HomeMy WebLinkAboutMO-9433_40867_G_C_20190131_Site Visit 1-28-2019 & Meeting NotesFuel Oil Release Remediation Plan Rocky River Presbyterian Church On January 28, 2019, a meeting was held regarding release of fuel oil during a delivery to Rocky River from Barefoot Oil on December 20, 2018 Present were: Trudy Beverly of NC Department of Environmental Quality; King McCachern, Jim Rockel and Jim Pharr of Rocky River Presbyterian Church; Rob Barbour and Hunter Henley from Barefoot Oil regarding During this meeting, parties agreed to further explore contamination limits and remediate further where applicable. It was generally agreed that surface areas which had been excavated downhill from the tank are remediated to acceptable levels. Areas of concern are: 1) Surface area within the cemetery that were not excavated for remediation. 2) Soil beside and below the tank adjacent to the heating room (basement). 3) Odor intrusion to the sanctuary. 4) Drains leading from the heating basement may have transferred contamination from the room but the terminus is not known. 5) Stability of sanctuary foundation during excavation to remove contamination. Actions needed to accomplish the agreed upon course of work are: 1) Barefoot Oil will assign a plumbing company to check for heating basement floor drain routing and contamination. This will be attempted with a tape to determine if piping is open and to check for contamination return. If this method does not work effectively, a sewer type camera will be engaged to explore. a. If contamination is identified in the drain, applicable remediation plans will be made and completed. 2) Contamination is present in the cemetery however all parties agree that: a. No environmental concerns are present b. Grass that has been killed should be replanted repeatedly until such time as it continues to grow and thrive. Bioremediation will occur with the grass. c. Barefoot Oil will cover costs of reseeding efforts until grass land cover is reestablished. 3) Contamination beside and below the tank will be evaluated. 4) RRPC has initiated efforts to install a gas fired furnace and remove the fuel oil tank. 5) Once the fuel oil tank is removed an assessment will be made as to presence of fuel. The professional making this assessment will attempt to discern fresh fuel from the overfill release from oil released in another manner, i.e. from degradation of the tank (if present). 6) Excavation will be supervised by an engineer appointed by RRPC and compensated by Barefoot. The purpose of this is to prevent damage to the sanctuary structure. 7) Excavated soil will be retained on -site for qualification. New and older contamination will be separated to the extent possible. Rocky River is responsible for contamination from tank degradation while Barefoot is responsible for contamination brought by the fuel release. 8) Masonry on the furnace basement wall will be cleaned and sealed to reduce in transfer of fuel oil currently present in the masonry. Work on the outside will be completed first then on the inside. 9) Backfill for the tank pit will be compacted as prescribed by the engineer. If needed, Barefoot agrees to provide concrete for this. Remediation goal for this project is to leave the property in pre -spill condition. Send all suspicious email as an All, Jim's e-mail is accurate to the extent of everything we discussed on site this past Tuesday. We agree to the responsibility of the tasks as listed in Jim's e-mail, and have no problem being financially responsible for those tasks. Steve Waller was able to investigate the floor drains this am, and there was no discovery of any presence fuel oil in the floor drains, or in the "pee traps" in the drains. There was also no evidence, as best Steve Waller could determine, to indicate that enough fuel entered the drains to migrate away from the immediate area under the furnace room. We were prepared to put one coat of basement sealer on the inside wall, to attempt to eliminate the odor, of fuel oil, coming from the staining on the inside wall of the furnace room. Jim and I discussed this on the phone, and it was determined a better course of action would be to clean the inside of the wall with a non-flammable degreaser, and wait to seal the inside wall, after the outside of the wall is sealed, post tank removal. This will allow any fuel that may be permeating through the wall to continue to make its way through the wall, rather than be "trapped" in the brick. We also spread several bags of lime in the tank and vent area, to help eliminate any odor that may be a result as any fuel soiled dirt in close proximity to the outside heat/AC units. We feel those units may be pulling in odor when they come on, thus making its way to the Sanctuary and inside areas of the church. At this point, we will wait for RRPC to schedule the tank removal, unless we hear otherwise, that there is something we can do to help with anything that may have been overlooked, or any problems that may arise between now and the tank removal, that are related to the spill. If RRPC seeds and straws the new soils placed in the excavated areas, or areas that the grass may have been kilted by the fuel spill, we will promptly reimburse those costs as we are provided invoices. Additionally, we will reimburse RRPC for all fuel oil purchased from Barefoot Oil Company that is pumped out of the tank prior to its removal. We will reimburse that fuel at the cost per gallon it was purchased at. Additionally we will not charge any fees related to any labor or cost we incur to pump that fuel oil out. One last thing I would like to mention is that Barefoot Oil Company is willing to transport the newly contaminated soils that are excavated as a result of the spill, to our location, to stage on plastic, and cover with plastic, until the lab results indicate the soils are within the acceptable limits as determined by NCDEQ, if that is acceptable to RRPC and NCDEQ. Additionally, we will transport and contain up to 25 cubic yards of soils to our facility, that appear to be a result of any older historical spills, at no charge to RRPC, so that RRPC does not have to stage and contain those soils on their property on Rocky River Road, while lab results are being done. If any soils from historical spills are contaminated above NCDEQ acceptable limits, will also contain and store those soils at our facility until they are below required limits, if desired by RRPC, at no cost to RRPC. If the quantity of those soils exceeds 25 cubic yards, we will be glad to offer assistance on those soils, as best we can, to be determined by the quantity, if that is acceptable to all parties.
