Per the March 22, 2018 notice letter to Jim Rudder of the Brownfields Program, Cormetech, via merger, is the current owner of the Site. As the new owner of the Site, Cormetech intends to be in compliance with the land use restrictions in the Brownfields Agreement. This letter is to summarize events relating to land use restriction 4 concerning soil disturbances ("LUR 4") in the Notice of Brownfields for the Site. Emergency Repair of Water Line and Replacement of Fire Hydrants in 2018 In the last few months of 2018, Cormetech had to make an emergency repair to a fire suppression line and replaced three fire hydrants. Between 10/24/18 through 10/31/18, it was discovered the water line feeding the fire system behind the Phoenix Building was leaking water to the surface. The water line had to be repaired immediately to support fire protection. According to the maintenance department, the line had to be replaced which resulted in temporarily removing soil to a depth of 4 to 5 ft along an area 45 ft long by 5 ft wide. All soil was replaced. No excavated soil was removed from the Site or relocated on Site. The area of this emergency repair is marked as "B" on the attached Brownfields Survey Plat. Additionally, Cormetech recently had three fire hydrants replaced at the end of November, early December, 2018. As stated in the attached summary from the contractor that performed this work, the fire hydrants were buried 3.5 to 4 feet in depth, and all soils were reused as backfill for the new fire hydrants. The contractor included a diagram of the location of the fire hydrants. Mr. David Peacock NC Department of Environmental Quality January 16, 2019 Page 2 Emergency Repair of Water Line in December 2017 Cormetech also wanted to make DEQ aware of another emergency repair at the Site that occurred in December 2017, a few months before STEAG Energy Services (the prior property owner) was formally merged into Cormetech on March 1, 2018. On December 10, 2017, a water line for fire suppression burst. Again, according to the maintenance department, this water line needed to be immediately repaired to provide water pressure to the fire system and to stop the water from washing out soil under the concrete. The maintenance department reports that to access and replace the pipe, soil was temporarily removed to a depth of approximately 8 to 10 ft deep, along a 17 ft by 22 ft area. Again, the soil was replaced and no excavated soil was removed from the Site or relocated on Site. The area of this emergency repair is marked as "A" on the attached Brownfields Survey Plat. While all three of these events involved disturbing soil, the information in the Brownfields file and the Brownfields Agreement show that accessing the soil during these events posed no risk. The Brownfields Agreement in paragraph 6.b. states that the one soil contaminant found on Site, Arsenic, was below the residential risk-based standard and is "therefore not a concern at the Property." The sample for the Arsenic is also located in an area away from, and to the south of, the described work. No other soil impacts are reported for this Site. Further, no soil was removed from the Site, or relocated on the Site. Moreover, the December 12, 2013 Brownfields' decision memo observes that because no soil impacts have been reported at the Site, the likelihood of exposure is very low. Finally, groundwater was documented in the 2013 Hart & Hickman report between 18.9 ft and 21.07 ft below ground surface and thus would not have been encountered during this work. Cormetech has worked with its maintenance department to put into place procedures to address this particular LUR 4 in the future. Based on the language in the Brownfields Agreement and the decision memorandum concerning the low risk of soil exposure at the Site, and considering the facts surrounding the repairs, Cormetech requests that DEQ approve the described work with no further work required. To that end, Cormetech proposes to complete the LUR 4 for 2018 as follows: LUR 4.-No activity that disturbs soil on the Property may occur unless and until DENR states in writing, in advance of the proposed activity, that said activity may occur if carried out along with any measures DENR deems necessary to ensure the Property will be suitable for the uses specified in LUR I above while fully protecting public health and the environment, except in connection with, mowing and pruning of above-ground vegetation, landscape plantings that do not exceed 18 inches in depth; and,for emergency repair of underground infrastructure,provided that DENR shall be given written notice (if only by email) of any such emergency repair no later than the next business day, and that any related assessment and remedial measures required by DENR shall be taken. 0 In compliance L7 Out of compliance Mr. David Peacock NC Department of Environmental Quality January 16, 2019 Page 3 Remarks: Cormetech makes this certification upon best information and belief after reasonable investigation, and approval from the DEQ concerning emergency repairs of water lines and the replacement of fire hydrants as explained further in Cormetech's letter to DEQ dated January 16, 2019.
