The EMP is a typical requirement of a Brownfields Agreement (BFA). Its purpose is to clarify actions to be taken during the demolition and construction at Brownfields properties in an effort to avoid delays in the event of the discovery of new contamination sources or other environmental conditions. The EMP provides a means to document redevelopment plans and environmental data for each applicable environmental medium to inform regulatory-compliant decision-making at the site. As much detail as possible should be included in the EMP, including contingency planning for unknowns. Consult your project manager if you have questions. Prospective Developers and/or their consultants must complete and submit this form and all pertinent attachments, see checklist below, to their Brownfields project manager prior to any earthmoving or other development-related activities that have the potential to disturb soil at the Brownfields Property, including demolition. For the resultant EMP to be valid for use, it must be completed, reviewed by the program, signed by all parties working on the project, and approved by the Brownfields project manager. Failure to comply with the requirements of the EMP could jeopardize project eligibility, or in the event of a completed agreement, be cause for a reopener So that the EMP provides value in protecting brownfields eligibility and public health, the preparer shall ensure that the following steps have been completed prior to submitting the EMP for review. The Site is currently developed with an asphalt/gravel covered parking lot and two primarily vacant retail buildings. A commercial building (former K-Town Furniture) in the southwestern portion of the Site was recently demolished. The Site is bisected by Wellness Way/W. A Street and Oak Avenue. Parcel 56145073590000 and a portion of parcel 56145083040000 currently are subject to a brownfields agreement entered into by Castle & Cooke North Carolina, LLC for an adjacent property (NCBP #0929-05-13) (the “Research Campus Brownfields Agreement”). This area is generally referred to in the Research Campus Brownfields Agreement as the “water vault” area. Current redevelopment plans include removal of asphalt and gravel surfaces from the parking lot; City street closures and removal of asphalt/concrete surfacing; decommissioning/relocation of utilities beneath Wellness Way/W. A Street and Oak Avenue; building demolition and removal of concrete foundations in the eastern and southeastern portions of the Site; grading the Site; construction of a minor league baseball stadium and associated walkways and entrances in the western portion of the Site; and construction of one level of subgrade parking beneath two mixed use commercial/retail buildings in the eastern and southeastern portion of the Site. Residential apartments are planned to be constructed above the mixed use commercial/retail spaces. PART 1. Soil – Please fill out the information below, using detailed site plans, if available, or estimate using known areas of contaminated soil and a conceptual redevelopment plan. Provide a figure overlaying new construction onto figure showing contaminated soil and groundwater locations. 1) Known or suspected contaminants in soil (list general groups of contaminants): In January and March 2018, H&H advanced 32 soil borings to depths of up to 30 feet below ground surface (bgs) at the Site. Seventeen soil borings were advanced within the footprint of the proposed baseball stadium (SB-1 though SB-12 and B-1 through B-5) and 15 soil borings (SB 13 through SB-26) were advanced in the eastern and southeastern portions of Site in the vicinity of the proposed subgrade parking and/or commercial/retail building areas. Sample locations are shown on the attached Figure 1, and the sample analytical methods are shown in Table 1. Laboratory analytical results of the soil samples indicate the presence of benzo[a]pyrene above the Inactive Hazardous Site Branch (IHSB) Residential and Industrial/Commercial Preliminary Soil Remedial Goals (PSRGs) in soil samples B-1 (0-2 ft) and B-1 (6-8 ft). Benzo[a]pyrene was detected above the IHSB Residential PSRG in soil samples SB-17 (3-3.5 ft), SB-21 (0.5-1.5 ft), B-3 (0-2 ft), and B-4 (11-13 ft). Benzo[a]anthracene, benzo[b]fluoranthene, and indeno[1,2,3- cd]pyrene were detected above their IHSB Residential PSRGs in soil samples B-1 (0-2 ft) and B-1 (6-8 ft). Dibenz[a,h]anthracene was detected in soil sample B-1 (6-8 ft) above the IHSB Residential PSRG. Hexavalent chromium was detected above the IHSB Residential PSRG in soil sample SB-21 (0.5-1.5 ft). With the exception of naturally occurring metals (i.e., arsenic), no other compounds were detected above the Industrial/Commercial or Residential PSRGs. However, several other compounds [including tetrachloroethylene (PCE) in SB-2 (2-4 ft) and SB-9 (2-4 ft), benzo[a]anthracene in SB-17 (3-3.5 ft), and selenium in SB-13 through SB-26 (at depths ranging from 0.5 to 3.5 ft bgs] were detected above their respective IHSB Protection of Groundwater (POG) PSRGs. A summary of the soil analytical data is provided as Table 1. 