919.847.4241 main Ms. Carolyn Minnich July 18, 2014 Page 2 2.0 Background Information The Phase III redevelopment area is comprised of the 2001 Suttle Avenue portion of the site (historically referred to as Tract F) and the northern portion of the property located at 1900 Wilkinson Boulevard (historically referred to as Tract G). Tract F is located north of Tract G (Figure 2). Phase III redevelopment involved site grading and construction of a charter school, and surface parking lots. Environmental conditions at the Brownfields property have been documented by data presented in the Results of Site Assessment Activities prepared by Hart & Hickman, PC (August 19, 2002), in the Supplemental Soil Sampling Activities report (February 20, 2007), and in the H&H Additional Soil Sampling Activities (Tract F) report dated November 3, 2008. The data available from the Phase III area is summarized and compared to current screening criteria in the Soil Management Plan for "Areas of Known Contamination " dated July 18, 2013 (SMP). This SMP was approved by DENR on July 19, 2013. The SMP required a work plan for sampling in areas of exposed soils following the completion of grading activities. Therefore, H&H submitted a Post -Construction Sampling and Analysis Plan dated January 22, 2014 (SAP) which was subsequently approved by DENR on January 24, 2014. The scope of work described below includes the sampling required in the SAP. 3.0 Scope of Work Collection of Post -Grading Samples H&H collected composite soil samples on May 30 and June 2, 2014 in accordance with the SAP. The sample aliquots were collected using decontaminated stainless steel hand augers, composited as detailed in the SAP, and placed into laboratory provided glassware. The samples were immediately placed on ice and delivered to the laboratory under chain of custody protocol. The composite samples were submitted to Pace Analytical Services, Inc. (Pace) in Huntersville, North Carolina for laboratory analysis of PCBs by EPA Method 8082. According to the BFA, the total PCB concentration in exposed areas of soil to a depth of 5 ft bgs must be below one (1) part per million PCBs. No PCB concentrations exceeded the 1 mg/kg criteria except in two adjacent samples. PCB-1248 was detected at a concentration of 2.33 mg/kg in the 0-2 ft bgs composite sample from the designated "Area F" and at a concentration 4.80 mg/kg in the 0-2 ft bgs composite sample from the designated "Area E". These contiguous areas are shown on Figure 2. Additional Soil Excavation Since the composite sampling data indicated the designated "Areas E and F" had concentrations of PCBs in shallow (0-2 ft bgs) soil above the site specific screening criteria, H&H contacted DENR regarding additional soil removal. In an emailed work plan, H&H indicated that the areas of known soil contamination designated "Areas E and F" during the post -grading sampling would be excavated and transported for off -site disposal, and would be backfilled with imported fill from a known source. After backfilling, two additional composite samples for PCB analysis would be collected from the backfilled excavated area at a 0-2 ft depth interval, which is consistent with the sampling activities approved in the SAP. In an email dated June 30, 2014 DENR approved the proposed corrective action (Appendix B). H&H contracted A&D Environmental Services (A&D) to excavate the impacted soil. On July 7 and 8, 2014 the PCB -containing soil from the areas designated "Areas E and F" was excavated, loaded into dump trucks, and transported to the Republic landfill Services, Inc. (Republic) landfill in Concord, NC. H&H provided oversight of the excavation, and confirmed the extent of the excavation included Areas E and F, and field measured the dimensions of the excavation which was 76 ft in length by 10 ft in width and 5 ft in depth. A total of 159.33 tons of soil was removed and disposed at the Republic Services landfill in Concord, NC. Completed manifests and weight tickets are provided in Appendix C. Backfill Analysis In accordance with DENR requirements, H&H used a decontaminated hand auger to collect additional composite samples in the backfilled excavation at a depth of 0-2 ft. The samples (labeled as E-Backfill and F-Backfill) were collected in laboratory provided glassware, placed on ice, and delivered to Pace under chain of custody protocol. The samples were submitted for laboratory analysis of PCBs by EPA Method 8082. The analytical results of the two samples collected indicated that no PCBs were detected above laboratory detection limits. Analytical results are provided on Table 1 and laboratory results are provided in Appendix C. 4.0 Summary and Conclusion Post -grading sampling indicated no PCBs above the site specific screening criteria, with the exception of two locations. The soil within the areas of known soil contamination designated "Areas E and F" was found to contain PCBs above 1 ppm. Therefore, in accordance with the BFA, the impacted soil was excavated and removed from the site for disposal. The entire area of known soil contamination was then backfilled with clean off -site fill to a depth of 5 ft bgs. Additional confirmation samples collected from backfill placed in the excavation at "Areas E and F" confirm no PCBs are present above site specific goals. Based upon the post site grading confirmation sampling, the site is in compliance with BFA. Therefore, on behalf of Suttle Avenue, LLC we request a letter from DENR confirming your agreement that the BFA has been complied with and no further activities are necessary. I attached a table summarizing the recent data from the post -grading confirmatory sampling and a figure from the approved Post - Grading Sampling Plan for ease of reference. As we discussed, the sample results were below 1 mg/kg in all areas except for the areas defined as E & F (shown as one contiguous area). You will note on the attached figure and table that PCBs were detected at 2.3 mg/kg and 4.8 mg/kg at 0-2 ft in this area. To address these exceedances as quickly as possible, we discussed it was acceptable to excavate the designated "Area of Known Soil Contamination" (which is depicted as Areas E & F and outlined in blue) to approximately 5 ft below ground surface and then backfill the entire area with clean imported fill. We discussed the excavation area will be approximately 75 feet long, 10 feet wide, and 5 ft deep (based on Figure 2 ). We discussed collecting two additional composite samples for PCB analysis from the backfill after it has been placed (0-2 ft depth interval to be consistent with previous sampling) to document no PCBs are above the action levels. We discussed that no additional sampling will be required since the area of known soil contamination will be removed for offsite disposal. We plan to send the soil to the Republic landfill in Concord, NC. We did discuss with our client that they could do additional sampling to possibly reduce the area to be excavated but they prefer to move quickly to meet the schedule to occupy the building next month. We plan to start this excavation in the next few days so if you would please respond to this email that this plan is acceptable I would appreciate it. H&H will prepare a final summary report with the results of the post -grading sampling and will include a summary of this additional excavation as well.
