This Notice is part of a remedial action for the Site that has been approved by the Secretary (or his/her delegate) of the North Carolina Department of Environmental Quality (or its successor in function), as authorized by N.C.G.S. Section 143B-279.9 and 143B-279.11. The North Carolina Department of Environmental Quality shall hereinafter be referred to as "DEQ". NOTICE Petroleum product was released and/or discharged at the Site. Petroleum constituents remain on the site, but are not a danger to public health and the environment, provided that the restrictions described herein, and any other measures required by DEQ pursuant to N.C.G.S. Sections 143B-279.9 and 143B-279.11, are strictly complied with. This "Notice of Residual Petroleum" is composed of a description of the property, the location of the residual petroleum and the land use restrictions on the Site. The Notice has been approved and notarized by DEQ pursuant to N.C.G.S. Section 143B-279.9(b) shall apply to all of the above -described real property. These restrictions shall continue in effect as long as residual petroleum remains on the site in excess of unrestricted use standards and cannot be amended or cancelled unless and until the Mecklenburg County Register of Deed receives and records the written concurrence of the Secretary (or his/her delegate) of DEQ (or its successor in function). PERPETUAL LAND USE RESTRICTIONS Soil: Soil containing residual petroleum above applicable regulatory standard(s) remains on the site in the area identified in Figure 1, Attachment A. No soil shall be excavated or disturbed within 3 feet of the area identified in Figure 1 Attachment A except to remediate the soil in accordance with all applicable state and federal statutes, regulations and guidelines. Groundwater: Groundwater from the site is prohibited from use as a water supply. Water supply wells of any kind shall not be installed or operated on the site. ENFORCEMENT The above land use restriction(s) shall be enforced by any owner, operator, or other party responsible for the Site. The above land use restriction(s) may also be enforced by DEQ through any of the remedies provided by law or by means of a civil action, and may also be enforced by any unit of local government having jurisdiction over any part of the Site. Any attempt to cancel this Notice without the approval of DEQ (or its successor in function) shall be subject to enforcement by DEQ to the full extent of the law. Failure by any party required or authorized to enforce any of the above restriction(s) shall in no event be deemed a waiver of the right to do so thereafter as to the same violation or as to one occurring prior or subsequent thereto. (Cedar Rock) is pleased to submit this report describing activities and results for the in -place abandonment of two USTs located at 800 Mohigan Street in Charlotte, North Carolina. The UST abandonments were performed on January 22, 2020. Included in this report are project documents consisting of a disposal manifest and photographic documentation. This report should be kept with other documents pertaining to the residential property. Both USTs were found to have leaked, and significant soil contamination was detected beneath one of the USTs during a site inspection performed on December 19, 2019. The release was reported to the Department of Environmental Quality (DEQ) using a UST-61 form on January 3, 2020. Although the State no longer requires further assessment of the contamination, the State does require the filing of a Notice of Residual Petroleum (NRP) prior to conveying the property to another party. The NRP includes land use restrictions prohibiting any disturbance of site soils within a specified radius of the estimated extent of soil contamination, and prohibits the use or installation of any water supply wells on the property. Cedar Rock filed the NRP on January 14, 2020. The DEQ will issue a Conditional Notice of No Further Action (NFA) letter within the next few days. Upon receipt of proof that the local officials and adjacent property owners have been notified of the release by receiving a copy of the Conditional NFA letter, and that the NRP has been filed, the DEQ will reissue the NFA letter with no conditions to officially close out the petroleum release incident. Payne, L.G. Geologist ii 1.0 INTRODUCTION Cedar Rock Environmental, P.C. (Cedar Rock) was contacted by Mr. Wade Chipps of Charlotte, North Carolina to abandon in -place two underground storage tanks (USTs) located at 800 Mohigan Street in Charlotte, North Carolina. The USTs were first inspected on December 19, 2019. An inactive UST (T I) was discovered to be located parallel to and centered approximately 4.3 feet off the northwest foundation wall and about 10 feet southwest of the northern foundation corner of the house. Both the fill and vent pipes of T 1 were observed to be intact. The depth to the top of the UST is approximately 18 inches below land surface (bls). The UST has a length of about 75 inches with a diameter of approximately 46 inches and a capacity of about 540 gallons. The UST was measured to contain approximately 181 gallons of fluid. White flagging was installed to mark the ends of the UST. Once the orientation of the UST (TI) was determined, two soil borings were performed, one at each end of the UST using a 3.25-inch diameter stainless steel hand auger. The soil boring at the northeast end of the T 1 was advanced to a depth of approximately 6.6 feet bls, about 1.3 feet below the bottom of the UST. No soil contamination was observed in this boring. A second soil boring was performed at the opposite end of T1. A slight petroleum odor was observed at a depth of approximately 4.8 feet and exhibited local discoloration indicating that some tank leakage had occurred. The soil at the base of the boring at a depth of 6.6 feet bls exhibited no petroleum odor suggesting T 1 is in the early stages of leakage but has not yet significantly impacted the underlying soils. The native soil underlying T 1 consists of a reddish -brown sandy silt. A metal detector was used to survey the outside perimeter of the house where USTs are most likely to be located. In such manner, a second UST (T2) was discovered to be located parallel to and centered approximately 6.0 feet off the southwest foundation wall and about 11.2 feet southeast of the western foundation corner of the house. Both the fill and vent pipes of T2 were missing. The depth to the top of T2 is approximately 19 inches below land surface (bls). The UST has a length of about 98 inches. No access was available to measure tank contents on December 19, 2019. White flagging was installed to mark the ends of the UST. UST T2 is likely to be the original UST installed with the oil heat system. UST T 1 would probably have been installed to replace T2 when it began to take on water through corrosion holes in the UST. During abandonment activities on January 22, 2020, the diameter of T2 was measured to be approximately 42 inches giving a capacity of about 590 gallons, and it was measured to contain approximately 20 gallons of fluid. Once the orientation of the UST (T2) was determined, a single soil boring was performed at the northwest end of the UST. The soil boring was advanced to a depth of approximately 6.8 feet bls, about 1.9 feet below the estimated bottom of the UST. A moderate petroleum odor was observed in the soils from a depth of approximately 5.0 to 6.8 feet bls suggesting the UST has significantly impacted the underlying soils. The native soil underlying T2 consists of a light brown sandy silt. 2.0 PROJECT The in -place abandonments of the USTs were performed on January 22, 2020. The abandonments consisted of the hand excavation of the soils overlying the northeastern end of T1, and the northwestern end of T2, to expose the topside of each tank. A hole approximately 1.5 feet in 1 diameter was then cut on the top of each UST to allow for removal of the tank contents, cleaning and visual inspection of the UST interior, and subsequent filling. Each tank was pressure washed to remove all residual petroleum sludge. Residual oil in the fuel lines was also removed by vacuum. The fuel lines were cut and crimped closed at the foundation wall of the crawlspace area. A total of approximately 243 gallons of fluid and sludge (including rinsate) were removed from the two USTs. The fluid disposal manifest for the tank contents is included in Appendix A. After the interior of each UST was cleaned, each tank was then entirely filled with an excavatable flowable fill cement slurry.