2) Depth of known or suspected contaminants (feet): Laboratory analytical results of the soil samples indicate the presence of benzo[a]pyrene above the IHSB Industrial/Commercial Preliminary PSRG in soil samples B-1 (0-2 ft) and B-1 (6-8 ft). Benzo[a]pyrene was detected above the IHSB Residential PSRG in soil samples SB-17 (3-3.5 ft), SB-21 (0.5-1.5 ft), B-3 (0-2 ft), and B-4 (11-13 ft). Benzo[a]anthracene, benzo[b]fluoranthene, and indeno[1,2,3-cd]pyrene were detected above their respective IHSB Residential PSRGs in soil samples B-1 (0-2 ft) and B-1 (6-8 ft). With the exception of naturally occurring 8 EMP Version 2, June 2018 metals (i.e., arsenic), no other compounds were detected above the Industrial/Commercial or Residential PSRGs. 3) Area of soil disturbed by redevelopment (square feet): In order to achieve the desired grade for the baseball stadium portion of the project, the western portion of the Site (approximately 6.39 acres or 278,723 thousand square ft) will be graded. Grading activities will be conducted utilizing grading equipment (i.e., backhoes, front end loaders, excavators, bull dozers, etc.) and the Site development contractor will implement best management practices (i.e., implementation of silt fencing and berming) to manage soil on-site during redevelopment activities. A grading plan and cut and fill maps for the baseball stadium portion of the Site are included as Appendix A. A grading plan for the proposed mix use commercial buildings in the eastern and southern portions of the Site is not yet available. Once that plan is available, an addendum to this EMP may be needed. 4) Depths of soil to be excavated (feet): Approximately 5 to 13 ft of soil will be excavated to construct the field of the baseball stadium in the western portion of the Site. Near the completion of site grading activities, the stormwater retention pond will be filled during site grading activities for the purpose of achieving the desired level grade. 5) Estimated volume of soil (cubic yards) to be excavated (attach grading plan): Based upon the grading plans, it is anticipated that approximately 25,200 net cubic yards of soil will be excavated on-site to achieve the desired grade for the baseball park. This volume includes approximately 10 ft of soil that was excavated in December 2017 and January 2018 to construct a stormwater retention pond in the southwest portion of the Site in accordance with the Site’s approved Erosion and Sediment Control Plan. Soil excavated from the stormwater retention pond area was stockpiled on an asphalt-covered surface in the western portion of the Site. Soil stockpile analytical results indicate concentrations of benzo[a]anthracene, benzo[a]pyrene, and dibenz[a,h]anthracene above IHSB Residential PSRGs and concentrations of PCE, naphthalene, p-isopropyltoluene, 1,2,4-trimethylbenzene, and 1,3,5-trimethylbenzene above the IHSB POG PSRGs. With the exception of naturally occurring metals (i.e., arsenic), no other compounds were detected above the Industrial/Commercial, Residential, or POG PSRGs. The stockpiled soil was covered with plastic sheeting. A summary of the soil stockpile analytical data is included as Table 2. The covered soil stockpiles remain on-site and none of the soil disturbed as the result of grading activities has been exported from the Site. The covered soil stockpile is estimated to contain approximately 4,300 cubic yards. Thus, the total volume of soil which is anticipated to be excavated and exported from the Site is 25,200 net cubic yards of soil. 9 EMP Version 2, June 2018 6) Estimated volume of excavated soil (cubic yards) anticipated to be impacted by contaminants: Based upon previous soil assessment data, approximately 10,300 cubic yards of impacted soil is estimated to be present on-site which will be excavated during redevelopment activities for the baseball stadium. This volume includes approximately 6,000 cubic yards of impacted soil in the vicinity of soil boring B-1 adjacent to the former water vault where average cuts are anticipated to be approximately 8 ft and the approximate 4,300 cubic yards of impacted soil which is stockpiled on the western portion of the Site. A grading plan and cut and fill maps are not yet available for the proposed mixed used commercial/retail buildings in the eastern and southeastern portions of the Site. Once that plan is available, an addendum to this EMP may be needed. 7) Estimated volume of contaminated soil expected to be disposed of offsite, if applicable: It is anticipated that approximately 10,300 cubic yards of impacted soil will be disposed of off- site. Any soil sent off-site will be disposed of in accordance with applicable regulations. Part 1.A. The export fill from the Site is proposed to be transported to the adjacent former Pillowtex Plant 1 Brownfields Property (NCBP #09029-05-13) for use as fill in a former sediment basin located on the northern portion of the property. The former sediment basin is located less than a half a mile from the Site. The export fill is proposed to be transported to the former sediment basin using covered dump trucks. The export fill would be placed and compacted in 1 to 2 foot increments (i.e., lifts) in the former sediment basin. The export fill soil containing impacts above IHSB industrial PSRGs will not be placed within the top 2 ft fill in the sediment basin. A copy of the approved Erosion Control Plan and grading plan for placement of the export fill soil is included as Appendix C. A copy of the agreement between the