Dear Mr. Bowser:
Amec Foster Wheeler Environment & Infrastructure, Inc. (Amec Foster Wheeler) formerly
known as MACTEC Engineering and Consulting, Inc. (MACTEC)prepared the subjectreporton behalf of our client, New Tryon, LLC in 2007 for work performed at the subjectpropertyin Charlotte, North Carolina.In 2007, this report was prepared and submitted to our
client, but was not provided to North Carolina Department of Environmental Quality
(NCDEQ), Division of Waste Management (DWM), UST Section for review.
Amec Foster Wheeler recently provided electronic copies of the report to the UST Section
under a separate cover.However, you requested that an original signature paper copy of
the report sealed by a licensed professional be provided in accordance with the USTSectionguidelines.Neither the client nor Amec Foster Wheeler could locate an original
signature paper copy of the report sealed by a licensed professional.
Since that time, MACTEC was acquired by Amec Foster Wheeler, making reproduction of
the report infeasible.For this reason, Amec Foster Wheeler requests that the UST
Section accept this photocopy of the report (dated February 5, 2007) with this cover letter
signed and sealed by the licensed geologist supervising the work in 2006 and 2007.
New Tryon, LLC, owner of the subject referenced property (but not the tank
owner/operator),wishes to obtain Notices of No Further Action relative to these tanks andrespectfully requests your review of this report.
