AquAirII(#18038-14-060)Remarks:LUR5:UnlesscompliancewiththisLURiswaivedinwritingbyDENRinadvanceinregardtoparticularactivity,noactivitiesthatencounter,expose,removeorusegroundwater(forexample,installationofwatersupplywells,ponds,lakesorswimmingpools,orconstructionorexcavationactivitiesthatencounterorexposegroundwater)mayoccurontheBrownfieldsPropertywithoutpriorsamplingandanalysisofgroundwatertothewrittensatisfactionofDENRinanyareasproposedforsuchactivities,andsubmittaloftheanalyticalresultstoDENR.IfsuchresultsreflectcontaminantconcentrationsthatexceedthestandardsandscreeninglevelsapplicabletotheusesauthorizedfortheBrownfieldsProperty,thegroundwater-relatedactivitiesproposedmayonlyoccurincompliancewithanywrittenconditionsDENRimposes.IncomplianceDOutofcomplianceRemarks:LUR6:BeginninginJanuary[2016]followingtheyearinwhichtheNoticeofBrownfieldsProperty(“Notice”)isrecorded,andforaminimumoffive(5)annualsamplingevents[2016to2021],theowner(s)oftheBrownfieldsPropertywherethebelowreferencedwellsarelocatedshalleffectsamplingofmonitoringwellsAMW-102,AMW-104,AMW-103,andAMW-108andsamplingoftheadjacentstreamfromanupgradientlocationandalocationnearwellAMW-108inaccordancewiththemostcurrentversionoftheGuidelinesoftheInactiveHazardousSitesBranchofDENR’sSuperfundSection.ThegroundwaterandstreamsamplescollectedshallbeanalyzedbyU.S.EnviromnentalProtectionAgency’sMethod8260orbyanothermethodapprovedinadvance,inwriting,byDENRoritssuccessorinfunction.Afterthecompletionofthefiveyearperiod,theowner(s)oftheBrownfieldsPropertywherethewellsarelocatedshallprepareandsubmittoDENRanupdatedreceptorsurveytothesatisfactionofDENR,andmaysubmittoDENRarequesttoterminatesuchsamplingincludingthepublichealthrationaleforsuchtermination.Thethenowner(s)oftheBrownfieldsPropertywherethewellsarelocatedshallsampleandmaintainthewellsidentifiedinthis[LUR].IfoneorallofthewellsidentifiedinthisparagraphneedtobeabandonedforBrownfieldsPropertyredevelopmentpurposes,thethenowneroftheBrownfieldsPropertythatcontainsthewell(s)shallnotifyDENRatleast30daysinadvanceoftheabandonmentandthewellsshallbeabandonedinaccordancewithapplicableregulations.Intheabandonmentnotification,thethenBrownfieldsPropertyownershallprovideforDENRreviewandapprovalarationaleastowhythewell(s)donotneedtobereplacedortheproposedlocationandconstructiondetailsofareplacementwellorwells.IncomplianceDOutofcomplianceRemarks:ThemonitoringwellandsurfacewatersamplingrequiredtobeconductedperthisLURarenotlocatedontheportionoftheBrownfieldspropertyownedbyWestinghouseRealEstateandDevelopment.