City of Kannapolis and the owner of the adjacent former Pillowtex Plant 1 Brownfields Property for acceptance of the export fill from the Site is included in Appendix C. The soil impacts at the Site are similar in nature and concentration to soil impacts documented at the former Pillowtex Plant 1 Brownfields Property. For example, PAHs including benzo[a]pyrene at concentrations up to 0.69 mg/kg and arsenic up to 8.1 mg/kg have been documented on the receiving former Pillowtex Plant 1 Brownfields Property (See former Pillowtex Plant 1 Brownfields Agreement and referenced Environmental Reports therein). A soil characterization work plan for the collection and analyses of soil samples from the proposed excavation area has been submitted under separate cover. Part 1.D. Per EMP notification requirements, the NC Brownfields project manager will be notified within 48 hours of discovery of previously unknown contamination. PART 2. Hexavalent chromium by EPA Method 7196A or 7199A Please provide details on the proposed methods of managing the following commonly encountered issues during redevelopment of Brownfields Properties. In January and March 2018, H&H conducted Phase II ESA and Brownfields soil assessment activities at the Site. The results of the assessment activities indicate the presence of arsenic and PAHs above the IHSB Residential and Industrial/Commercial PSRGs and hexavalent chromium above the IHSB Residential PSRGs. No other compounds were detected above the Residential or Industrial/Commercial PSRGs. Because cuts are anticipated in the area of known soil impacts above the IHSB Residential and Commercial/Industrial PSRGs, the impacted soil will require proper off-site management during redevelopment activities. Although it is not anticipated that soil impacts will be encountered in other areas during construction activities, contractors may encounter unknown sub-surface environmental conditions that, if encountered, will require proper management. In the event that such conditions are encountered during Site redevelopment activities, the environmental actions noted below will be used to direct environmental responses. 1. During soil disturbance at the Site, the workers or contractors will observe soils for evidence of 23 EMP Version 2, June 2018 impacted soil that may not be suitable to leave in place in exposed areas at a residential use site. Evidence of potential impacted soil includes a distinct color, discoloration, strong odor, and/or observance of previously disposed materials of concern (i.e., chemicals, tanks, drums, etc.). Should any of the above be noted during Site work, the contractor will contact the project environmental professional to observe the suspect condition. If the environmental professional confirms that the material may be impacted, then the procedures below will be implemented. In addition, the environmental professional will contact the DEQ Brownfields project manager within 48 hours of discovery to advise that person of the condition. In addition, H&H will visit the construction Site to check for environmental concerns multiple times during Site work. Based on the results of laboratory analyses and specific operations planned in the vicinity of the environmental impacts, the DEQ Brownfields Program will be notified and additional sampling may be required. 2. If significant soil impact is encountered during grading and/or installation or removal of utilities, excavation will proceed only as far as needed to allow grading and/or construction of the utility to continue. 3. Suspect significantly impacted soil (i.e., does not appear to be associated with prior known soil contamination) excavated during grading and/or utility line installation or removal may be stockpiled and covered in a secure area on-site to allow construction to progress. Suspected impacted soil will be underlain by and covered with minimum 10-mil plastic sheeting. At least one representative sample of the soil will be collected per 800 cubic yards of stockpiled soil for analysis of total VOCs, SVOCs, and RCRA metals (including speciation for chromium). If the results of analysis of the sample indicate that the soil could potentially exceed characteristically, hazardous waste criteria, then the soil will also be submitted for Toxicity Characteristic Leaching Procedure (TCLP) analyses for appropriate compounds. Impacted soil will be managed in accordance with Paragraph 4 below. 4. Soil sampled in accordance with Paragraph 3 of this section will be handled in the manner described below based upon the laboratory analyses: i. If detectable levels of compounds are found which do not exceed the DEQ IHSB Residential PSRGs (other than which are attributable to sampling or laboratory artifacts or which are consistent with background levels identified by Hart & Hickman for metals) and the TCLP concentrations are below hazardous waste criteria, then the soil may be used on-site as fill without conditions. ii. If detectable levels of compounds are found which exceed the DEQ IHSB Residential PSRGs (other than which are attributable to sampling or laboratory artifacts or which are consistent with background levels for metals) and the TCLP concentrations are below hazardous waste criteria, then the soil, with DEQ’s written approval, may be used on-site as fill below a hardscape surface or beneath at least 2 ft of compacted clean soil. iii. Impacted soil may be transported to a permitted facility such as a landfill after the soil is profiled and accepted at the disposal facility. In the unlikely event that the composite sample data indicates concentrations above TCLP hazardous waste criteria, then the soil must be pre-treated on-site and/or transported off-site to a permitted disposal facility that can accept or treat hazardous waste. Copies of waste manifests will be provided to 24 EMP Version 2, June 2018 the DEQ Brownfields Program. Sampling data for potential impacted soil and the disposition of impacted soil will be provided to DEQ if and when the data becomes available. 