Dear Mr. DeSimone:
On November 20, 2014, David Peacock of North Carolina Brownfields Program received an
email from you, on behalf of the current owner of the above reference brownfields site. The request
was to reduce or eliminate the sampling requirement in LUR No. 11 in the Notice of Brownfields
Property. The Notice was initially recorded on June 21, 2005 and again on February 1, 2006, by
Paul Ferrigan & Lynda Wolfe. It was recorded at the Mecklenburg Register of Deeds in Book
18912, Page 718 (with the associated plat recorded in Plat Book 43, Page 833) and in Book 19966,
Page 134, respectively. In April 2006, Polymers Foundation, Inc. purchased the brownfields
property and remain current owners.
In the Notice, LUR No. 11 states the following:
11. Beginning in January following the year in which this Notice is recorded, and in every other
January unless and until DENR determines in writing, after a minimum of five (5) sampling events, that
protection of public health and the environment no longer requires such sampling, the owner(s) of the
Brownfields Property shall effect sampling of monitoring wells MW-5B, Mw-5C, MW-6, and MW-7 and
sampling of the adjacent stream in accordance with the most current version of the Guidelines of the Inactive
Hazardous Sites Branch of DENR's Superfund Section. The groundwater and stream samples collected shall
be analyzed by EPA Method 8260 or by another method approved in advance, in writing, by DENR or its
successor in function.
Upon review of the Annual Monitoring Report prepared by S&ME dated February 14, 2014,
DENR hereby approves your request to cease groundwater sampling as contaminant levels have
remain steady or decreased. Be advised that Polymers Foundation, Inc. is still required to submit an
annual LUR Update, but the sampling in LUR 11 is no longer required. Please refer to this
correspondence in future LUR Updates.
