Dear Sirs:
Thank you for providing the Articles of Organization of Addison
Investments, LLC ("Addison"), confirming that Addison is a legal entity and,
therefore, a viable prospective developer ("PD") under the North Carolina
brownfields program. After reviewing the items included with your Letter of Intent
with respect to the requirements of the Brownfields Property Reuse Act of 1997,
we have determined that the following items from Appendix A are still necessary to
make a final determination regarding the project's eligibility for continued
evaluation for a brownfields agreement:
Item g) - The name, address, and telephone number of all parent companies,
subsidiaries, or other affiliates of Addison Investments, LLC. If
parent companies, subsidiaries, or other affiliates do not exist,
please provide a specific statement so stating.
Item j) - A more detailed statement regarding how Addison intends to
demonstrate that it has the financial means to fully implement a
brownfields agreement and assure the safe use of the property. A
bank reference or a Dunn & Bradstreet or similar financial
statement would suffice.
Once you have addressed these two items we can make an official
determination regarding the project's eligibility for continued evaluation for a
brownfields agreement.
The next step will be a detailed evaluation of all existing environmental and
other data needed to determine what additional work will be required to ensure that
the property is safe for the intended reuse. You have provided the S&ME Phase II
Environmental Site Assessment (Additional), dated October 21, 1999. Please
forward to my attention all other environmental reports and laboratory analytical
data from previous investigations performed at the site (e.g. the original S&M=