5. If determined to be warranted, confirmation samples will be used to determine the appropriate corrective measure for soil beyond the excavation limits required for grading and/or utility line installation or removal. Such corrective measures are specified in the items below. 6. If surface water run-off gathers in an open excavation determined during construction that appears to be impacted, appropriate worker safety measures will be undertaken. The accumulated water will be allowed to evaporate, be tested and disposed off-site (if impacted), or be tested and discharged as typical construction stormwater (if not impacted above DEQ surface water standards) in accordance with applicable regulations. 7. In the event that soil within an excavation cannot be dried adequately for construction purposes using the methods described above, the soil may be amended with clean soil, aggregate, inert drying agents, and/or stabilizing agents to achieve the desired geotechnical qualities. Underground Storage Tanks: In the event that impacts associated with a UST release are found to be present on the Site, they will be addressed through the Brownfields Program. However, the methods used to remove the UST will be consistent with Section 5.2 of the NC DEQ UST Section Guidelines for Site Checks, Tank Closure, and Initial Response and Abatement for UST Releases. Sub-Grade Feature/Pit: If a sub-grade feature or pit is encountered and does not require removal for geotechnical or construction purposes, it will be filled with soil or suitable fill and construction will proceed. Where appropriate, the bottom may be penetrated before back filling to prevent fluid accumulation. If the pit has waste in it, the waste may be set aside in a secure area and will be sampled for waste disposal purposes for TCLP VOCs, TCLP SVOCs, and TCLP RCRA metals and disposed off-site at a permitted facility in accordance with applicable regulations, or the waste will be managed in accordance with Paragraph 3 above, whichever is most applicable based on the type of waste present. If the pit must be removed and the observed waste characteristics indicate the concrete may potentially be contaminated to a significant degree, the concrete will be sampled and analyzed by methods specified by the disposal facility. If buried piping is encountered and must be removed to allow construction to proceed, the contractor will inspect the pipe for fluids, collect the fluids where appropriate, and look for signs of a release using field methods. The collected fluids will be sampled for VOCs, SVOCs, and RCRA metals to determine appropriate disposition of the fluid. Buried Waste Material: 25 EMP Version 2, June 2018 If excavation into buried wastes or significantly impacted soil occurs, the contractor is instructed to stop work in that location and notify the environmental consultant. The environmental consultant will observe the materials and collected samples if warranted. In this event, confirmation sampling will be conducted at representative locations in the base and sidewalls of the excavation after the waste or significantly impacted soil is removed. The confirmation samples will be analyzed for VOCs, SVOCs, and RCRA metals (including speciation for chromium). Areas of suspected contaminated soil that remain at the Site after excavation is complete above the DEQ IHSB Residential PSRGs will be managed pursuant to this plan and incorporated into the Brownfields plat. Disturbed buried wastes will be sampled for waste characterization purposes and disposed off-site at a permitted facility in accordance with applicable regulations. Copies of waste manifests will be provided to the DEQ Brownfields Program. If determined to be warranted, confirmation samples will be used to determine the appropriate corrective measure for soil beyond the excavation limits required for grading and/or utility line installation or removal. Such corrective measures are specified in the items below. Re-Use of Impacted Soils On-Site: See Paragraph 4 of this section above. If unknown, impacted soil is identified on-site, management on-site can be considered after the project team provides the necessary information, outlined in Part 1.A. methodology(ies) employed for field screening, sampling and laboratory analysis of environmental media; 4. stockpiling, containerizing, decontaminating, treating, handling, laboratory analysis and ultimate disposition of any soil, groundwater or other materials suspected or confirmed to be contaminated with regulated substances; and 5. removal of any contaminated soil, water or other
