Both sites are barren yet they possess beautiful river frontage and flat, desirable land.
They have both sat for years without any activity and there are no planned uses that I
am aware of.

The Phase II Environmental Reports indicate that there are a variety of contaminants in
the soil that will need to be addressed before development of almost any kind on the
site.

E. In what way(s) is the redevelopment of the property difficult or 'mpossible without a
brownfields aareement (attach any supoortino documentation such as letters form lending
institutions)?
In preliminary discussions, both Billy Clarke and Tracy Wahl have indicated that a
Brownfield Agreement would be needed for a school on the proposed site. Also, most
banks will not finance a construction loan without a Brownfield Agreement in place.
Also, as a small non-profit school, the French Broad River Academy does not want to
ever be in a position where we have to assume liability for the cleanup of the site.
F. What are the planned () of the redeveloped brownfields property to which the PD will
commit? Be as specific as specific as possible.
The site will be developed into a campus for the French Broad River Academy GIRLS
program. Our curriculum, conservation work, and outdoor education program
are primarily focused on the French Broad River and the surrounding watershed. (see
attached conceptual bulletin)
G. Current tax value of brownfields property: 1420 Riverside Drive-$338,700

List and describe the public benefits that will result from the property's redevelopment. Be
as specific as possible. (Examples of public benefits for brownfields projects include job
creation, tax base increases, revitalization of blighted areas, preserved green space,
preserved historic places, improving disadvantaged neighborhood quality-of-irfe related
retail shopping opportunities, affordable housing, environmental cleanup activities or set
asides that have community or environmental benefits. In gauging public benefit, NCBP
places great value upon letters of support fmm community groups and local government
that describe anticipated improvements in quality of life for neighboring communities that
the project will bring about. The inclusion of such support letters with this application is
recommended and encouraged 1
The project will create jobs for the architects, engineers, general contractors, and
builders involved in the project. It will also create at least 2 to 3 more jobs for FBRA,
as well as sustain the existing 14 full-time positions and one part-time position. The
new location will also result in exposure to the burgeoning Woodfin riverfront district
by our more than seventy-two different families from all over the region. FBRA will
improve the site by removing invasive species, protecting riparian vegetation, and
installing rain gardens and wetlands areas. Any potential remedial efforts will serve
as an educational opportunity. Securing a riverfront campus is critical for the
sustainability and success of the GIRLS program.
Special Note: Please describe all environment -friendly technologies and designs PD
plans to utilize in its redevelopment strategy. For example, environment friendly
redevelopment plans could include: Leadership in Energy and Environmental Design

(LEED) Certification, green building materials; green landscaping techniques such as
using drought resistant plants; energy efficient designs, materials, appliances,
machinery, etc.; renewable sources of energy, and/or recycling/reuse of old building
materials such as brick or wood.
LEED certification will be explored as part of the proposed construction budget, as
well as Xenscape landscaping. We will explore solar hot water and electricity
options, and reuse old brick and wood if possible. See the attached Environmental
Vision Statement for more information about FBRA's commitment to improving the
environment.

notarized original of the unmodified model brownfields affidavit provided by NCBP, that
it did not reuse or contribute to contamination at the property and that it meets all other
statutory eligibility requirements. (Note: The form to use for this affidavit is attached to
this application. An original hard copy of this affidavit must be filled out, signed,
notarized and submitted with this application.)

III. Protective Measures
I am prepared to take steps necessary to make the property suitable for its planned uses while
fully protecting public health and the environment. I propose that NCBP consider a brownfields
agreement that will make the property suitable for the planned use(s) through the following
mechanism(s) (check all that apply):

■ Engineered Controls (e.g., low permeability caps, vapor mitigation systems, etc)
■ Land use restrictions that run with the land that will restrict or prohibit uses that
are unacceptable from a risk assessment/management perspective. (Important Note: In
arty final brownfields agreement generated by the NCBP, land use restrictions will
ultimately come with the continuing obligation to submit an annual certification that the
Land Use Restrictions are being complied with and remain recorded at the applicable
register of deeds office.)
IV. Fees
In connection with a brownfields agreement, the Act requires that the developer pay fees to
offset the cost to the Department of Environmental Quality and the Department of Justice. In
satisfaction of the Act, the following fees apply to a brownfields agreement that is developed for
this project under the standard program, subject to negotiation of the brownfields agreement:
a. A $2,000 initial fee will be due from the applicant PD when both of the following occur:
1) NCBP receives this application, the affidavit and proposed brownfields agreement, AND
2) NCBP notifies the applicant in writing that the applicant PD and theproject are eligible for
participation in the NCBP and continued negotiation of a brownfields agreement.
b. A second fee of $6,000 will be due from the PD prior to execution of the brownfields
agreement. Should the prospective developer choose to negotiate changes to the agreement
that necessitate evaluation by the Department of Justice, additional fees shall apply.
c. Any addendum/modifications to the BFA or NBP after they are in effect will result in an
additional fee of at least $1,000,
d. In the unexpected event that the environmental conditions at the property are unusually
complex, such that NCBP's costs will clearly exceed the above amounts, NCBP and PD will
negotiate additional fees.
e. Additional fees are charged for the Ready for Reuse and Redevelopment Now programs.

