Craighead Road & Philemon Avenue Charlotte, North Carolina Brownfields Project ID: 18015-14-060 H&H Job No. SHR-001 1.0 Introduction On behalf of Philemon NoDa Partners, LLC, Hart & Hickman, PC (H&H) has prepared this work plan to conduct post-development Brownfields sampling activities at the Craighead Road (Abernethy Lumber) Brownfields site (BF # 18015-14-060) located at E. Craighead Road and Philemon Avenue in Charlotte, Mecklenburg County, North Carolina (Site). The Site is in the North Carolina Department of Environmental Quality (DEQ) Brownfield Program. A Site location map is included as Figure 1. The Site is approximately 9.9 acres and is being redeveloped with a residential apartment complex that includes two four-story apartment buildings (identified as Building 1 and Building 2), an attached amenities building and leasing office, an outdoor pool/courtyard, asphalt-paved parking, and landscaped areas that are collectively known as the NoDa Village Apartments. The building locations are provided on Figure 2 and a Site Plan is included in Appendix A. The soil sampling activities will be conducted in general accordance with the methods stated in the DEQ approved Environmental Management Plan (EMP) prepared for the subject Site by H&H and dated February 21, 2017. Redevelopment of the Site is underway as of the submittal of this work plan and final grade has been achieved throughout the subject Site. A brief summary of background information is presented in Section 2.0 below, and the proposed scope of work is provided in Section 3.0. 2 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx 2.0 Background Information 2.1 Site History The Site has been historically used for residential and industrial purposes. Residences were constructed in the late 1920s and early 1930s along Philemon Avenue. Abernethy Lumber owned the industrial portion of the subject Site from the late 1930s until 2007. From the late 1930s through early 1990s, Abernethy Lumber operated as a full-service lumber yard. From the early 1990s until 2007, Abernethy Lumber utilized the Site for custom millworking and reportedly for the storage of treated wood. During the mid-1990s, the western portion of the Site was used to store shipping containers. 2.2 Summary of Previous Environmental Assessment and Brownfields Activities 1996 UST Removal and Regulatory Closure In April 1996, one 1,000-gallon gasoline underground storage tank (UST) and one 1,000-gallon diesel UST, located in the east-central portion of the Site, were removed (Incident No. 27627). After UST removal, four closure samples were collected approximately two feet below the former base of the USTs. The closure sample results indicated total petroleum hydrocarbons (TPH) below DEQ Action Levels and DEQ issued no further action (NFA) for the USTs in March 1997. 2007 Limited Site Investigation A Limited Site Investigation was conducted by Terracon in May 2007, which included the collection of soil and groundwater samples from the vicinity of the former 1,000-gallon USTs (Incident No. 27627). In addition, sampling was conducted near a recently discovered orphan UST (later associated with Incident No. 36599). Various petroleum constituents were reportedly identified in soil at concentrations exceeding Soil to Water Maximum Soil Contaminant Concentrations (MSCCs), but below Residential MSCCs. A groundwater sample collected from TMW-1 collected near the existing orphan UST basin (No. 36599) contained benzene at a concentration of 24,000 µg/L, which is above the North Carolina Groundwater Quality Standard 3 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx (2L Standard) and the DEQ-defined Gross Contamination Level (GCL). Various other petroleum constituents were detected in TMW-1 at concentrations above their respective 2L Standard, but below GCLs. A groundwater sample collected from TMW-2 (near the former UST basin associated with Incident No. 27627) contained several petroleum constituents and the chlorinated solvent trichloroethene (TCE; 42 µg/L) at concentrations above 2L Standards. TCE was not identified in soil samples from either of the two UST basins. 1,000-Gallon Orphan UST Assessment and Closure In September 2008, Mactec (formerly Terracon) began assessment and closure activities associated with the orphan UST identified during their May 2007 assessment. The 1,000-gallon orphan UST was removed in August 2008. After removal of the orphan UST, approximately 219 tons of petroleum-impacted soil was removed for off-Site disposal and excavation confirmation samples were collected for laboratory analysis. Laboratory results indicated TPH-gasoline range organics (GRO) was detected in a closure soil sample at 199 mg/kg, which was above the DEQ Action Level at that time of 10 mg/kg. Select soil excavation confirmation samples contained petroleum constituents at concentrations above Soil to Water MSCCs, but below Residential MSCCs. Subsequently, Mactec submitted a 20-day report and an Initial Abatement Action report in September 2008 that detailed UST removal and over-excavation activities (Incident No. 36599). Based on the August 2008 excavation confirmation sample results, a Phase I Limited Site Assessment (LSA) was required to address the orphan UST. In September 2008, Mactec installed one LSA soil boring/monitoring in the vicinity of the former orphan UST. Soil samples collected during the LSA did not identify petroleum-impacted soil near the orphan UST. The petroleum- related compounds benzene, naphthalene, n-butylbenzene, methyl-tert-butyl ether, di-isopropyl ether, 1,2,4-trimethylbenzene, and total xylenes were identified in groundwater at concentrations above 2L Standards but below GCLs. In September 2008, Mactec also collected four soil samples and installed