AquAirII(#18038-14-060)redevelopmentactivitiesattheBrownfieldsProperty,thetimingofredevelopmentphases,andaddresseshealth,safetyandenvironmentalissuesthatmayarisefromuseoftheBrownfieldsPropertyduringconstructionorredevelopmentinanyotherform,includingwithoutlimitation:a.soilandwatermanagementissues,includingwithoutlimitationthoseresultingfromcontaminationidentifiedintheEnvironmentalReports;b.issuesrelatedtopotentialsourcesofcontaminationreferencedinExhibit2totheNoticeofBrownfieldsProperty;andc.contingencyplansforaddressingnewlydiscoveredpotentialsourcesofenvironmentalcontamination(e.g.,tanks,drums,septicdrainfields).IncomplianceDOutofcomplianceRemarks:TherehasbeennophysicalredevelopmentoftheportionoftheBrownfieldspropertyownedbyWestinghouseRealEstateandDevelopment.LUR3:Within90daysaftereachone-yearanniversaryoftheeffectivedateoftheBrownfieldsAgreementforaslongasphysicalredevelopmentoftheBrownfieldsPropertycontinues(exceptthatthefinaldeadlineshallfall90daysaftertheconclusionofphysicalredevelopment),thethenowner(s)oftheBrownfieldsPropertyshallprovideDENRareport(s)subjecttowrittenDENRapprovalonenvironment-relatedactivitiesattheBrownfieldsPropertysincethelastreport,withasummaryanddrawings,thatdescribes:a.actionstakeninaccordancewiththeplanrequiredbyLUR2above;b.soilgradingandcutandfillactions;c.methodology(ies)employedforfieldscreening,samplingandlaboratoryanalysisofenvironmentalmedia;d.stockpiling,containerizing,decontaminating,treating,handling,laboratoryanalysisandultimatedispositionofanysoil,groundwaterorothermaterialssuspectedorconfirmedtobecontaminatedwithregulatedsubstances;ande.removalofanycontaminatedsoil,waterorothercontaminatedmaterials(forexample,concrete,demolitiondebris)fromtheBrownfieldsProperty(copiesofalllegallyrequiredmanifestsshallbeincluded).IncomplianceDOutofcomplianceRemarks:LUR4:Surfacewater,otherthaninconnectionwithlegallycompliantstormwatercollectionandreusetechniques,maynotbeusedattheBrownfieldsPropertyforanypurposewithoutthepriorwrittenapprovalofDENR.IncomplianceDOutofcompliance AquAirII(#18038-14-060)Remarks:LUR5:UnlesscompliancewiththisLURiswaivedinwritingbyDENRinadvanceinregardtoparticularactivity,noactivitiesthatencounter,expose,removeorusegroundwater(forexample,installationofwatersupplywells,ponds,lakesorswimmingpools,orconstructionorexcavationactivitiesthatencounterorexposegroundwater)mayoccurontheBrownfieldsPropertywithoutpriorsamplingandanalysisofgroundwatertothewrittensatisfactionofDENRinanyareasproposedforsuchactivities,andsubmittaloftheanalyticalresultstoDENR.IfsuchresultsreflectcontaminantconcentrationsthatexceedthestandardsandscreeninglevelsapplicabletotheusesauthorizedfortheBrownfieldsProperty,thegroundwater-relatedactivitiesproposedmayonlyoccurincompliancewithanywrittenconditionsDENRimposes.IncomplianceDOutofcomplianceRemarks:LUR6:BeginninginJanuary[2016]followingtheyearinwhichtheNoticeofBrownfieldsProperty(“Notice”)isrecorded,andforaminimumoffive(5)annualsamplingevents[2016to2021],theowner(s)oftheBrownfieldsPropertywherethebelowreferencedwellsarelocatedshalleffectsamplingofmonitoringwellsAMW-102,AMW-104,AMW-103,andAMW-108andsamplingoftheadjacentstreamfromanupgradientlocationandalocationnearwellAMW-108inaccordancewiththemostcurrentversionoftheGuidelinesoftheInactiveHazardousSitesBranchofDENR’sSuperfundSection.ThegroundwaterandstreamsamplescollectedshallbeanalyzedbyU.S.EnviromnentalProtectionAgency’sMethod8260orbyanothermethodapprovedinadvance,inwriting,byDENRoritssuccessorinfunction.Afterthecompletionofthefiveyearperiod,theowner(s)oftheBrownfieldsPropertywherethewellsarelocatedshallprepareandsubmittoDENRanupdatedreceptorsurveytothesatisfactionofDENR,andmaysubmittoDENRarequesttoterminatesuchsamplingincludingthepublichealthrationaleforsuchtermination.Thethenowner(s)oftheBrownfieldsPropertywherethewellsarelocatedshallsampleandmaintainthewellsidentifiedinthis[LUR].IfoneorallofthewellsidentifiedinthisparagraphneedtobeabandonedforBrownfieldsPropertyredevelopmentpurposes,thethenowneroftheBrownfieldsPropertythatcontainsthewell(s)shallnotifyDENRatleast30daysinadvanceoftheabandonmentandthewellsshallbeabandonedinaccordancewithapplicableregulations.Intheabandonmentnotification,thethenBrownfieldsPropertyownershallprovideforDENRreviewandapprovalarationaleastowhythewell(s)donotneedtobereplacedortheproposedlocationandconstructiondetailsofareplacementwellorwells.IncomplianceDOutofcomplianceRemarks:ThemonitoringwellandsurfacewatersamplingrequiredtobeconductedperthisLURarenotlocatedontheportionoftheBrownfieldspropertyownedbyWestinghouseRealEstateandDevelopment. AquAirII(#18038-14-060)LUR7:Duringphysicalredevelopmentandonward,noactivitythatdisturbssoilontheBrownfieldsPropertylocatedwestoftheSouthernRailroadRightofWayinthe“AreaofPotentialSoilContamination”asdelineatedontheplatcomponentoftheNotice,mayoccurunlessanduntilDENRstatesinwriting,inadvanceoftheproposedactivity,thatsaidactivitymayoccurifcarriedoutalongwithanymeasuresDENRdeemsnecessarytoensuretheBrownfieldsPropertywillbesuitablefortheusesspecifiedinLUR1abovewhilefullyprotectingpublichealthandtheenvironment,except:inconnectionwithdeminimissoilremovalstodepthsnotexceeding6inches,mowingandpruningofabove-groundvegetation;and,foremergencyrepairofundergroundinfrastructure,providedthatDENRshallbegivenwrittennotice(ifonlybyemail)ofanysuchemergencyrepairnolaterthanthenextbusinessday,andthatanyrelatedassessmentandremedialmeasuresrequiredbyDENRshallbetaken.1IncomplianceDOutofcomplianceRemarks:LUR8:NobuildingmaybeconstructedontheBrownfieldsProperty,unlessanduntilDENRdeterminesinwritingthat:a.thebuildingwouldbesufficientlydistantfrom(1)theBrownfieldsProperty’sknowngroundwaterand/orsoilcontamination(2)andpotentialoff-sitesourcesthataremigratingon-sitethatthebuilding’susers,publichealthandtheenvironmentwillbeprotectedfromriskfromvaporintrusionrelatedtosaidcontamination;orb.aplanforavaporintrusionmitigationsystem,approvedinwritingbyDENRinadvanceandincludingaproposedperformanceassessmentfordemonstrationofthesystem’sprotectionofthebuilding’susers,publichealthandtheenvironmentfromriskfromvaporintrusion,isimplementedtothesatisfactionofaNorthCarolina-licensedprofessionalengineerasreflectedbyimplementationdocumentationsealedbysaidengineer.XiIncomplianceDOutofcomplianceRemarks:NobuildinghasbeenconstructedontheportionoftheBrownfieldspropertyownedbyWestinghouseRealEstateandDevelopment.LUR9:NoneofthecontaminantsknowntobepresentintheenvironmentalmediaattheBrownfieldsProperty,includingthoseappearinginExhibit2totheNotice,maybeusedorstoredattheBrownfieldsPropertywithoutthepriorwrittenapprovalofDENR,exceptindeminimisamountsforcleaningandotherroutinehousekeepingactivities,forvehiclemaintenanceandserviceincompliancewithapplicablelaw(althoughvehiclepartsandtoolsmaynotbecleanedinsolventscontaininganycontaminantsknowntobepresentinenvironmentalmediaatthe