DEQ Brownfields concurs that soils disturbance actions to remove foundation related structures is restricted under LUR 3 and requires approval. Therefore, after review of the letter request describing Spectrum Mills, LLC planned work actions to only demolish the existing on-site building, along with our discussion, DEQ Brownfields hereby approves of the request for demolition contingent upon the following conditions: 1)Movement of any soils off-site, or from a known contaminated area to another area within theBrownfields Property, is prohibited. 2)Efforts should be made to keep the soils disturbance to a minimum within the “AREA OF SOILCONTAMINATION” depicted on Exhibit B (Plat) to the recorded Notice of Brownfields Property.Evidence of impacts observed outside of said area should be documented, and DEQ Brownfieldsshall be notified within 48 hours, if only by email, of any evidence of new impacts. 3)Any soils that are removed or disturbed within the “AREA OF SOIL CONTAMINATION” mustbe returned to the same area in the opposite order they were removed (first-out, last-in premise). 4)Ensure that impacted soils are not mixed with debris generated from building deconstruction. Anyfoundation material removed from the “AREA OF SOIL CONTAMINATION” suspected of being impacted by contaminants should be segregated and sampled for proper disposal. 5)Submit a final grade sampling plan within 14 days of the conclusion the completed demolition work for DEQ Brownfields review and approval. The plan should meet the Environmental Site April 28, 2020 Page 2 of 2 Spectrum Mills Demolition Approval Assessment Work Plan Minimum Requirements Checklist (see attached and available on our website) and also include a summary of the environmental professionals field observations during slab removal and photographic documentation of the final landscaped area. 6)Demolition must be conducted in accordance with all applicable legal requirements, includingwithout limitation those related to lead and asbestos abatement that are administered by the HealthHazards Control Unit within the Division of Public Health of the North Carolina Department ofHealth and Human Services. Please note that this approval is only for building demolition. Any future soil disturbance or construction of building slabs/parking lots may not occur at the site until a DEQ-approved Environmental Management Plan is established. Furthermore, any new construction is subject to the provisions of Land Use Restriction 4 regarding potential vapor intrusion. Be advised that this approval from the Brownfields Program does not waive any applicable requirement to obtain any necessary permits, licenses, or certifications for demolitions, nor does it waive any requirement to comply with applicable law for such activities.