one temporary well in the vicinity of the former USTs associated with Incident No. 27627. The soil analytical results indicated TPH – diesel range organics (DRO) was identified in one sample at a concentration of 20 mg/kg, which was above the DEQ Action Level at that time of 10 mg/kg. Laboratory analysis 4 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx of the groundwater sample indicated benzene above the 2L Standard but below GCLs. The Site was determined to be low-risk, and DEQ issued a conditional NFA pending the filing of a Notice of Residual Petroleum (NORP) for the property. The NORP includes a perpetual groundwater use restriction at the Site. 2013 Due Diligence and Additional Assessment H&H conducted Phase I and Phase II ESA activities at the subject Site in November 2013. A detailed account of the 2013 findings are documented in H&H’s Phase I Environmental Site Assessment (December 20, 2013) and Revised Phase II Environmental Site Assessment (February 16, 2015) reports. During Phase II assessment activities, a total of 15 soil samples from 10 soil borings, and three groundwater samples, were collected from the Site. TCE was detected in groundwater in the eastern portion of the Site at a concentration of 13.7 µg/L, which was significantly lower than the 2007 detection, but still above the 2L Standard of 3 µg/L. Soil analytical results indicated several metals above their respective Protection of Groundwater and/or Residential Health-Based Preliminary Soil Remediation Goals (PSRGs) including arsenic, cadmium, manganese, and thallium. However, the detected metals concentrations are within the range of published regional background levels for North Carolina soil and Site-specific background levels. Notice of Brownfields Property In 2015, as part of the redevelopment of the Site, the Prospective Developer (PD) at the time, MREC Vision Craighead, LLC, entered into a Brownfields Agreement (BFA) with DEQ. The BFA includes the former Abernethy Lumber parcel and former residential parcels located along Philemon Avenue and is referred to as the Craighead Road (Abernethy Lumber) Brownfields site (Brownfield Project#18015-14-060). 2015 Additional Assessment As part of the completion of the BFA, historical groundwater analytical data were compared to the DEQ Residential Soil Gas Screening Levels (SGSLs). Several VOCs, including both petroleum compounds and chlorinated solvents (specifically TCE), exceeded the screening criteria. 5 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx Brownfields Assessment In February 2015, H&H conducted additional assessment activities to evaluate the potential for vapor intrusion associated with historical detections of petroleum related compounds and TCE in groundwater. H&H collected additional soil samples from historically residential or undeveloped areas of the Site that would not likely have been impacted by historical lumber yard operations to evaluate the potential that the detected metal concentrations are consistent with naturally occurring or background concentrations at the Site. The results of H&H’s February 2015 additional assessment indicated the following: • Several VOCs, including TCE, were detected in soil gas samples collected at the Site. TCE was detected at concentrations exceeding Residential SGSLs in the north-central portion of the Site [138 micrograms per cubic meter (µg/m3)] and Non-Residential SGSLs in the northeastern portion of the Site (392 µg/m3). No other compounds were detected in soil gas at concentrations above vapor intrusion screening levels. • Six soil samples collected from the Site in areas which were not suspected to be impacted indicated the presence of naturally occurring or “background” metals. The data was utilized to calculate the range, mean, and two times the mean for each constituent. These Site-specific background metals calculations were then utilized to screen the soil analytical data collected in 2013. After excluding those concentrations which were below the calculated background mean, only arsenic and manganese in five soil borings were found to be at concentrations exceeding the applicable PSRGs. Of the detections, only arsenic in two samples exceeded the Industrial/Commercial PSRG. Test Pit Excavations In advance of proposed redevelopment activities at the Site, a geotechnical survey was performed by ESP Associates, PA (ESP) in May 2015. The geotechnical survey results indicated fill materials were present in the central and western portions of the Site at depths ranging from 2.5 ft to 8 ft bgs. H&H returned to the Site in June 2015 to conduct additional soil sampling and test pit excavation activities. The assessment activities were conducted to evaluate the nature of the fill 6 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx material and included the advancement of four test pit excavations across the Site and the collection of select soil samples from each test pit. The fill material observed was comprised of various construction materials including primarily bricks and concrete rubble. Soil samples were analyzed for VOCs, SVOCs, and Hazardous Substance List (HSL) metals plus hexavalent chromium. Soil analytical results indicated that no VOCs or SVOCs were detected at concentrations exceeding Residential PSRGs. The metals arsenic and manganese were again detected above PSRGs, but within the range of Site-specific background. Drip Line Lead Assessment In December 2016, H&H conducted drip line lead sampling activities at the former residential Site parcels to determine if lead-based paint from former residential structures impacted soils situated near the buildings. Soil sample analytical results indicated that lead concentrations in the soil samples collected from former residential structure