Caroline,
This site (1430 Riverside) was part of a Solid Waste Section tire abatement action several years ago.
After the tires were removed, it revealed the large amount of waste still in place and the Section had
trouble initiating additional remedial cleanup action sue to property ownership changes, etc.
Essentially this site could be deemed an unpermitted landfill.
We likely have files if needed as Brownfield program works towards an agreement on this site that
may be helpful in understanding the waste types and any remedial action including waste removal
that may be beneficial to the proposed redevelopment of this site

This is an internal courtesy notice to inform your program that the DEQ Brownfields Program has
received a Brownfields Property Application submitted by French Broad River Academy, Inc. as the
Prospective Developer (PD) seeking entry into the Brownfields Program for the following property:

We are now evaluating French Broad River Academy, Inc. and the subject property for eligibility for
entry into the Brownfields Program. The property was previously utilized as an auto salvage, auto
repair shop, and recycling center (at least 1997-2009). There is known metals contamination in soil
and groundwater. Low VOC/SVOC levels are also present in soil on the 1420 Riverside Drive
property. The PD plans to redevelop the property into a school.

Under the Brownfields Property Reuse Act, only entities that did not cause or contribute to the
contamination at the property are eligible to enter the program. The applicant PD listed above have
asserted that: 1) they have not caused or contributed to the contamination at the property, and 2)
they have substantially complied with laws, regulations, and rules for the protection of the
environment. If you have any information to suggest otherwise, please provide that information to

A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or
enforce against any and all parties who caused or contributed to the contamination at the
property. In fact, the BFA will require the developer to provide access to the property to any
party doing work under any DEQ program.
A BFA provides liability protection only to a non -causative redeveloper of the property. The
developer will be required to make the property safe for its intended re -use. Cleanup to
unrestricted use standards will not be required unless deemed necessary based on the
developer's proposed use of the property. Furthermore, the BFA will not change the developer's
responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.)
as required under applicable law.

The North Carolina Department of Environmental Quality (DEQ) has received and reviewed
your September 11, 2017 Brownfields Property Application (BPA) submitted by Will Yeiser on behalf
of French Broad River Academy, Inc as a Prospective Developer seeking a Brownfields Agreement
regarding the Brownfields Property. Upon review of the BPA with respect to the requirements of the
Brownfields Property Reuse Act of 1997, DEQ has determined that this project is eligible for entry into
the North Carolina Brownfields Program (NCBP) and for continued evaluation for a Brownfields
Agreement (BFA).
The next step in the BFA process will involve a detailed review of available environmental and
other relevant data to determine what is currently known about contamination at the Brownfields
Property, and what, if any, information gaps may exist that may require additional assessment. We are
in receipt of the following documents submitted with your BPA:
If available, historical Brownfields Property information from the files of DEQ's Division of
Waste Management will also be utilized during the evaluation process. Please forward any additional
information or data you may have or can acquire for our evaluation. This should include reports from
other DEQ agencies or regional offices. We will contact you regarding any additional assessment that

may be necessary to establish that the Brownfields Property is or can be made suitable for the intended
reuse, as required by statute.
According to the BPA, the intended redevelopment for the Brownfields Property is a school with
associated parking, athletic field, and pick-up/drop-off area. Because risk management decisions may
vary depending on the nature of the redevelopment, it will be important that DEQ review the locations
of the various elements. Please forward any maps or drawings indicating these details, even if they are
only preliminary or conceptual.
Please note: pending execution of a final BFA, NCBP eligibility is provisional. The protections
a BFA offers the Prospective Developer are not in effect, unless and until, the BFA is executed. If you
occupy the Brownfields Property or operate or conduct activities at the Brownfields Property that result
in a release of regulated substances before a BFA has been finalized for the Brownfields Property, you
may be considered to have caused or contributed to contamination at the Brownfields Property. Because
an entity that could be considered to have caused or contributed to contamination at the Brownfields
Property cannot be a Prospective Developer under the Act, your eligibility for participation in the NCBP
would be placed in jeopardy. Consult closely with your Project Manager regarding any planned site
activities prior to agreement finalization. You are cautioned to conduct all such operations and activities
at the Brownfields Property with great care not to cause a release of regulated substances at the
Brownfields Property that could jeopardize your eligibility for participation in the NCBP.
If a party other than the French Broad River Academy, Inc will own the Brownfields Property at
the conclusion of the brownfields process, the final document (which gets recorded at the register of
deeds' office) must be signed not only by Prospective Developer, but by that owner. Failure by the
Prospective Developer to ensure, by the time the BFA negotiations are complete, the willingness to sign
of any such party, and to provide DEQ the exact name, email address, telephone number, and US mail
address of the party (along with the signatory/signatory's tile in the case of an entity) will delay, and
could prevent, the BFA taking effect.