AquAirII(#18038-14-060)BrownfieldsProperty),andfuelandotherfluidscustomarilyusedinvehicles,constructionequipment,landscapingequipmentandemergencygenerators.1IncomplianceDOutofcomplianceRemarks:LUR10:TheBrownfieldsPropertymaynotbeusedforagricultureorgrazing,withoutthepriorwrittenapprovalofDENR.IncomplianceDOutofcomplianceRemarks:LUR11:TheBrownfieldsPropertymaynotbeusedasapark,playground,orforsportsofanykind,including,butnotlimitedto,golf,football,soccerandbaseball,withoutthepriorwrittenapprovalofDENR.IncomplianceDOutofcomplianceRemarks:LUR12:TheownerofanyportionoftheBrownfieldsPropertywhereanyexisting,orsubsequentlyinstalled,DENR-approvedmonitoringwellisdamagedshallberesponsibleforrepairofanysuchwellstoDENR’swrittensatisfactionandwithinatimeperiodacceptabletoDENR,unlesscompliancewiththisLURiswaivedinwritingbyDENRinadvance.1IncomplianceDOutofcomplianceRemarks:AllmonitoringandrecoverywellsontheportionofthepropertyownedbyWestinghouseRealEstateandDevelopmentwereabandonedinMayandJune2018inaccordancewithapprovalfromDEOBrownfields.LUR13:NeitherDENR,noranypartyconductingenvironmentalassessmentorremediationattheBrownfieldsPropertyatthedirectionof,orpursuanttoapermit,orderoragreementissuedorenteredintobyDENR,maybedeniedaccesstotheBrownfieldsPropertyforpurposesofconductingsuchassessmentorremediation,whichistobeconductedusingreasonableeffortstominimizeinterferencewithauthorizedusesoftheBrownfieldsProperty. AquAirII(#18038-14-060)1IncomplianceDOutofcomplianceRemarks:LUR14:DuringJanuaryofeachyearaftertheyearinwhichtheNoticeisrecorded,theownerofanypartoftheBrownfieldsPropertyasofJanuarylofthatyearshallsubmitanotarizedLandUseRestrictionsUpdate(“LURU”)toDENR,andtothechiefpublichealthandenvironmentalofficialsofMecklenburgCounty,certifyingthat,asofsaidJanuary1St,theNoticeofBrownfieldsPropertycontainingtheselanduserestrictionsremainsrecordedattheMecklenburgCountyRegisterofDeedsofficeandthatthelanduserestrictionsarebeingcompliedwith,andstating:a.thename,mailingaddress,telephoneandfacsimilenumbers,andcontactperson’se-mailaddressoftheownersubmittingtheLURUifsaidowneracquiredanypartoftheBrownfieldsPropertyduringthepreviouscalendaryear.b.thetransferee’sname,mailingaddress,telephoneandfacsimilenumbers,andcontactperson’se-mailaddress,ifsaidownertransferredanypartoftheBrownfieldsPropertyduringthepreviouscalendaryear.c.inthecaseoftheownerofthepartoftheBrownfieldsPropertyaffectedbyLUR6above,theresultsofthesamplingrequiredbysaidLUR(attachresults),andd.whetheranyvaporbarrierandlormitigationsystemsinstalledpursuanttoLUR8aboveareperformingasdesigned,andwhethertheusesofthegroundfloorsofanybuildingscontainingsuchvaporbarrierand/ormitigationsystemshavechanged,and,ifso,how.IncomplianceDOutofcomplianceRemarks:The2019LURUisbeingsubmittedafterJanuary31,2019;however,thelanduserestrictionsremainrecordedandthelanduserestrictionsarebeingcompliedwith.
