STATUS OF PERMIT:
Permit to Construct MSWLF Phase 3 and Operate MSWLF Phase 1, 2, and 3 (Calls 5A and 6A) was issued August 20,
2018. In accordance with North Carolina General Statute 130A-294(a2), permits for sanitary landfills and transfer
stations shall be issued for the life -of -site of the facility unless revoked.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Upper Piedmont Regional Landfill, 7304-MSWLF-1997, is permitted to operate Phase 1 (Cells 1A, 2A, 3A, and 4A),
Phase 2 (Cells 113, 213, 313, and 413) and Phase 3 (Cells 5A and 6A) of the municipal solid waste landfill.
The following items were observed during the inspection. Compliance issues are noted in bold and require action
within 30 days; I will re -inspect in May 2020 to observe progress.
1. UNRESOLVED: The upper tier of the north, west and southwest slopes of the landfill has little to no
vegetative cover due to reworking of the slopes that occurred in December 2019. The slopes were sliver

must be placed in these areas prior to establishing vegetative cover.

3. RESOLVED: Additional soil cover is needed at the southwest corner of the landfill. Mr. Gustin said the
facility has arranged to have a contractor cover the slope in the next week or two. The facility has been short-
staffed.
4. UNRESOLVED: All required sedimentation and erosion control measures must be installed and operable
to mitigate excessive on -site erosion and to prevent silt from leaving the area of the landfill unit during the
service life of the facility. The sediment basin on the southwest side of the landfill needs to be mucked out in
5. The facility is approved to accept an average maximum annual disposal rate is 660 tons per day, 365 days per
year, or 240,900 tons per year in accordance with the franchise approved by Person County Board of
Commissioners. The facility is looking to increase that amount to 780,000 tons per year but must first widen the
exterior road to create a turn lane. Prior to increasingtonnage, the facility must submit these changes to Solid
Waste Permitting Branch for approval.
6. The facility is permitted to use Posi-Shell, tarps or synthetic cover, and petroleum contaminated soil (PCS) as
alternative daily cover (ADC). Posi-Shell is used during the week and tarps on the weekends. Petroleum
contaminated soils are used as cover as they arrive. Soil cover is used at the completion of a lift. "Soil cover
shall be applied at a minimum of one time per week in accordance with Rule .1626 (2). Soil shall be applied
more frequently, if needed, to control nuisance, odor or vectors." Make sure you are covering with soil at
least every week.
