Lowery (plowery@summit-companies.com) Cc:Thompson, Jordan L; Harriger, Joselyn Subject:RE: [External] NC Brownfields Property - Shops@Innes (#20029-16-080) Alex:    Thank you for your time today and promptly addressing the issues at hand. As mentioned in our telephone  conversation, our Program has not received an annual certification (aka Land Use Restrictions Update or LURU)  in January 2019. Here is the last LURU we received on file:  https://edocs.deq.nc.gov/WasteManagement/edoc/1068375/20029_Shoppes%20on%20Innes_Centerlane%20I nnes_LURU.pdf?dbid=0&repo=WasteManagement&searchid=ddc1e059‐efea‐4c68‐be19‐bff8e33a29a2    To that end, our Program provides site‐specific LURU forms that should be used to complete these certifications.  Shoppes on Innes LURU form can be downloaded here:  https://edocs.deq.nc.gov/WasteManagement/edoc/765725/20029_Shoppes%20on%20Innes_LURU%20Model_ 20171010.docx?dbid=0&repo=WasteManagement&searchid=ddc1e059‐efea‐4c68‐be19‐bff8e33a29a2    The form should be completed, signed and notarized by the owner(s) of the Brownfields Property. Other  required reports should be attached or provided along with the LURU when it’s submitted. That being the case,  please provide us a schedule of when the 2020 LURU, along with all required documentation, will be submitted  to resolve the current non‐compliance items. The LURU and Reports should be submitted together and the  LURU should contain clarifying remarks as to the compliance of the owner/property with the LURs during the  missed 2018‐2019 reporting cycle.     Patrick:    LUR 11 details that a redevelopment summary report is to be supplied with the LURU. That report should cover  all environmental activities snice the last submittal. In this case, that report will be the first as we did not receive  a LURU or summary report in January 2019.  Therefore, please include all activities in the 2020 report since the  redevelopment started.     Additionally, LUR 9 specifies that a vapor mitigation work plan be approved by DEQ and thereby the property  sampled according to that plan annually. I suggest contacting Jordan Thompson with our Program to better  understand what should be included in the Vapor Mitigation Sampling Report. She can be reached at  Jordan.thompson@ncdenr.gov (704) 235‐2166.      Please feel free to contact me should either of you have questions or concerns about what is required by the  Brownfields Agreement. I also request that both of you provide an email acknowledgment that you have received this  correspondence.     Sincerely,    David    2 David Peacock Brownfields Compliance Officer, Division of Waste Management North Carolina Department of Environmental Quality 1646 Mail Service Center Raleigh, NC 27699-1646 910.796.7401 (Office) | 919.280.3408 (Mobile) David.Peacock@ncdenr.gov     Email correspondence to and from this address is subject to the North Carolina Public Records Law and may be disclosed to third parties.