drip lines were consistent with Site-specific background levels and were below Residential PSRGs. Amendment to Notice of Brownfields Property In May 2017, the PD filed an Amendment to the NBP and BFA for the Site with the Mecklenburg County Register of Deeds office. The Amendment revised the Brownfields Property boundary to include four additional former residential parcels located along Philemon Avenue. EMP H&H prepared an EMP for the subject Site which was approved by DEQ Brownfields in February 2017. As noted in Part 1 of the EMP Managing On-Site Soil, final grade sampling will be completed for areas at the Site that are not covered with buildings, sidewalks, asphalt -paved parking and driveways, or other impervious surfaces. Therefore, this work plan includes a scope of work to complete the final grade sampling activities, which are summarized below in Section 3. 7 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx 3.0 Scope of Work The proposed final grade soil sampling activities will be performed in general accordance with DEQ’s Inactive Hazardous Sites Branch (IHSB) Guidelines for Assessment and Cleanup (Guidelines) dated January 2020 and most recent version of the U.S. Environmental Protection Agency (EPA) Region IV Science and Ecosystem Support (SESD) Field Branches Quality System and Technical Procedures guidance. 3.1 Soil Sampling H&H proposes to advance shallow soil borings in areas on the Brownfields Property not covered by impervious surface (e.g., building foundations, sidewalks, hardscaping, asphalt surface parking, etc.) for collection of final grade soil samples. The soil borings will be advanced to a depth of 0 to 2 ft bgs from five (5) designated composite sample areas (CS-1 through CS-5) on the Site (see Figure 2). Each area will include five (5) soil borings per composite sample for a total of 25 soil boring locations on the Brownfields Property (see Table 1). The shallow soil borings will be advanced using a decontaminated hand auger and the soil from the borings will be field screened for the presence of odor, staining, and elevated photoionization detector (PID) readings. PID readings will be recorded and presented in the final report. Based on field screening results, one grab soil sample from each of the five (5) areas will be submitted for laboratory analysis of VOCs by EPA Method 8260. The VOC samples will be collected from the soil boring most indicative of potential impact. In addition, soil samples collected from the soil borings advanced in each of the five (5) designated areas will be composited in the field into one (1) composite soil sample per area using a stainless-steel bowl and spoon. One (1) composite soil sample from each of the five (5) designated areas will be submitted to the laboratory for analysis of SVOCs by EPA Method 8270, and HSL metals by EPA Methods 6020/7471 plus hexavalent chromium by EPA Method 7199. The HSL metals include antimony, arsenic, beryllium, cadmium, chromium, copper, lead, manganese, nickel, selenium, silver, thallium, and zinc by EPA Method 6020, and mercury by EPA Method 7471. 8 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx The soil samples will be placed in dedicated laboratory-supplied sample containers, labeled with the sample identification, date, and requested analysis, and placed in a laboratory supplied cooler with ice following sample collection. The sample coolers will be submitted to a North Carolina- certified laboratory (accompanied by the chain of custody and secured with custody seals) for the above analyses. 3.2 Quality Assurance/Quality Control H&H will collect one duplicate soil sample per every 20 laboratory samples for QA/QC purposes. Sufficient soil will be collected in the field for the duplicate sample and in order for the laboratory to perform a matrix spike and matrix spike duplicate (MS/MSD) analyses. The duplicate sample will be analyzed for the same compounds as the parent sample. In addition, H&H will request a Level II QA/QC data package from the laboratory and the laboratory will report values to the laboratory-specified method detection limits using J-flags. 3.3 Boring Abandonment and Investigation Derived Waste Investigation derived waste (IDW) generated during the sampling activities will be thin spread within the vicinity from which the boring was collected, unless there is evidence of significant impact (such as free product). If there is evidence of significant impact, the investigation derived waste from that area will be containerized in 55-gallon drums. If wastes are containerized, then a composite sample of the materials will be obtained for waste disposal purposes. Following sampling activities, the soil borings will be properly abandoned and the surface will be repaired similar to pre-sampling conditions. 9 S:\AAA-Master Projects\Stonehenge Real Estate Group - SHR\SHR-001 Former Abernethy Lumber\Final Grade Soil Sampling\Final Grade Sampling Work Plan.docx 4.0 Reporting Following completion of the soil assessment activities and receipt of the analytical data, H&H will prepare a report which describes the methods and results of the final grade soil sampling activities. The report will include a description of field activities, field screening results, a tabular summary of the analytical results in comparison to the PSRGs, risk calculations, boring logs in tabular form (will include boring IDs, field screening/PID results, and soil descriptions), figures depicting the sample locations, laboratory analytical reports including chain of custody, a discussion of QA/QC data, and conclusions based upon our assessment activities. The report will be sealed by a North Carolina Professional Engineer (PE) or Licensed Geologist (LG) and the firm PE/LG numbers will be provided.
