On May 19, 2006, a revised work plan for titled “Removal of Potentially Contaminated
Soils Former Sanitary Sewer Line” was submitted for review and comment on the above
referenced brownfields property. For purposes of brownfields agreement compliance, approval
for this work plan is accepted.

Be advised that this approval from the Brownfields Program does not waive any applicable
requirement to obtain any necessary permits, licenses or certifications for the above listed
activities nor does it waive any requirement to comply with applicable law for such activities. If
