This document was submitted in accordance with Land Use Restriction Number 3 in the Notice of Brownfields Property: 3. With the exception of buildings that are not enclosed (for example, an open parking garage), no building may be constructed on the Brownfields Property until DENR has been consulted regarding the proximity of the planned building to any volatile contaminant plume reflected in the most recent sampling results reasonably available to DENR. If DENR determines that the footprint of a building proposed to be constructed on the Brownfields Property would fall within one hundred (100) feet of such a plume, it may not be constructed until the proponent of the building: a. installs a vapor barrier system and/or mechanical or passive vapor mitigation system based on the sampling results referenced above and approved in writing by DENR; or b. prepares an assessment of the risk posed by plume-related soil gas that demonstrates to DENR’s written satisfaction that neither a vapor barrier nor mitigation system is required. Within thirty 30 days following installation of any vapor barrier system and/or mechanical or passive vapor mitigation system required by this subparagraph, DENR shall be provided certification of proper installation under seal of a professional engineer licensed in North Carolina, as well as photographs illustrating the installation and a brief narrative describing it, only after which may the building be used. Ventilation System Submittal - Brownfields Project # 10042-06-60 Shops at Southline Publix (aka Carolina Metals/Southside Properties) 2208-2222 South Blvd - Charlotte, NC (Mecklenburg County) Dear Carolyn: Please let this letter and attached documentation serve as South End Partners, LLC’s request for approval by NCDENR for its mechanical ventilation system being utilized in the construction of the new commercial/retail building and 2-story underground parking garage at the above referenced site. 1.The parking garage will utilize a mechanical ventilation system as required by code. 2.The lower level of the parking garage will utilize continuous running 3,500 CFM exhaust fan along with a 50,000 CFM exhaust fan which will run when carbon monoxide (CO) sensors throughout the garage trigger. See attached Sheet M-101. 3.The upper level of the parking garage will utilize continuous running 3,500 CFM exhaust fan along with a 50,000 CFM exhaust fan which will run when carbon monoxide (CO) sensors throughout the garage trigger. See attached Sheet M-102. 4.Please note that the attached retail shops fronting South Blvd will not have the parking garage below it. This attached structure will have a concrete slab-on-grade. See attached Building Cross Section A1 on the attached Sheet A-301. Although the retail shop bldg. is +/- 200 linear feet from any volatile contaminant plumes, a 10 mil poly vapor barrier is being installed under the floor slab system – See attached Sheet S-104. 5.A site plan (Sheet CV3.0) is also attached for reference and orientation. In paragraph 4 of the proposal, a liner under the Retail Shops is included. This liner is not required, therefore detailed specification and constructions details have not been reviewed by NCBP. Be advised that this approval from the Brownfields Program does not waive any applicable requirement to obtain any necessary permits, licenses or certifications for the above listed activities nor does it waive any requirement to comply with applicable law for such activities.
