The entire area has been seeded and mulched. I have called Tony to do a new topo survey and I'll get you the results as soon as they're complete. Glad you had a good time at the fesitval. Sorry we didn't get a chance to meet in person. I'll give you a call the next time I'm in Charlotte. One small favor I'd like to ask you for. Can you send me a letter saying that we have agreed to a Bronwsfield's agreement with NCDENR and that we have completed all of the remediation necessary to comply with that agreement? I understand that the process is not complete until the comment period has expired but I have been asked by the previous owner to send him a letter to show him that we have complied with the requirements of the Brownsfield agreement. Thanks and have nice day. Rick Lazes From:RLazes@aol.com To:cminnich@ci.charlotte.nc.us Subject:No Subject Date:Wednesday, May 07, 2003 3:58:14 PM Fiber Mills, LLC Dear Ms. Minnich, I am writing inregards to the Brownsfields Agreement on the Former Southern Manufacturing Site, 1000 Seaboard Street, Charlotte, North Carolina. During the month of April 2003, We installed the geotextile membrane and covered the asbestos contaminated areas with a minimum of six inches of compacted non-asbestos-containing material and we have seeded the area to prevent exposure of the asbestos containing waste as required under our Brownsfields Agreement for that property. I would appreciate your issuing me a letter confirming that this work has been done in compliance with our obligations under our Brownsfields Agreement. Thank you. Best regards, Richard Lazes, president From:Minnich, Carolyn To:" (RLazes@aol.com)" Cc:Bruce Nicholson (E-mail); "mac@arcspecialevents.com" Subject:Southern Manufacturing Soil Cap Date:Monday, May 19, 2003 4:26:19 PM Hi Rick: I met with Mac Goodwin this morning and walked the former Southern Manufacturing Site. The soil capping looks good and we discussed that one area remains to be covered near the corner of Seaboard and Hamilton Street. After reviewing the historical reports and analytical data, the coverage by the stream and near the electrical substation is adequate. No additional coverage is needed in these areas. One outstanding issue is the installation of measuring devices for future inspections. We need some type of rod or pole in the ground to determine if and when erosion occurs over time in the covered areas. These rods should be place in various locations across the site. The rods will be used as a gauge to ensure that the site is adequately covered and maintained in years to come. Upon completion, please send a letter report of the sites activities including the initial and final topographic surveys. The summary letter should include when the site activities occurred and who completed them. I will review the documents and send a letter of approval from the DENR Brownfields Program. At this time, the Responsible Party (Southern Manufacturing) may petition the IHSB Section for removal on the DENR Inactive Hazardous Site Inventory. This section may require additional certification or other activities. Please note, the activities you have completed are in accordance with the DENR Brownfields Program. Per our previous discussion, we agreed to update the plat to reflect actual covered areas. Please forward this plat to my attention prior to the end of public comment for signing the second week in June (assuming no public comments are received). This will ensure the plat reflects field conditions. The plat should also include the locations of the rods for future reference and updates. Thank You. I have spoken to Scott Cornell and provided your phone number to him. He will very likely call you to see what is necessary for him to resume work at the site. Please keep me informed regarding any developments, and if you meet with the involved parties on the site next week, I'd like to be included to meet you, learn something about the brownfield program and agreement for the site (could we get a copy?), and conclude our involvement. Thank you! Richard
