Hi Rick:
I have reviewed the Land Use Restriction Update dated January 5, 4004 and it appears complete. I was
driving by the site and it seems that you are doing quite a bit of work. I noticed some landscaping work
and a small bobcat. I wanted to make sure the landscaping work was protective of the soil cap. Please
ensure that the field personnel are aware of the soil cap and liner. If you have any questions or
comments, please contact me to discuss further.

Below please find a notarized Land Use Restriction Update for the property that is comprisedof approximately 9 acres located at 1000 Seaboard Street, Charlotte, North Carolina:
1. The Notice of Brownfields Property which contains the land use restrictions remains
recorded at the Mecklenburg County Register of Deeds office.
2. The land use restrictions are being complied with.
3. The measures that have been implemented to cover the areas of the Brownfields Propertywhere asbestos-containing waste is located are being maintained such that the asbestos-
containing waste is not exposed.
